  六、(1)、要求乙方自帶工具,安裝(zhuang)時(shi),搬(ban)鋁合金窗(chuang)材(cai)料進業主(zhu)家,要輕拿輕放,不得損壞業主(zhu)的門窗(chuang)、水管、電路和已刮好(hao)的`膩(ni)子粉(fen)墻,特別是(shi)天面吊頂等(deng)非常難補(bu)。另(ling)外在打玻(bo)璃膠時(shi),邊緣要貼上分色紙,以(yi)免(mian)把膩(ni)子粉(fen)墻搞臟。避免(mian)業主(zhu)不應有的損失(shi)。

  (2)、在(zai)安(an)裝過程中,不(bu)得往屋(wu)(wu)外丟棄任何物品,不(bu)得在(zai)屋(wu)(wu)內(nei)吸煙,如(ru)(ru)借用業主的梯(ti)子(zi)、凳子(zi),一定(ding)要(yao)釘牢固(gu)才(cai)能使(shi)用,在(zai)工作(zuo)中必要(yao)時要(yao)系安(an)全(quan)帶等設施(shi),絕對安(an)全(quan)才(cai)能施(shi)工。如(ru)(ru)以上出現事(shi)故由安(an)裝工人負責。

  七、工(gong)作(zuo)時間(jian)從年月日(ri)起至(zhi)年月日(ri)止。

  根據《住宅室內裝(zhuang)飾裝(zhuang)修(xiu)管理辦法》(建(jian)設部令第110號(hao))、《杭(hang)州市城市房屋安(an)全(quan)管理條例》等有關規(gui)定,制定本裝(zhuang)修(xiu)須知(zhi):

  一、住宅室內(nei)裝修活動,禁止(zhi)下列行為:

  (一)違法拆改(gai)、變動承(cheng)重結構和(he)建筑主體;

  (二)違法(fa)超過設計標準或規范(fan)增加房屋使用荷(he)載;

  (三(san))衛生間、廚房間移位、擴(kuo)大或增設;

  (四(si))擴大承重墻(qiang)上原有的門(men)窗尺寸;

  (五)拆除連(lian)接陽臺的磚、混凝土墻(qiang)體;

  (六)其他影響建筑結構和使(shi)用安全(quan)的行為;

  備注:

  1、建筑(zhu)主體(ti),是指建筑(zhu)實體(ti)的結(jie)構(gou)構(gou)造,包括屋蓋、樓(lou)蓋、梁、柱、支(zhi)撐、墻體(ti)、連(lian)接(jie)接(jie)點和(he)基礎等。

  2、承重(zhong)結構,是指(zhi)直接將本身自重(zhong)與各種外加作用力系統地傳(chuan)遞給基礎(chu)地基的`主要結構構件和其連接接點,包(bao)括承重(zhong)墻體(ti)、立桿(gan)、柱、框架柱、支墩(dun)、樓(lou)板、梁、剪力墻、屋(wu)架、懸索等。

  二(er)、房屋所有人或使(shi)用人對住宅房屋裝修(xiu)需進行(xing)下列行(xing)為(wei)之(zhi)一的,應當在(zai)裝修(xiu)前向房屋所在(zai)地區(qu)、縣(市)房屋使(shi)用安全管理部門(men)進行(xing)備案(an):

  (一)拆改、變動非承重結構;

  (二)增(zeng)砌墻體、增(zeng)加房屋使(shi)用(yong)荷載;

  (三)開(kai)鑿(zao)非(fei)承重(zhong)墻體、擴大或移動門窗尺寸(cun)、位置。

  三(san)、房(fang)屋所(suo)有(you)人(ren)或(huo)(huo)(huo)使(shi)用人(ren)裝(zhuang)修房(fang)屋需要搭建(jian)建(jian)筑物、構筑物,或(huo)(huo)(huo)改變(bian)建(jian)筑物外立面(mian)、改變(bian)房(fang)屋使(shi)用性質等行(xing)(xing)為的(de),房(fang)屋所(suo)有(you)人(ren)或(huo)(huo)(huo)使(shi)用人(ren)應(ying)當(dang)依法(fa)經規劃或(huo)(huo)(huo)其他行(xing)(xing)政(zheng)主(zhu)管(guan)部門批準后方可實施。

  四(si)、住宅小區(qu)房屋裝(zhuang)修違法違規(gui)行為(wei)處罰:

  (一)房(fang)(fang)屋(wu)所有人或使(shi)用(yong)人在(zai)住(zhu)宅房(fang)(fang)屋(wu)裝修中實施(shi)禁止行(xing)為(wei)的(de),按照《中華(hua)人民共和國建(jian)(jian)(jian)(jian)筑(zhu)法》、國務(wu)(wu)院(yuan)《建(jian)(jian)(jian)(jian)設工(gong)程質量(liang)(liang)管理(li)條例》等相關規定處罰。(根據國務(wu)(wu)院(yuan)《建(jian)(jian)(jian)(jian)設工(gong)程質量(liang)(liang)管理(li)條例》第69條規定,房(fang)(fang)屋(wu)建(jian)(jian)(jian)(jian)筑(zhu)使(shi)用(yong)者在(zai)裝修過程中擅自變動房(fang)(fang)屋(wu)建(jian)(jian)(jian)(jian)筑(zhu)主體結構和承重結構的(de),責令(ling)改正,處5萬元以上10萬元以下的(de)罰款。)

  (二)住宅(zhai)房(fang)(fang)(fang)屋所有人或使用(yong)人未在(zai)住宅(zhai)房(fang)(fang)(fang)屋裝修(xiu)前(qian)進行備案的,由房(fang)(fang)(fang)屋所在(zai)地區、縣(市)房(fang)(fang)(fang)屋使用(yong)安全(quan)管理部門責(ze)令其補辦手續,并可處(chu)以(yi)500元的罰款。

  茲就乙(yi)方(fang)(fang)(fang)委托丙方(fang)(fang)(fang)在甲(jia)方(fang)(fang)(fang)管理的某(mou)社(she)區內(nei)進行乙(yi)方(fang)(fang)(fang)所擁有房屋(wu)裝修工程事宜(yi),經(jing)叁(san)方(fang)(fang)(fang)協(xie)商(shang)簽定本協(xie)議書,具體(ti)條(tiao)文如下(xia),系叁(san)方(fang)(fang)(fang)共同遵守:

  1.應(ying)注意(yi)之事(shi)項

  上海(hai)某社區為(wei)一個高級(ji)商住物業(ye),管理公司必須(xu)嚴格管制各項裝修工程,以使(shi)某社區能(neng)成為(wei)高尚而環境(jing)優(you)美的(de)高級(ji)物業(ye),并祈達成下列目(mu)的(de):

  (1)促使物業價值日增;

  (2)減少火警發生及因擅自加(jia)建或改裝而(er)引(yin)致(zhi)之安(an)全(quan)及衛生問題;

  (3)避(bi)免擾(rao)及鄰居;

  (4)減少(shao)日後物業保養難題;

  (5)確(que)保遵守上海市政府及房管機關(guan)有關(guan)法規。

  業主應嚴格遵守有(you)關(guan)(guan)現行法(fa)規的規定,并聘用法(fa)律規定的認(ren)可人士進行工(gong)程。若有(you)任(ren)何(he)疑(yi)問,應向上(shang)海市(shi)政(zheng)府及有(you)關(guan)(guan)房管機(ji)關(guan)(guan)查詢。

  2.裝修(xiu)及施工(gong)工(gong)程守則(ze)

  單(dan)元(yuan)的(de)(de)業(ye)(ye)主(zhu)如需在該單(dan)元(yuan)內(nei)進行(xing)(xing)裝修,業(ye)(ye)主(zhu)及(ji)其(qi)所雇(gu)用(yong)的(de)(de)施工(gong)(gong)單(dan)位必(bi)須嚴格遵(zun)守(shou)(shou)管理公司(si)的(de)(de)有(you)關規(gui)定和安裝標準進行(xing)(xing)裝修工(gong)(gong)程,不得損及(ji)社區房(fang)屋的(de)(de)建筑(zhu)結構。一切費用(yong)由業(ye)(ye)主(zhu)自行(xing)(xing)負擔。業(ye)(ye)主(zhu)及(ji)其(qi)所雇(gu)用(yong)的(de)(de)施工(gong)(gong)單(dan)位應遵(zun)守(shou)(shou)的(de)(de)規(gui)定包括但(dan)不限於:

  (1)在對該單元進(jin)行裝(zhuang)修前,業主必須向管(guan)理公司提(ti)出書面申請(申請表如(ru)附件),并提(ti)供該單元有(you)資質(zhi)的設(she)計單位有(you)效圖(tu)簽(qian)的裝(zhuang)修圖(tu)紙(包括但不(bu)(bu)限(xian)於平面配置(zhi)圖(tu)、水(shui)電施工圖(tu))和資料(liao)(liao)。在不(bu)(bu)影響社區房屋結構、管(guan)道、電源(yuan)、整體外(wai)觀、公共設(she)施等(deng)和不(bu)(bu)觸犯(fan)本公約規(gui)(gui)定、有(you)關政(zheng)府法規(gui)(gui)下,管(guan)理公司會對業主的申請進(jin)行審(shen)批,審(shen)批工作(zuo)自(zi)資料(liao)(liao)完整的'申請表提(ti)交後(hou)(hou)叁個工作(zuo)天完成(cheng),若有(you)資料(liao)(liao)欠缺或資質(zhi)不(bu)(bu)符,自(zi)補(bu)件完成(cheng)後(hou)(hou)叁個工作(zuo)天完成(cheng)審(shen)批;

  (2)施工(gong)單位或裝(zhuang)修(xiu)(xiu)公司在進行裝(zhuang)修(xiu)(xiu)前必須對所(suo)(suo)裝(zhuang)修(xiu)(xiu)工(gong)程(cheng)投保(bao)有(you)效的、具足夠(gou)保(bao)險(xian)金額的“安裝(zhuang)工(gong)程(cheng)一切險(xian)”和“安裝(zhuang)工(gong)程(cheng)第(di)叁(san)者責任險(xian)”(安裝(zhuang)工(gong)程(cheng)期(qi)間)投保(bao)保(bao)險(xian)所(suo)(suo)需的保(bao)險(xian)費或任何其他(ta)費用均(jun)由業(ye)主(zhu)、施工(gong)單位或裝(zhuang)修(xiu)(xiu)公司自行負(fu)擔。未(wei)經管理公司審閱和批準(zhun)的安裝(zhuang)工(gong)程(cheng),任何加建及(ji)改裝(zhuang)工(gong)程(cheng)一概(gai)不準(zhun)動工(gong)。

  (3)施工(gong)單位人員進入(ru)社區,經管理公(gong)司(si)批準(zhun)并辦妥各式出(chu)入(ru)通(tong)行證後(hou)方可施工(gong);施工(gong)單位人員進入(ru)社區必(bi)須遵守管理公(gong)司(si)對於門衛保(bao)安要求的作(zuo)業規(gui)登記等手續。

  (4)業主(zhu)經管(guan)理公司同意對該單(dan)元進行裝(zhuang)修(xiu)後,業主(zhu)須與管(guan)理公司安排施工材料的(de)搬運時(shi)間、地(di)點及(ji)所經通(tong)道,不得占(zhan)用(yong)、阻(zu)塞公共(gong)地(di)方,亦不得弄污、損壞(huai)、堵塞公共(gong)地(di)方和公共(gong)設施;

  (5)進行裝修時(shi),業(ye)主(zhu)須保持社區(qu)公(gong)(gong)共地方和公(gong)(gong)共設備(bei)的清潔和該(gai)單元內(nei)部(bu)衛生,對施工用(yong)的材料、易燃物(wu)件或有揮發性的化學物(wu)品一(yi)定(ding)當心保管(guan)及(ji)使用(yong),不可抽(chou)煙,以免發生災(zai)害。一(yi)切廢物(wu)和施工垃圾由(you)業(ye)主(zhu)自費并即時(shi)清除和運(yun)走;

  (6)管(guan)理公司(si)有權在(zai)施(shi)工(gong)期內進入(ru)該(gai)單元(yuan)視察各(ge)項工(gong)程(cheng)是否符合管(guan)理公司(si)的(de)審批規格。如發現有違章施(shi)工(gong)情(qing)況(kuang),管(guan)理公司(si)可要求業主和施(shi)工(gong)單位立即停(ting)工(gong),并(bing)采(cai)取(qu)相應步驟糾正和補救違章施(shi)工(gong)情(qing)況(kuang),其間所(suo)引起的(de)一切費(fei)用(yong)、損失或經濟責任,均由業主自行負擔,與管(guan)理公司(si)無涉。

  (7)因(yin)裝修施工或(huo)其他(ta)任何行為引致(zhi)他(ta)人受傷或(huo)財物損失均由業主負責。

  (8)其他(ta)禁(jin)止項目

  業主不得

  (1)改變任(ren)何渠道、管井及其他公共裝置;

  (2)懸(xuan)掛(gua)或裝設任何物件於窗(chuang)外(綠化(hua)植栽除外但(dan)須注意(yi)安(an)全(quan));

  (3)更改樓宇主要結構(如支柱橫梁、結構墻(qiang)、樓面及天花);

  (4)裝置神位或任何物體於單位外;

  (5)更改原有屋外(wai)(wai)設計及(ji)外(wai)(wai)貌(mao),例如(ru)不可擊穿外(wai)(wai)墻裝置空調(diao)機或(huo)其他(ta)用途(tu);

  (6)在單元大門或(huo)窗(chuang)口(kou)裝置(zhi)鐵閘或(huo)窗(chuang)花。

  (9)空調機

  社區(qu)所有單元(yuan)內(nei)已(yi)備(bei)(bei)有適(shi)當的位(wei)置可(ke)供安裝空(kong)調(diao)(diao)設(she)備(bei)(bei),管(guan)(guan)理(li)公司(si)嚴禁(jin)業主擊穿墻壁(bi)作(zuo)安裝空(kong)調(diao)(diao)機(ji)或其他(ta)物(wu)件(jian)。及(ji)任何(he)空(kong)調(diao)(diao)設(she)備(bei)(bei)、室(shi)外管(guan)(guan)線(xian)任意垂懸、按置於非指(zhi)定(ding)位(wei)置(尤(you)其是外墻墻面(mian))

  (10)電(dian)視(shi)天線

  客廳及主人房間(jian)均設有(you)電(dian)視視訊插座,接(jie)收(shou)有(you)線(xian)電(dian)視節目(mu)(mu)及衛星(xing)電(dian)視節目(mu)(mu),因此嚴(yan)禁在窗戶及外(wai)墻裝置任何(he)形式天線(xian)。

  (11)抽氣(qi)風(feng)扇

  社區所有(you)單元內廚房及(ji)不直接采(cai)光浴室皆預裝抽油煙機及(ji)抽氣扇,業(ye)主(zhu)不得另擊穿墻壁(bi)或天(tian)花以(yi)安裝抽氣扇。

  (12)遮陽篷帳及檐篷

  任(ren)何(he)臨(lin)時或永久(jiu)性之(zhi)遮陽篷(peng)及檐篷(peng)不得設置。

  (13)門窗

  所(suo)有業主(zhu)不(bu)得(de)拆除或更換建筑物(wu)外觀門窗,門窗亦不(bu)可(ke)改裝反光玻(bo)璃或是其(qi)他(ta)類似材質(zhi),以免影響其(qi)他(ta)住戶(hu)。

  (14)裝修工(gong)程施工(gong)時間:

  為避(bi)免裝修工程施工所產生的(de)噪音、污染影(ying)響小區住戶的(de)安寧(ning),施工時(shi)(shi)(shi)間(jian)訂(ding)為上午08:00至晚上20:00時(shi)(shi)(shi),在此時(shi)(shi)(shi)段(duan)(duan)以外時(shi)(shi)(shi)間(jian)禁止(zhi)施工,如因特殊狀況(kuang)需要(yao)在規定(ding)時(shi)(shi)(shi)段(duan)(duan)以外時(shi)(shi)(shi)間(jian)施工,必須先(xian)向管理公司申(shen)請施工許(xu)可,經審(shen)批通過以後才準許(xu)施工(但一(yi)定(ding)要(yao)遵循審(shen)批時(shi)(shi)(shi)要(yao)求的(de)條件)

  3.裝(zhuang)修公司及裝(zhuang)修公司保證金(jin)

(zheng)(zheng)(zheng)金(jin)一(yi)經(jing)退(tui)還後,如(ru)業(ye)(ye)(ye)(ye)主(zhu)(zhu)(zhu)再欲裝(zhuang)(zhuang)修(xiu)(xiu)(xiu)(xiu),必須(xu)(xu)(xu)重新申請(qing)并(bing)再繳(jiao)(jiao)裝(zhuang)(zhuang)修(xiu)(xiu)(xiu)(xiu)保(bao)(bao)(bao)證(zheng)(zheng)(zheng)(zheng)金(jin),方可(ke)(ke)施(shi)(shi)工(gong)(gong)(gong)(gong)(gong)(gong)。為(wei)(wei)保(bao)(bao)(bao)障業(ye)(ye)(ye)(ye)主(zhu)(zhu)(zhu)本(ben)身利益,殷望各業(ye)(ye)(ye)(ye)主(zhu)(zhu)(zhu)衷誠合作,管(guan)理(li)(li)公(gong)(gong)(gong)(gong)(gong)(gong)司(si)(si)(si)(si)辦理(li)(li)登(deng)記(ji),主(zhu)(zhu)(zhu)動提供裝(zhuang)(zhuang)修(xiu)(xiu)(xiu)(xiu)公(gong)(gong)(gong)(gong)(gong)(gong)司(si)(si)(si)(si)資質證(zheng)(zheng)(zheng)(zheng)明及(ji)繳(jiao)(jiao)交保(bao)(bao)(bao)證(zheng)(zheng)(zheng)(zheng)金(jin)。

  甲方:物(wu)業有限(xian)責任公(gong)司

  乙方(業主):

  丙方(施工單位或個人):

  茲有業主(乙(yi)(yi)方(fang))委(wei)托裝修公(gong)司或個人(丙方(fang))在(zai)甲方(fang)管理的住宅小區(qu)號(hao)(hao)小區(qu)號(hao)(hao)樓(lou)單(dan)元號(hao)(hao)房內進行裝修。乙(yi)(yi)方(fang)所擁有房屋(wu)裝修工程事宜,經(jing)叁(san)方(fang)協商簽定(ding)本(ben)協議書(shu),具體條文如(ru)下,系叁(san)方(fang)共同遵守:

  1、應注意之事(shi)項

  物(wu)業公司必須嚴格管制各項裝(zhuang)修工程,以使(shi)小區能成(cheng)為高尚而環境優美的高級物(wu)業,并祈達成(cheng)下列目(mu)的:

  (1)促使物業(ye)價值日增;

  (2)減少火警發生(sheng)及因擅自加建或改裝而引致之安全及衛(wei)生(sheng)問題;

  (3)避(bi)免擾及鄰居;

  (4)減少(shao)日後物業保養難(nan)題;

  (5)確(que)保(bao)遵守市(shi)政府及(ji)房管機關有關法規。

  業主應嚴格遵守有(you)關現(xian)行法規(gui)的規(gui)定(ding),并聘用法律規(gui)定(ding)的認可(ke)人(ren)

  士(shi)進行工程。若有(you)任何疑問,應向市政府(fu)及有(you)關房管機關查詢(xun)。

  2、裝修及施工工程守則

  單(dan)(dan)元的(de)業主(zhu)如需(xu)在該單(dan)(dan)元內進(jin)行(xing)裝修,業主(zhu)及(ji)其所雇用的(de)施工單(dan)(dan)位必(bi)須嚴格遵(zun)守管理公司的(de)有關規定和安裝標準進(jin)行(xing)裝修工程,不得(de)

  損(sun)及(ji)社(she)區(qu)房屋的(de)建筑結構。一切費用由業(ye)主自(zi)行負(fu)擔。業(ye)主及(ji)其所雇用的(de)`施工(gong)單(dan)位應(ying)遵守的(de)規定包括但不(bu)限於:

  (1)在對(dui)該(gai)單元(yuan)進行(xing)(xing)裝(zhuang)修(xiu)前,業主必須向(xiang)管理公(gong)司提出書面申請(申請表如附件),并(bing)提供該(gai)單元(yuan)有(you)資(zi)(zi)質(zhi)的設(she)計單位(wei)有(you)效(xiao)圖簽的裝(zhuang)修(xiu)圖紙(包括但不限於(wu)平面配(pei)Z圖、水電(dian)施(shi)工(gong)圖)和(he)資(zi)(zi)料。在不影響(xiang)社區房(fang)屋(wu)結構(gou)、管道、電(dian)源、整體外觀、公(gong)共設(she)施(shi)等和(he)不觸犯(fan)本公(gong)約規定、有(you)關政(zheng)府法規下,管理公(gong)司會對(dui)業主的申請進行(xing)(xing)審批,審批工(gong)作(zuo)自(zi)資(zi)(zi)料完(wan)整的申請表提交後(hou)叁(san)(san)個(ge)工(gong)作(zuo)天完(wan)成,若有(you)資(zi)(zi)料欠缺或資(zi)(zi)質(zhi)不符,自(zi)補件完(wan)成後(hou)叁(san)(san)個(ge)工(gong)作(zuo)天完(wan)成審批;

  (2)施工(gong)(gong)單位(wei)或(huo)裝(zhuang)(zhuang)(zhuang)修(xiu)公(gong)司(si)在進行裝(zhuang)(zhuang)(zhuang)修(xiu)前必須對所(suo)裝(zhuang)(zhuang)(zhuang)修(xiu)工(gong)(gong)程(cheng)投保有效的(de)、具足夠(gou)保險金額的(de)“安裝(zhuang)(zhuang)(zhuang)工(gong)(gong)程(cheng)一切險”和“安裝(zhuang)(zhuang)(zhuang)工(gong)(gong)程(cheng)第叁者(zhe)責任(ren)險”(安裝(zhuang)(zhuang)(zhuang)工(gong)(gong)程(cheng)期間)投保保險所(suo)需的(de)保險費(fei)或(huo)任(ren)何(he)其(qi)他費(fei)用(yong)均由(you)業主、施工(gong)(gong)單位(wei)或(huo)裝(zhuang)(zhuang)(zhuang)修(xiu)公(gong)司(si)自(zi)行負(fu)擔(dan)。未經管理公(gong)司(si)審(shen)閱和批準的(de)安裝(zhuang)(zhuang)(zhuang)工(gong)(gong)程(cheng),任(ren)何(he)加建及(ji)改裝(zhuang)(zhuang)(zhuang)工(gong)(gong)程(cheng)一概不(bu)準動(dong)工(gong)(gong)。

  (3)施(shi)工(gong)單位人員進(jin)(jin)入(ru)(ru)社區,經(jing)管(guan)理(li)公司批準并辦妥各式出(chu)入(ru)(ru)通行證後方可(ke)施(shi)工(gong);施(shi)工(gong)單位人員進(jin)(jin)入(ru)(ru)社區必(bi)須遵守管(guan)理(li)公司對(dui)於門衛保安(an)要求的作業規(gui)登(deng)記(ji)等手續。

  (4)業主經(jing)管(guan)理(li)公司同意對該單(dan)元進行裝修後(hou),業主須(xu)與管(guan)理(li)公司安排(pai)施工材料(liao)的搬運時間(jian)、地(di)點及所經(jing)通道,不得占用、阻塞公共地(di)方,亦不得弄污、損壞、堵塞公共地(di)方和公共設施;

  (5)進(jin)行裝修時,業主(zhu)須保(bao)持社(she)區公(gong)共地方(fang)和公(gong)共設備的清潔和該單元內部(bu)衛生,對施工用的材料(liao)、易燃物件或有揮發性的化學物品

  一(yi)定當心保管(guan)及(ji)使用,不可抽煙,以免發生災害。一(yi)切廢物和(he)施工垃(la)圾由業主自費并即時清除(chu)和(he)運走;

  (6)管(guan)(guan)理公(gong)(gong)司(si)有(you)權在施工(gong)期內進(jin)入該單元視(shi)察各項工(gong)程(cheng)是否符合管(guan)(guan)理公(gong)(gong)司(si)的審批規(gui)格。如發現有(you)違章(zhang)施工(gong)情(qing)況(kuang),管(guan)(guan)理公(gong)(gong)司(si)可要求(qiu)業主(zhu)和(he)(he)施工(gong)單位立即(ji)停工(gong),并采取相應步驟糾正和(he)(he)補救違章(zhang)施工(gong)情(qing)況(kuang),其間(jian)所引起(qi)的一切(qie)費用(yong)、損失(shi)或經濟責(ze)任,均由業主(zhu)自行負擔,與管(guan)(guan)理公(gong)(gong)司(si)無涉。

  (7)因裝修施工(gong)或(huo)其他任何行為引致(zhi)他人受傷或(huo)財物損失均由業主負責。

  (8)其他禁止(zhi)項(xiang)目業主不得:

  1)改(gai)變任何渠道、管井及其他(ta)公共裝;

  2)懸掛或裝(zhuang)設任(ren)何物件於窗(chuang)外(綠化(hua)植(zhi)栽除外但須注(zhu)意安(an)全(quan));

  3)更(geng)改(gai)樓(lou)(lou)宇主要結構(如支柱橫(heng)梁、結構墻(qiang)、樓(lou)(lou)面及天花);

  4)裝Z位(wei)或任(ren)何物體(ti)於(wu)單位(wei)外;

  5)更改原有屋外設計及外貌(mao),例如不可(ke)擊穿外墻裝Z空調機(ji)或(huo)其(qi)他用途;

  6)在單元大(da)門或(huo)窗口裝Z鐵閘或(huo)窗花。

  9)空調機

  社區所有(you)單元內(nei)已備(bei)有(you)適當的位Z可供安(an)裝空(kong)調(diao)設備(bei),管理公(gong)司嚴禁業主擊穿墻壁作安(an)裝空(kong)調(diao)機(ji)或其他(ta)物件。及任何(he)空(kong)調(diao)設備(bei)、室(shi)外(wai)管線任意(yi)垂懸、按Z於非指定位Z(尤其是外(wai)墻墻面)

  10)電視天線

  客(ke)廳(ting)及主(zhu)人房間均(jun)設有(you)電(dian)視(shi)視(shi)訊插座,接收有(you)線電(dian)視(shi)節目及衛星電(dian)視(shi)節目,因(yin)此嚴(yan)禁在窗戶(hu)及外墻裝Z任何(he)形式天(tian)線。

  11)抽氣風扇

  社區(qu)所有單元內廚房及不直接采(cai)光浴室皆預裝抽油(you)煙機及抽氣(qi)扇,業(ye)主不得另擊穿墻壁或天花以安裝抽氣(qi)扇。

  12)遮(zhe)陽篷(peng)帳及檐(yan)篷(peng)

  任何臨時或永久性(xing)之遮陽篷及檐篷不得設(she)Z。

  13)門窗

  所有業(ye)主不得拆除或(huo)(huo)更換建(jian)筑物外觀門窗,門窗亦不可改裝(zhuang)反光玻璃或(huo)(huo)是其他類似(si)材質,以免影響其他住戶。

  14)裝修(xiu)工程施(shi)工時間:

  為避免裝修工程施(shi)工所產生的(de)噪音(yin)、污(wu)染影響小區住戶的(de)安寧,施(shi)工時(shi)(shi)(shi)(shi)(shi)間(jian)(jian)訂為上(shang)(shang)午09:00至(zhi)上(shang)(shang)午14:00時(shi)(shi)(shi)(shi)(shi),16:00至(zhi)晚上(shang)(shang)22:00在此時(shi)(shi)(shi)(shi)(shi)段以外(wai)時(shi)(shi)(shi)(shi)(shi)間(jian)(jian)禁止施(shi)工,如因特(te)殊狀況需要(yao)在規定時(shi)(shi)(shi)(shi)(shi)段以外(wai)時(shi)(shi)(shi)(shi)(shi)間(jian)(jian)施(shi)工,必須先向(xiang)管理公司申請施(shi)工許(xu)可,經(jing)審(shen)批通過以後才準許(xu)施(shi)工(但一定要(yao)遵循審(shen)批時(shi)(shi)(shi)(shi)(shi)要(yao)求的(de)條件(jian))

  3、裝(zhuang)修公司及裝(zhuang)修公司保證金

  社(she)(she)區(qu)施工(gong)(gong)(gong)的業主(zhu)都需要向(xiang)管(guan)(guan)(guan)理(li)(li)(li)公(gong)(gong)(gong)司(si)(si)(si)登記(ji)、申(shen)辦施工(gong)(gong)(gong)許可(ke),業主(zhu)繳(jiao)(jiao)付保(bao)證(zheng)(zheng)(zheng)(zheng)金(jin)人(ren)(ren)民幣(bi)二仟元(yuan)正(zheng)(金(jin)額(e)可(ke)按需要隨(sui)時調(diao)整)此項(xiang)保(bao)證(zheng)(zheng)(zheng)(zheng)金(jin)作(zuo)(zuo)(zuo)為(wei)保(bao)證(zheng)(zheng)(zheng)(zheng)該(gai)業主(zhu)及(ji)(ji)(ji)其(qi)所雇用(yong)的施工(gong)(gong)(gong)單位(wei)(wei)在(zai)(zai)裝(zhuang)(zhuang)修(xiu)(xiu)(xiu)(xiu)(xiu)(xiu)某單元(yuan)完工(gong)(gong)(gong)後(hou),清理(li)(li)(li)所有(you)裝(zhuang)(zhuang)修(xiu)(xiu)(xiu)(xiu)(xiu)(xiu)廢(fei)料、自費修(xiu)(xiu)(xiu)(xiu)(xiu)(xiu)理(li)(li)(li)所有(you)因(yin)裝(zhuang)(zhuang)修(xiu)(xiu)(xiu)(xiu)(xiu)(xiu)工(gong)(gong)(gong)程而(er)導致損(sun)毀(hui)的公(gong)(gong)(gong)共設施,及(ji)(ji)(ji)將管(guan)(guan)(guan)理(li)(li)(li)公(gong)(gong)(gong)司(si)(si)(si)發(fa)出的工(gong)(gong)(gong)作(zuo)(zuo)(zuo)證(zheng)(zheng)(zheng)(zheng)交(jiao)回。該(gai)等工(gong)(gong)(gong)人(ren)(ren)出入(ru)本(ben)社(she)(she)區(qu)時,必須(xu)出示其(qi)工(gong)(gong)(gong)作(zuo)(zuo)(zuo)證(zheng)(zheng)(zheng)(zheng)供駐(zhu)守社(she)(she)區(qu)入(ru)口的保(bao)安管(guan)(guan)(guan)理(li)(li)(li)員查驗登記(ji)。裝(zhuang)(zhuang)修(xiu)(xiu)(xiu)(xiu)(xiu)(xiu)公(gong)(gong)(gong)司(si)(si)(si)須(xu)繳(jiao)(jiao)交(jiao)每張(zhang)臨時工(gong)(gong)(gong)作(zuo)(zuo)(zuo)出入(ru)證(zheng)(zheng)(zheng)(zheng)工(gong)(gong)(gong)本(ben)費人(ren)(ren)民幣(bi)貳拾圓正(zheng)(此金(jin)額(e)可(ke)依實際狀(zhuang)況需要而(er)隨(sui)時變動(dong)),管(guan)(guan)(guan)理(li)(li)(li)公(gong)(gong)(gong)司(si)(si)(si)才發(fa)給(gei)臨時工(gong)(gong)(gong)作(zuo)(zuo)(zuo)證(zheng)(zheng)(zheng)(zheng)。管(guan)(guan)(guan)理(li)(li)(li)公(gong)(gong)(gong)司(si)(si)(si)會(hui)隨(sui)時突擊檢(jian)查裝(zhuang)(zhuang)修(xiu)(xiu)(xiu)(xiu)(xiu)(xiu)工(gong)(gong)(gong)人(ren)(ren)是否領有(you)管(guan)(guan)(guan)理(li)(li)(li)公(gong)(gong)(gong)司(si)(si)(si)發(fa)給(gei)的工(gong)(gong)(gong)作(zuo)(zuo)(zuo)證(zheng)(zheng)(zheng)(zheng)。管(guan)(guan)(guan)理(li)(li)(li)公(gong)(gong)(gong)司(si)(si)(si)有(you)權拒絕任何(he)未領有(you)工(gong)(gong)(gong)作(zuo)(zuo)(zuo)證(zheng)(zheng)(zheng)(zheng)之裝(zhuang)(zhuang)修(xiu)(xiu)(xiu)(xiu)(xiu)(xiu)工(gong)(gong)(gong)人(ren)(ren)在(zai)(zai)社(she)(she)區(qu)內進(jin)行任何(he)工(gong)(gong)(gong)程。管(guan)(guan)(guan)理(li)(li)(li)公(gong)(gong)(gong)司(si)(si)(si)在(zai)(zai)確(que)定裝(zhuang)(zhuang)修(xiu)(xiu)(xiu)(xiu)(xiu)(xiu)公(gong)(gong)(gong)司(si)(si)(si)完全遵(zun)守有(you)關條(tiao)款後(hou),并經有(you)關業主(zhu)在(zai)(zai)裝(zhuang)(zhuang)修(xiu)(xiu)(xiu)(xiu)(xiu)(xiu)工(gong)(gong)(gong)程申(shen)請(qing)(qing)表背(bei)面簽認(ren)該(gai)公(gong)(gong)(gong)司(si)(si)(si)裝(zhuang)(zhuang)修(xiu)(xiu)(xiu)(xiu)(xiu)(xiu)其(qi)單元(yuan)妥當後(hou),裝(zhuang)(zhuang)修(xiu)(xiu)(xiu)(xiu)(xiu)(xiu)保(bao)證(zheng)(zheng)(zheng)(zheng)金(jin)可(ke)以(yi)免息發(fa)還。未經業主(zhu)背(bei)書之裝(zhuang)(zhuang)修(xiu)(xiu)(xiu)(xiu)(xiu)(xiu)公(gong)(gong)(gong)司(si)(si)(si)保(bao)證(zheng)(zheng)(zheng)(zheng)金(jin),在(zai)(zai)通常情況下(xia)不(bu)會(hui)發(fa)還。倘若裝(zhuang)(zhuang)修(xiu)(xiu)(xiu)(xiu)(xiu)(xiu)保(bao)證(zheng)(zheng)(zheng)(zheng)金(jin)不(bu)足彌補(bu)上述(shu)費用(yong)時,有(you)關業主(zhu)須(xu)責成施工(gong)(gong)(gong)單位(wei)(wei)向(xiang)管(guan)(guan)(guan)理(li)(li)(li)公(gong)(gong)(gong)司(si)(si)(si)繳(jiao)(jiao)付其(qi)差(cha)額(e)。裝(zhuang)(zhuang)修(xiu)(xiu)(xiu)(xiu)(xiu)(xiu)保(bao)證(zheng)(zheng)(zheng)(zheng)金(jin)一(yi)經退還後(hou),如業主(zhu)再欲裝(zhuang)(zhuang)修(xiu)(xiu)(xiu)(xiu)(xiu)(xiu),必須(xu)重新申(shen)請(qing)(qing)并再繳(jiao)(jiao)裝(zhuang)(zhuang)修(xiu)(xiu)(xiu)(xiu)(xiu)(xiu)保(bao)證(zheng)(zheng)(zheng)(zheng)金(jin),方可(ke)施工(gong)(gong)(gong)。為(wei)保(bao)障業主(zhu)本(ben)身利益,殷(yin)望各業主(zhu)衷誠合作(zuo)(zuo)(zuo),管(guan)(guan)(guan)理(li)(li)(li)公(gong)(gong)(gong)司(si)(si)(si)辦理(li)(li)(li)登記(ji),主(zhu)動(dong)提供裝(zhuang)(zhuang)修(xiu)(xiu)(xiu)(xiu)(xiu)(xiu)公(gong)(gong)(gong)司(si)(si)(si)資(zi)質(zhi)證(zheng)(zheng)(zheng)(zheng)明及(ji)(ji)(ji)繳(jiao)(jiao)交(jiao)保(bao)證(zheng)(zheng)(zheng)(zheng)金(jin)。

  4、改裝及加建工(gong)程

  當業(ye)(ye)主裝修物業(ye)(ye)時,謹請留(liu)意切(qie)勿違反政府(fu)條例(li)或“業(ye)(ye)主公約”,否(fou)則業(ye)(ye)主須(xu)將物業(ye)(ye)恢復原狀,或有可能受到上海市政府(fu)有關(guan)機關(guan)檢(jian)控。

  未經(jing)物(wu)業公司書面批準(zhun)之加建及改裝(zhuang)工(gong)程,一概不準(zhun)動(dong)工(gong)。經(jing)物(wu)

  業(ye)公(gong)司批準加建(jian)(jian)及(ji)(ji)改(gai)裝工(gong)(gong)(gong)程申請書,只表示(shi)管(guan)理公(gong)司不反對所擬加建(jian)(jian)及(ji)(ji)改(gai)裝工(gong)(gong)(gong)程,而(er)任何工(gong)(gong)(gong)程若有違反國(guo)有土地使用許(xu)可證或(huo)(huo)/及(ji)(ji)公(gong)約或(huo)(huo)/及(ji)(ji)市政(zheng)府(fu)法規(gui)各條款,發(fa)展商(shang)及(ji)(ji)管(guan)理公(gong)司概不負(fu)責。加建(jian)(jian)及(ji)(ji)改(gai)裝工(gong)(gong)(gong)程批準書須經市政(zheng)府(fu)有關機關或(huo)(huo)其他有關政(zheng)府(fu)部(bu)門的允許(xu)及(ji)(ji)批準方能成(cheng)立。

  倘若(ruo)發現有(you)非法或未經(jing)批準的加(jia)建及(ji)(ji)改裝工(gong)程(cheng)正(zheng)在進行(xing)或存在,管(guan)理(li)公司可依法采取(qu)法律行(xing)動或其他行(xing)動加(jia)以制止,或依據公約(yue)條款要求(qiu)作出更正(zheng)。如有(you)任何法律費用或/及(ji)(ji)有(you)關支出或/及(ji)(ji)賠償,須由有(you)關業(ye)主全部負責。如有(you)疑問,請尋(xun)求(qiu)獨立專(zhuan)業(ye)意見(jian)及(ji)(ji)向管(guan)理(li)公司查詢(xun)。

  5、裝修工程如用重(zhong)型機(ji)械須知

  除非已得(de)管理公司書(shu)面批準及由裝修(xiu)商(shang)交付特別裝修(xiu)保證金,任何(he)重(zhong)型(xing)機械不得(de)進入本社區(qu)內。

  甲方:泉州摯誠物業有(you)限公(gong)司

  乙方:(裝修(xiu)業(ye)主)

  為了(le)共同(tong)維護本物(wu)業(ye)的房屋完好、環境整潔、優美(mei),維護廣大業(ye)主的利益,甲、乙雙方根(gen)據《泉州市居(ju)住(zhu)物(wu)業(ye)管理條例》和《住(zhu)宅使用(yong)公約》特制訂本管理合同(tong)。

  一、甲(jia)方作(zuo)為本物(wu)業(ye)的管理(li)單位,有責任(ren)對業(ye)戶的裝修(xiu)工(gong)作(zuo)進行檢查、監(jian)督(du)和管理(li)。

  二、乙方在實施裝(zhuang)修過程中,愿意(yi)接受物業管(guan)理單位的監督(du)和管(guan)理,遵(zun)守《住宅使用公約(yue)》。

  三、乙方應嚴(yan)格按(an)照物(wu)業服務管理中心審驗(yan)備案(an)的裝修方案(an)施(shi)工(gong),不得擅自增加項目,改變(bian)施(shi)工(gong)圖紙(zhi),不得擅自變(bian)動戶內原有的設(she)備及設(she)施(shi),嚴(yan)禁(jin)損(sun)壞承重墻。

  四、乙(yi)方(fang)裝修(xiu)施工期為 天,自 年 月 日(ri)起,至 年 月 日(ri)裝修(xiu)施工結束。

  五、乙方把(ba)裝(zhuang)修(xiu)建筑垃(la)圾袋裝(zhuang)后(hou),集(ji)中(zhong)堆(dui)放(fang)至小(xiao)區 處,并保持周(zhou)邊環境的整潔。

  六、乙方(fang)應督(du)促所委托裝修房屋的施工(gong)隊到(dao)物業服務管理(li)中心辦理(li)施工(gong)許可證和施工(gong)人員出入證。

  七(qi)、物業(ye)服務管理中心(xin)的(de)服務人員有權(quan)查(cha)驗施工人員的(de)出入證和身份證,如發(fa)現偽(wei)造、冒用、證件過期、無證作業(ye),甲方可(ke)向施工單位罰款100元/人次,同時停止違規者進場作業(ye)。

  八(ba)、乙方裝修施(shi)工時(shi)間(jian)為8:00-18:30之間(jian),并確保18:30-次日8:00期間(jian)不發出影響他人休息的噪聲;提倡使(shi)用綠色涂料,在周圍業戶休息或做飯時(shi),不宜進行污染性涂料施(shi)工。

  九、乙方搬運(yun)(yun)裝(zhuang)修材(cai)料(liao),須聽從(cong)甲方的(de)指揮,搬運(yun)(yun)時間為周一至(zhi)周五10:00~15:00,節假日不可搬運(yun)(yun)裝(zhuang)修材(cai)料(liao)。

  十、乙方(fang)裝修施工時遵(zun)守下列(lie)禁止行為(wei):

  1、 在外墻(qiang)上開門、窗(chuang),在承重墻(qiang)上鑿(zao)、拆、打洞(dong),擴大承重墻(qiang)上原有的`門窗(chuang)尺寸,拆除連接陽(yang)臺的磚(zhuan)、混凝土墻(qiang)體;

  2、鑿、挖地坪(ping)、頂面;

  3、隨意封閉陽臺。

  4、侵占公共部位(wei)、走道(dao)。

  5、在(zai)指定以外的(de)位置(zhi)安裝空調機(ji)、排放冷凝水。

  6、在陽臺、外墻、門外塔建、加建、懸掛任何建筑(zhu)物(wu)及晾衣(yi)架。

  7、隨意改變或移(yi)動電話、電視(shi)、煤氣、水管(guan)、電線(xian)管(guan)等(deng)設施。

  8、將(jiang)沒有防水要求的房間(jian)改為衛生間(jian)、廚房間(jian);

  9、損壞房屋原(yuan)有節能設施,降低節能效果(guo);

  10、其他影響建(jian)筑結構(gou)和使用(yong)安全(quan)的行為。

  十一、乙(yi)方裝修施工(gong)而(er)造成的(de)漏水、滲水等,應立(li)即(ji)整(zheng)改修復(fu),并作相(xiang)應賠償。

  十二、乙方應督促施(shi)工隊在搬運建筑材料和建筑垃圾時(shi)要注意保護(hu)樓內公共設施(shi)、設備,不損壞、污染樓梯、臺階、扶手欄桿,如有違背(bei),甲方可作出處罰。

  十三、 遵守甲方(fang)制(zhi)訂的電梯使用規定,甲方(fang)發現乙方(fang)在電梯中裝運超(chao)重、超(chao)寬、超(chao)長物品,將從(cong)重處(chu)罰。

  十四、甲方有責(ze)任向乙方提供在(zai)業(ye)戶房屋內預埋(mai)水(shui)、電暗管的走向,乙方在(zai)裝(zhuang)修施(shi)工時嚴禁(jin)在(zai)這(zhe)些(xie)管道20厘米范圍內撞擊、打孔,如(ru)不(bu)按規定(ding)操作,造成管線損壞,責(ze)任自負(fu)。

  十五、乙方(fang)須告知裝修施工(gong)隊(dui),嚴禁(jin)電源線直(zhi)接接在漏電開關上,嚴禁(jin)用(yong)電爐做飯,施工(gong)(木工(gong)、油漆)現場(chang)不許抽煙(yan),需動用(yong)明火作業時要(yao)事先(xian)向甲方(fang)提出(chu)申請,經批準后(hou)方(fang)可施工(gong)。

  十六、甲(jia)方應隨時(shi)(shi)檢查裝修工作情(qing)況(kuang),發現有(you)違章情(qing)況(kuang)要及時(shi)(shi)制止。

  十七、甲(jia)、乙雙(shuang)方應共同(tong)遵守《福建省(sheng)物(wu)業管(guan)理條例》和泉州市制定的相關的裝修管(guan)理規定。

  十八、甲方有(you)權停止(zhi)違規(gui)施(shi)工(gong)人員的裝修工(gong)作,因(yin)此產生的誤工(gong),由責(ze)任方自(zi)負。

  十九、甲、乙雙(shuang)方應共同遵守本(ben)協議,如有違反,應承擔相(xiang)應的法律責任。

  二十、本協(xie)議一式兩份(fen),經(jing)簽(qian)字蓋章后生效(xiao),具(ju)同等(deng)法律效(xiao)力。
