  休(xiu)(xiu)(xiu)假(jia)期(qi)(qi)間(jian)(jian)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)不(bu)變(bian)《條(tiao)例》規定(ding)了(le)職工(gong)(gong)(gong)(gong)(gong)年(nian)(nian)休(xiu)(xiu)(xiu)假(jia)天數,還規定(ding),國家法定(ding)休(xiu)(xiu)(xiu)假(jia)日(ri)、休(xiu)(xiu)(xiu)息日(ri)不(bu)計入(ru)年(nian)(nian)休(xiu)(xiu)(xiu)假(jia)的假(jia)期(qi)(qi)。職工(gong)(gong)(gong)(gong)(gong)在(zai)休(xiu)(xiu)(xiu)假(jia)期(qi)(qi)間(jian)(jian)享受與正常工(gong)(gong)(gong)(gong)(gong)作期(qi)(qi)間(jian)(jian)相同的工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)收入(ru)。不(bu)休(xiu)(xiu)(xiu)年(nian)(nian)假(jia)可獲3倍工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)補償《條(tiao)例》指出(chu),年(nian)(nian)休(xiu)(xiu)(xiu)假(jia)在(zai)1個年(nian)(nian)度(du)內可以集中安排(pai),也可以分(fen)段安排(pai),一般不(bu)跨年(nian)(nian)度(du)安排(pai)。對職工(gong)(gong)(gong)(gong)(gong)應休(xiu)(xiu)(xiu)未(wei)休(xiu)(xiu)(xiu)的年(nian)(nian)休(xiu)(xiu)(xiu)假(jia)天數,單位應當(dang)按照該職工(gong)(gong)(gong)(gong)(gong)日(ri)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)收入(ru)的300%支付(fu)年(nian)(nian)休(xiu)(xiu)(xiu)假(jia)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)報(bao)酬(chou)。

  解(jie)讀不(bu)(bu)讓休(xiu)(xiu)假(jia)(jia)(jia)(jia)(jia)又不(bu)(bu)補(bu)償,單(dan)位(wei)(wei)要受罰據(ju)新華(hua)社電國務院(yuan)法制(zhi)辦負責人對《職(zhi)工(gong)帶薪年(nian)休(xiu)(xiu)假(jia)(jia)(jia)(jia)(jia)條例》的熱(re)點問題(ti)進(jin)行了解(jie)讀。工(gong)作(zuo)1年(nian)以(yi)(yi)上(shang)就可享(xiang)受年(nian)休(xiu)(xiu)假(jia)(jia)(jia)(jia)(jia)勞動者平等享(xiang)有。條例規定:機(ji)關、團體(ti)、企業(ye)、事業(ye)單(dan)位(wei)(wei)、民辦非企業(ye)單(dan)位(wei)(wei)、有雇工(gong)的個(ge)體(ti)工(gong)商(shang)戶等單(dan)位(wei)(wei)的職(zhi)工(gong)連續工(gong)作(zuo)1年(nian)以(yi)(yi)上(shang)的.,享(xiang)受帶薪年(nian)休(xiu)(xiu)假(jia)(jia)(jia)(jia)(jia)(以(yi)(yi)下(xia)簡稱年(nian)休(xiu)(xiu)假(jia)(jia)(jia)(jia)(jia))。單(dan)位(wei)(wei)應(ying)當(dang)保(bao)證職(zhi)工(gong)享(xiang)受年(nian)休(xiu)(xiu)假(jia)(jia)(jia)(jia)(jia)。一年(nian)請20天事假(jia)(jia)(jia)(jia)(jia)不(bu)(bu)許休(xiu)(xiu)年(nian)假(jia)(jia)(jia)(jia)(jia)目(mu)前,我國職(zhi)工(gong)其(qi)他休(xiu)(xiu)假(jia)(jia)(jia)(jia)(jia)主要有:寒暑(shu)假(jia)(jia)(jia)(jia)(jia)、探親假(jia)(jia)(jia)(jia)(jia)、病假(jia)(jia)(jia)(jia)(jia)、事假(jia)(jia)(jia)(jia)(jia)等。條例對年(nian)休(xiu)(xiu)假(jia)(jia)(jia)(jia)(jia)與這(zhe)些休(xiu)(xiu)假(jia)(jia)(jia)(jia)(jia)的關系(xi)作(zuo)了明(ming)確規定:

  第一(yi),年休(xiu)(xiu)(xiu)假與寒暑假。條(tiao)例規定(ding):職工依法(fa)享(xiang)受寒暑假,其休(xiu)(xiu)(xiu)假天(tian)數多于年休(xiu)(xiu)(xiu)假天(tian)數的,不享(xiang)受當年的年休(xiu)(xiu)(xiu)假。

  第二,年(nian)休假與(yu)并事假。條(tiao)例(li)規定(ding)(ding):職(zhi)工(gong)請(qing)事假累計(ji)(ji)20天以(yi)上(shang)且單(dan)位按照規定(ding)(ding)不(bu)(bu)(bu)扣工(gong)資的(de),不(bu)(bu)(bu)享(xiang)受(shou)當(dang)年(nian)的(de)年(nian)休假;累計(ji)(ji)工(gong)作滿1年(nian)不(bu)(bu)(bu)滿10年(nian)的(de)職(zhi)工(gong)請(qing)病假累計(ji)(ji)2個(ge)月(yue)以(yi)上(shang)的(de),累計(ji)(ji)工(gong)作滿10年(nian)不(bu)(bu)(bu)滿20年(nian)的(de)職(zhi)工(gong)請(qing)病假累計(ji)(ji)3個(ge)月(yue)以(yi)上(shang)的(de),累計(ji)(ji)工(gong)作滿20年(nian)以(yi)上(shang)的(de)職(zhi)工(gong)請(qing)病假累計(ji)(ji)4個(ge)月(yue)以(yi)上(shang)的(de),不(bu)(bu)(bu)享(xiang)受(shou)當(dang)年(nian)的(de)年(nian)休假。
