  為維護友好(hao)的(de)房屋產權(quan)共(gong)有(you)關(guan)系(xi)順利履行,經甲乙雙(shuang)方(fang)友好(hao)協商,就雙(shuang)方(fang)共(gong)同出(chu)資(zi)購房的(de)相關(guan)事宜,依據《物權(quan)法》,訂立(li)如下(xia)共(gong)有(you)人協議,以(yi)便雙(shuang)方(fang)共(gong)同遵守。

  雙方在自(zi)愿、平等(deng)、互利的基礎上,就共有產權房屋的經營、管理、居(ju)住、出(chu)租、使用(yong)等(deng)相關事宜,達成以下協議:

  一、房屋產權(quan)(quan),該房屋所有權(quan)(quan)為(wei)甲乙雙(shuang)(shuang)方(fang)共同擁有,且(qie)各享(xiang)有百分之五十的(de)產權(quan)(quan),雙(shuang)(shuang)方(fang)對于(yu)該房屋享(xiang)有共同的(de)使用及處分權(quan)(quan)。

  二、房(fang)屋(wu)(wu)處(chu)分(fen)。共(gong)(gong)有(you)(you)產權(quan)房(fang)屋(wu)(wu)未經共(gong)(gong)有(you)(you)產權(quan)人(ren)(ren)雙方(fang)同(tong)(tong)意并(bing)簽(qian)字(所(suo)有(you)(you)共(gong)(gong)有(you)(you)人(ren)(ren)必須一(yi)致同(tong)(tong)意并(bing)簽(qian)字,即使是大多數共(gong)(gong)有(you)(you)人(ren)(ren)同(tong)(tong)意簽(qian)字也無(wu)(wu)效。),任(ren)何(he)一(yi)方(fang)及(ji)第(di)(di)三(san)人(ren)(ren)不(bu)得(de)擅自(zi)將共(gong)(gong)有(you)(you)產權(quan)房(fang)屋(wu)(wu)出(chu)(chu)租、轉(zhuan)讓(rang)或(huo)私自(zi)無(wu)(wu)償(chang)讓(rang)第(di)(di)三(san)人(ren)(ren)居住、使用,不(bu)得(de)為自(zi)己或(huo)第(di)(di)三(san)人(ren)(ren)提供抵(di)押擔(dan)(dan)保(bao)及(ji)作為實(shi)物出(chu)(chu)資(zi)。任(ren)何(he)人(ren)(ren)在(zai)沒(mei)有(you)(you)經過共(gong)(gong)有(you)(you)人(ren)(ren)一(yi)致同(tong)(tong)意并(bing)簽(qian)字的(de)情(qing)況下出(chu)(chu)租、轉(zhuan)讓(rang)或(huo)私自(zi)無(wu)(wu)償(chang)讓(rang)第(di)(di)三(san)人(ren)(ren)居住、使用,為自(zi)己或(huo)第(di)(di)三(san)人(ren)(ren)提供抵(di)押擔(dan)(dan)保(bao)及(ji)作為實(shi)物出(chu)(chu)資(zi)的(de)行為無(wu)(wu)效,由此給共(gong)(gong)有(you)(you)人(ren)(ren)造(zao)成(cheng)的(de)損失(shi),應當由無(wu)(wu)權(quan)處(chu)分(fen)權(quan)人(ren)(ren)進(jin)行賠(pei)償(chang)。任(ren)何(he)一(yi)方(fang)不(bu)得(de)因個人(ren)(ren)的(de)債務(wu)導(dao)致共(gong)(gong)有(you)(you)房(fang)產的(de)所(suo)有(you)(you)權(quan)、使用權(quan)受到(dao)影響(xiang),否則,應賠(pei)償(chang)另一(yi)方(fang)所(suo)產生的(de).損失(shi)。

  四(si)、共(gong)(gong)(gong)(gong)有(you)房屋(wu)(wu)產(chan)權(quan)(quan)(quan)(quan)人(ren)共(gong)(gong)(gong)(gong)同(tong)擁有(you)此處(chu)房產(chan)的(de)經(jing)營、管(guan)理(li)(li)權(quan)(quan)(quan)(quan),共(gong)(gong)(gong)(gong)有(you)產(chan)權(quan)(quan)(quan)(quan)房屋(wu)(wu)對外(wai)出(chu)租,所(suo)得(de)(de)收(shou)益分(fen)配,按照(zhao)購(gou)買(mai)(mai)房屋(wu)(wu)出(chu)資(zi)比例(li),各得(de)(de)50%.如共(gong)(gong)(gong)(gong)有(you)產(chan)權(quan)(quan)(quan)(quan)房屋(wu)(wu)轉(zhuan)讓(rang),須(xu)經(jing)房屋(wu)(wu)共(gong)(gong)(gong)(gong)有(you)產(chan)權(quan)(quan)(quan)(quan)人(ren)雙方(fang)同(tong)意,并共(gong)(gong)(gong)(gong)同(tong)簽字后,方(fang)可處(chu)置,所(suo)得(de)(de)收(shou)益各50%,一(yi)(yi)方(fang)對外(wai)轉(zhuan)讓(rang)房產(chan)份額的(de),另(ling)一(yi)(yi)方(fang)在同(tong)等(deng)(deng)條件下有(you)優先(xian)購(gou)買(mai)(mai)權(quan)(quan)(quan)(quan)。如經(jing)協商(shang),房屋(wu)(wu)共(gong)(gong)(gong)(gong)有(you)產(chan)權(quan)(quan)(quan)(quan)人(ren)一(yi)(yi)方(fang)全資(zi)收(shou)購(gou)此房產(chan),應按照(zhao)收(shou)購(gou)時間(jian)的(de)市(shi)場評估價(jia)格出(chu)資(zi)購(gou)買(mai)(mai),雙方(fang)有(you)義(yi)務共(gong)(gong)(gong)(gong)同(tong)辦理(li)(li)轉(zhuan)讓(rang)等(deng)(deng)相關手(shou)續。共(gong)(gong)(gong)(gong)有(you)房屋(wu)(wu)產(chan)權(quan)(quan)(quan)(quan)證件,由共(gong)(gong)(gong)(gong)有(you)房屋(wu)(wu)產(chan)權(quan)(quan)(quan)(quan)人(ren)(姓名:___________)代為保管(guan),保管(guan)人(ren)不得(de)(de)私自將共(gong)(gong)(gong)(gong)有(you)房屋(wu)(wu)進行抵押(ya)、轉(zhuan)讓(rang)等(deng)(deng)損害(hai)另(ling)一(yi)(yi)方(fang)產(chan)權(quan)(quan)(quan)(quan)人(ren)利(li)益的(de)事情。

  五、對外出租或共(gong)(gong)同(tong)經營,需要裝(zhuang)修或改造(zao),應由雙(shuang)(shuang)方(fang)共(gong)(gong)同(tong)出資(zi),出資(zi)比例(li)各(ge)占50%.因(yin)本房(fang)產(chan)的市(shi)場增(zeng)值(zhi)部分(fen),屬于雙(shuang)(shuang)方(fang)共(gong)(gong)同(tong)享有。因(yin)不可抗力或政府政策原因(yin),導致的房(fang)產(chan)滅(mie)失、被征收等(deng)情形出現,風險有雙(shuang)(shuang)方(fang)共(gong)(gong)擔,所(suo)得(de)補(bu)償有雙(shuang)(shuang)方(fang)按出資(zi)比例(li)分(fen)配。

  六、未經甲乙雙(shuang)方(fang)協(xie)商一(yi)致(zhi),本(ben)協(xie)議(yi)不得變更或(huo)解除。本(ben)協(xie)議(yi)正(zheng)本(ben)一(yi)式兩份(fen),各份(fen)具有同等法(fa)律效力(li)。本(ben)協(xie)議(yi)自(zi)甲乙雙(shuang)方(fang)簽字之日(ri)起生效。
