  張(zhang)某(mou)(mou)于2007年3月進入(ru)甲(jia)公(gong)(gong)(gong)司(si)工作,雙(shuang)方未(wei)簽訂勞(lao)(lao)(lao)動合同。2007年7月張(zhang)某(mou)(mou)在甲(jia)公(gong)(gong)(gong)司(si)不知情(qing)的情(qing)況下(xia),利用(yong)業余時間到(dao)乙公(gong)(gong)(gong)司(si)兼職,并與乙公(gong)(gong)(gong)司(si)簽訂了(le)一份(fen)一年期限的全日制勞(lao)(lao)(lao)動合同。甲(jia)公(gong)(gong)(gong)司(si)得知情(qing)況后(hou),要求(qiu)張(zhang)某(mou)(mou)改(gai)正,張(zhang)某(mou)(mou)未(wei)予理睬。甲(jia)公(gong)(gong)(gong)司(si)遂于2007年9月通知張(zhang)某(mou)(mou)解除(chu)勞(lao)(lao)(lao)動合同。張(zhang)某(mou)(mou)申請(qing)勞(lao)(lao)(lao)動爭議仲(zhong)裁(cai)。

  【關(guan)于此案的評析】:

  一、關于雙重(zhong)勞(lao)動關系(xi)

  二、關于未簽訂勞(lao)動合同的二倍工(gong)資

  《勞(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)(tong)法(fa)》第(di)十條(tiao)的規定(ding):“建立(li)勞(lao)動(dong)(dong)(dong)關系(xi),應(ying)當(dang)訂(ding)立(li)書面(mian)勞(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)(tong)。”第(di)六十九條(tiao)規定(ding),非(fei)全(quan)日制用(yong)(yong)工(gong)雙方當(dang)事人可以訂(ding)立(li)口頭協(xie)議。《勞(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)(tong)法(fa)》第(di)八十二條(tiao)規定(ding),用(yong)(yong)人單位自(zi)用(yong)(yong)工(gong)之日起超過一個月不(bu)滿一年(nian)未與勞(lao)動(dong)(dong)(dong)者(zhe)(zhe)訂(ding)立(li)書面(mian)勞(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)(tong)的,應(ying)當(dang)向勞(lao)動(dong)(dong)(dong)者(zhe)(zhe)每月支付(fu)二倍的工(gong)資(zi)。本案中(zhong),張(zhang)某(mou)先與甲(jia)(jia)公司建立(li)了全(quan)日制用(yong)(yong)工(gong)關系(xi),因此甲(jia)(jia)公司依(yi)照《勞(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)(tong)法(fa)》的相關規定(ding)應(ying)與張(zhang)某(mou)訂(ding)立(li)書面(mian)勞(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)(tong),甲(jia)(jia)公司與張(zhang)某(mou)未訂(ding)立(li)勞(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)(tong),因此,甲(jia)(jia)公司應(ying)依(yi)法(fa)支付(fu)張(zhang)某(mou)雙倍工(gong)資(zi)。
