《勞(lao)動合同(tong)法》實(shi)施后,用人單位不(bu)按照法定(ding)形(xing)式在法定(ding)時間簽訂書面勞(lao)動合同(tong)的(de)',不(bu)僅不(bu)會規避法律的(de)規定(ding),而且還會產生賠償。

支付(fu)未簽勞動合(he)同(tong)(tong)雙(shuang)倍工(gong)資(zi)(zi)的賠(pei)償《勞動合(he)同(tong)(tong)法》第(di)八(ba)十二條(tiao)規定,用人單位(wei)(wei)自用工(gong)之日起(qi)超過一(yi)個月(yue)(yue)但不滿一(yi)年(nian)位(wei)(wei)于勞動者訂(ding)立勞動的同(tong)(tong)的,應當向(xiang)勞動者每月(yue)(yue)支付(fu)二倍工(gong)資(zi)(zi)。

無固定(ding)期(qi)限(xian)勞(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)條(tiao)件成立的(de)風(feng)險(xian)《勞(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)法》第十四條(tiao)第三款規定(ding),用(yong)(yong)人(ren)單位(wei)自用(yong)(yong)工之日起滿(man)一年(nian)不(bu)與勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)訂立書(shu)面(mian)勞(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)的(de),視(shi)為(wei)用(yong)(yong)人(ren)單位(wei)與勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)已訂立無固定(ding)期(qi)限(xian)勞(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)。也就是說《勞(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)法》實施后,用(yong)(yong)人(ren)單位(wei)不(bu)與勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)簽訂書(shu)面(mian)勞(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)超(chao)過(guo)一年(nian)的(de),就視(shi)為(wei)雙方簽訂了無固定(ding)期(qi)限(xian)的(de)勞(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)。

支(zhi)付(fu)未簽(qian)勞(lao)(lao)動(dong)(dong)合同(tong)經(jing)濟補償(chang)金在(zai)一(yi)(yi)個月(yue)的(de)“寬限期”內,如果由于勞(lao)(lao)動(dong)(dong)者(zhe)不簽(qian)訂(ding)書(shu)面勞(lao)(lao)動(dong)(dong)合同(tong),用(yong)人(ren)單(dan)位(wei)終(zhong)(zhong)止勞(lao)(lao)動(dong)(dong)合同(tong)的(de),可以不支(zhi)付(fu)經(jing)濟補償(chang),超過一(yi)(yi)個月(yue)的(de),由于勞(lao)(lao)動(dong)(dong)者(zhe)不簽(qian)訂(ding)書(shu)面勞(lao)(lao)動(dong)(dong)合同(tong),而(er)用(yong)人(ren)單(dan)位(wei)終(zhong)(zhong)止勞(lao)(lao)動(dong)(dong)合同(tong)的(de),用(yong)人(ren)單(dan)位(wei)須依法支(zhi)付(fu)經(jing)濟補償(chang)。
