  孫(sun)某(mou)(mou)于20xx年(nian)年(nian)初(chu)入職(zhi)某(mou)(mou)酒(jiu)店,任(ren)大(da)堂主管(guan),月薪(xin)8000元。20xx年(nian)8月孫(sun)某(mou)(mou)向當地勞動仲裁部門申請勞動仲裁,要求單位支付未(wei)簽訂(ding)勞動合同的雙倍工(gong)資9萬余(yu)萬。該酒(jiu)店辯稱酒(jiu)店行(xing)業不(bu)(bu)簽訂(ding)勞動合同是普遍現象,而且孫(sun)某(mou)(mou)在外面已經(jing)掛靠社保(bao)(bao),入職(zhi)時也曾(ceng)要求不(bu)(bu)簽訂(ding)勞動合同、不(bu)(bu)繳納(na)社保(bao)(bao)、仲裁委員會支持了孫(sun)某(mou)(mou)的仲裁申請后,該酒(jiu)店不(bu)(bu)服(fu)訴至法院。

  【風險提示】

  1、不簽勞動合同的風(feng)險(xian)

  (1)支付(fu)雙倍工資

  《勞動(dong)合同(tong)法(fa)》第(di)82條的規定,用(yong)人單(dan)位自用(yong)工之日起(qi)超過一(yi)個月不滿一(yi)年未與勞動(dong)者訂(ding)立書面(mian)勞動(dong)合同(tong)的,應向(xiang)勞動(dong)者每月支付2倍的工資。

  (2)無法約定使試用期

  用(yong)人(ren)單位不簽訂勞(lao)動合同,對新招員(yuan)工就難(nan)以約定試(shi)用(yong)期(qi)(qi),直接招用(yong),不僅(jin)需要(yao)增加試(shi)用(yong)期(qi)(qi)期(qi)(qi)間的(de)支(zhi)出,而(er)且容易帶(dai)來用(yong)人(ren)風險。

  (3)難(nan)以(yi)穩定(ding)員工

  如果用(yong)人單位(wei)不簽訂(ding)勞動(dong)合同,職工可以說(shuo)走(zou)就走(zou),無(wu)需提前1個(ge)月大離職報告,法律不追究其責(ze)任(ren)。技術人員也同樣。如果用(yong)人單位(wei)與技術人員不簽訂(ding)勞動(dong)合同,不僅可以說(shuo)走(zou)就走(zou),而且無(wu)需承擔培訓(xun)費用(yong)。

  (4)難以保護商業秘密

  每個用人單位或多或少有(you)商(shang)業秘(mi)密,不簽(qian)勞(lao)動合(he)同,無法通過勞(lao)動合(he)同增(zeng)加條款(kuan),很難(nan)保(bao)護同人單位的商(shang)業秘(mi)密。

  (5)難以(yi)進行競(jing)業限制

  用人單位要對勞(lao)動者進(jin)行(xing)競(jing)業(ye)(ye)限制,主要針對高技能人才,不簽訂勞(lao)動合同,無法通過勞(lao)動合同作出競(jing)業(ye)(ye)限制,采用其他辦法很(hen)難(nan)收效。

  (6)被迫簽訂(ding)無(wu)固定期限(xian)勞(lao)動合同

  《勞(lao)(lao)(lao)(lao)動合同(tong)(tong)法》第14條第3款的(de)(de)規定(ding),“用(yong)人單位(wei)自用(yong)工之(zhi)日起滿一年不(bu)與(yu)勞(lao)(lao)(lao)(lao)動者(zhe)簽訂(ding)勞(lao)(lao)(lao)(lao)動者(zhe)訂(ding)立書面勞(lao)(lao)(lao)(lao)動合同(tong)(tong)的(de)(de),視為用(yong)人單位(wei)與(yu)勞(lao)(lao)(lao)(lao)動者(zhe)已(yi)訂(ding)立無固(gu)定(ding)期限勞(lao)(lao)(lao)(lao)動合同(tong)(tong)。”如果用(yong)人單位(wei)被迫(po)與(yu)勞(lao)(lao)(lao)(lao)動者(zhe)簽訂(ding)無固(gu)定(ding)期限的(de)(de)勞(lao)(lao)(lao)(lao)動合同(tong)(tong),對(dui)用(yong)人單位(wei)利益將(jiang)造成較大影響(xiang)。

  (7)在(zai)勞動爭(zheng)議中(zhong)處于被動

  不簽勞(lao)(lao)動(dong)合同,責任(ren)主要在是用人單位。即(ji)使當初未簽訂(ding)勞(lao)(lao)動(dong)合同存在諸多合理因素,但(dan)也無法證(zheng)明其不簽訂(ding)勞(lao)(lao)動(dong)合同的(de)合法性。一旦產(chan)生勞(lao)(lao)資糾紛,企(qi)業(ye)拿(na)不出重(zhong)要依據--勞(lao)(lao)動(dong)合同,必然要承擔法定(ding)的(de)賠償責任(ren)。

  2、用人(ren)單位拒(ju)簽無固定期限(xian)勞(lao)動合同的法律風(feng)險

  用人單位違反勞(lao)動(dong)合同(tong)法規定不(bu)與勞(lao)動(dong)者訂(ding)立無固(gu)定期限勞(lao)動(dong)合同(tong)的,自應當(dang)訂(ding)立勞(lao)動(dong)合同(tong)之日(ri)起向(xiang)勞(lao)動(dong)者每月支付2倍的工(gong)資。

  3、勞動合同無效的(de)風險

  無效的(de)(de)勞(lao)動合同,從訂立(li)的(de)(de)時候就沒(mei)有法律約束力。法律之所以不規(gui)定無效勞(lao)動合同的(de)(de)起(qi)算時間是(shi)從履(lv)行的(de)(de)時候起(qi),主要是(shi)因為無效勞(lao)動合同的(de)(de)訂立(li)從一開(kai)始就是(shi)錯誤的(de)(de),而對建立(li)在錯誤基(ji)礎上的(de)(de)勞(lao)動合同是(shi)不應予以承認的(de)(de)。

  4、勞動合同變更的風險

  用人單(dan)位違法調(diao)整勞(lao)動者崗(gang)位和薪資等勞(lao)動合同內容的(de)(de),除應(ying)當(dang)賠償(chang)造成的(de)(de)損失(shi)之(zhi)外(wai),如果造成勞(lao)動者辭(ci)職(zhi)的(de)(de),視為推定解雇,應(ying)當(dang)支付勞(lao)動者經(jing)濟補償(chang)金(jin)。

  【問(wen)題(ti)釋解】勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)同(tong)的(de)(de)變(bian)(bian)更,是指勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)同(tong)依法訂(ding)立后,在合(he)(he)(he)同(tong)尚(shang)未履行(xing)或(huo)者(zhe)尚(shang)未履行(xing)完(wan)畢之前,用人單位和勞(lao)(lao)動(dong)(dong)(dong)者(zhe)在平等(deng)自(zi)愿、協(xie)商一致的(de)(de)基礎上,就已訂(ding)立的(de)(de)勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)同(tong)條款進(jin)行(xing)修(xiu)改、補充(chong)或(huo)廢(fei)止部分內(nei)(nei)容的(de)(de)法律行(xing)為。當勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)同(tong)出現履行(xing)障礙時,法律允許雙方(fang)當事人在勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)同(tong)的(de)(de)有效期(qi)內(nei)(nei),對原勞(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)同(tong)的(de)(de)相關(guan)內(nei)(nei)容進(jin)行(xing)調整和變(bian)(bian)更。有下列(lie)情形之一的(de)(de),合(he)(he)(he)同(tong)雙方(fang)可以變(bian)(bian)更本(ben)合(he)(he)(he)同(tong):

  (1)在不損害國家、集體和他(ta)人利益的情況下,雙方協商(shang)一致的;

  (2)勞動合同訂立時所(suo)依據的客(ke)觀(guan)情況發生了重大變化,經(jing)合同雙方協商一致的;

  (3)由于不可抗力的因素致(zhi)使(shi)勞動合同無(wu)法完全履行(xing)的。不可抗力是(shi)指當事人所不能預見、不能避免(mian)并不能克服的客觀情況,如自(zi)然災害、意外事故、戰爭等。;

  (4)勞動合(he)同訂立(li)時所依據(ju)的法律、法規已修(xiu)改的;

  (5)勞動(dong)(dong)者的身(shen)體健康狀況發生變(bian)化、勞動(dong)(dong)能力喪失(shi)(shi)或(huo)(huo)部分喪失(shi)(shi)、所在(zai)崗位與其職業技(ji)能不相(xiang)適(shi)應、職業技(ji)能提高了一定(ding)等級等,造(zao)成原勞動(dong)(dong)合(he)(he)同(tong)不能履行(xing)或(huo)(huo)者如果繼(ji)續履行(xing)原合(he)(he)同(tong)規定(ding)的義務對勞動(dong)(dong)者明顯不公平;

  (6)法律、法規(gui)規(gui)定的其(qi)他(ta)情形(xing)。《勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)法》第三十五條規(gui)定,用(yong)人(ren)單(dan)位(wei)與勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)協商一致,可以變(bian)(bian)(bian)更(geng)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)約定的內(nei)容。由于勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)法未(wei)明確(que)規(gui)定勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)變(bian)(bian)(bian)更(geng)需采用(yong)書(shu)面形(xing)式,實踐(jian)中用(yong)人(ren)單(dan)位(wei)隨意變(bian)(bian)(bian)更(geng)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)的現象比較(jiao)嚴重,如(ru)隨意調整(zheng)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)工作崗位(wei),隨意降(jiang)低勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)工資標(biao)準,嚴重損害了(le)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)的合(he)法權益,為(wei)了(le)規(gui)范勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)變(bian)(bian)(bian)更(geng)行為(wei),勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)法明確(que)規(gui)定了(le)變(bian)(bian)(bian)更(geng)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)同(tong),應當采用(yong)書(shu)面形(xing)式。變(bian)(bian)(bian)更(geng)后的勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)同(tong)文本由用(yong)人(ren)單(dan)位(wei)和勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)各執一份。

  勞動合同變更程序如下:

  (1)提出變(bian)更(geng)的要(yao)約(yue):用(yong)人單(dan)位或勞動者提出變(bian)更(geng)勞動合同(tong)的要(yao)求,說明變(bian)更(geng)合同(tong)的理(li)由、變(bian)更(geng)的內容以及變(bian)更(geng)的條件,請(qing)求對方在一定期限內給(gei)予(yu)答復。

  (2)承諾:合同另一方(fang)接(jie)到對方(fang)的變更請(qing)求后(hou),應當及時進行答復,明確告知對方(fang)同意或是不同意變更;

  (3)訂立書(shu)面變(bian)更(geng)(geng)(geng)協議:當事人雙方就(jiu)變(bian)更(geng)(geng)(geng)勞動合(he)同的內容經過平等協商,取得一致意見后(hou)簽(qian)訂書(shu)面變(bian)更(geng)(geng)(geng)協議,協議載明變(bian)更(geng)(geng)(geng)的具體內容,經雙方簽(qian)字蓋章后(hou)生效。變(bian)更(geng)(geng)(geng)后(hou)的勞動合(he)同文本由(you)用人單位和勞動者各執一份。

  【實務操作指南】平等自愿、協商一致是勞(lao)動合(he)同變更的基本要求(qiu),用人(ren)單位未經(jing)勞(lao)動者同意強行(xing)變更勞(lao)動合(he)同,屬違(wei)約行(xing)為(wei),應當(dang)承(cheng)擔違(wei)約責任,造成勞(lao)動者損(sun)失的,需承(cheng)擔損(sun)害賠(pei)償責任。

  (2)自解除勞動(dong)合同(tong)之日起一年內,不得參(can)與(yu)二(er)級(ji)公司主營(ying)業(ye)務(wu)相(xiang)沖突的商業(ye)活動(dong)。

  (3)不得以任何(he)方式做出有損于甲(jia)方與客戶的合作關系的行為。

  何職務,包括但不(bu)限于股東、合伙人、董事、監(jian)事、經理、員工(gong)、代(dai)理人、顧問等(deng);乙方在離職之(zhi)前或(huo)離職之(zhi)后兩(liang)年以內,不(bu)得(de)搶奪甲(jia)(jia)方客(ke)戶,或(huo)引誘甲(jia)(jia)方其他員工(gong)離職,損(sun)害甲(jia)(jia)方的合法權益;也不(bu)得(de)自營與(yu)甲(jia)(jia)方相同或(huo)具有競爭性(xing)關系的產品或(huo)服務。

  六(liu)、甲(jia)方(fang)為培訓(xun)(xun)乙(yi)方(fang)所(suo)花費的培訓(xun)(xun)費用(yong),若乙(yi)方(fang)在合同(tong)未到期(qi)的情況下解除合同(tong),應向甲(jia)方(fang)賠償上述培訓(xun)(xun)費用(yong)(按(an)照實際費用(yong)評(ping)算)。

  七、乙方違反本協議(yi)第(di)五條的(de)約(yue)定,應(ying)向甲方支付違約(yue)金為合同期工資總(zong)額的(de)30%。

變更勞動合同14

  1、調(diao)崗屬(shu)于(yu)變(bian)更勞(lao)動(dong)合同(tong)的(de)主(zhu)要(yao)內容(rong),用人(ren)單(dan)位必(bi)須先與勞(lao)動(dong)者(zhe)協商(shang)一致,未經(jing)勞(lao)動(dong)者(zhe)同(tong)意,用人(ren)單(dan)位單(dan)方面調(diao)整(zheng)崗位,原(yuan)則(ze)上(shang)是(shi)無(wu)效(xiao)的(de);

  2、如果用(yong)(yong)(yong)(yong)人(ren)(ren)單(dan)(dan)位(wei)(wei)是(shi)生產(chan)經(jing)營需要的調(diao)(diao)崗(gang),且調(diao)(diao)崗(gang)具有合理(li)性(xing),不存在侮辱(ru)或懲(cheng)罰性(xing)質,工(gong)資待遇(yu)不降低,與勞(lao)(lao)(lao)動合同(tong)約定的崗(gang)位(wei)(wei)之間(jian)存在相關性(xing),則調(diao)(diao)崗(gang)有效;你(ni)作(zuo)為(wei)勞(lao)(lao)(lao)動者(zhe)應(ying)該遵(zun)守。當(dang)然,調(diao)(diao)整崗(gang)位(wei)(wei)的合理(li)性(xing)需要用(yong)(yong)(yong)(yong)人(ren)(ren)單(dan)(dan)位(wei)(wei)舉證;反之,用(yong)(yong)(yong)(yong)人(ren)(ren)單(dan)(dan)位(wei)(wei)是(shi)基于迫使勞(lao)(lao)(lao)動者(zhe)離職而(er)調(diao)(diao)整崗(gang)位(wei)(wei),勞(lao)(lao)(lao)動者(zhe)是(shi)可(ke)以拒(ju)絕的。用(yong)(yong)(yong)(yong)人(ren)(ren)單(dan)(dan)位(wei)(wei)以勞(lao)(lao)(lao)動者(zhe)不服從安排(pai)為(wei)由解除勞(lao)(lao)(lao)動合同(tong),就屬于違法解除;你(ni)可(ke)以申請勞(lao)(lao)(lao)動仲裁要求(qiu)支付賠償金,工(gong)作(zuo)1年支付2個月本人(ren)(ren)工(gong)資,即2N;

  3、如果勞動(dong)者不能(neng)勝任(ren)工作,用(yong)(yong)人(ren)單(dan)(dan)位(wei)(wei)(wei)也是有權調(diao)整崗位(wei)(wei)(wei)的(de)。當(dang)然,用(yong)(yong)人(ren)單(dan)(dan)位(wei)(wei)(wei)主張勞動(dong)者不勝任(ren)工作也是需(xu)要提(ti)供證(zheng)據的(de)。勞動(dong)者拒絕(jue)調(diao)整崗位(wei)(wei)(wei)的(de),用(yong)(yong)人(ren)單(dan)(dan)位(wei)(wei)(wei)據此解除勞動(dong)合(he)同(tong),屬于(yu)合(he)法(fa)解除,但是用(yong)(yong)人(ren)單(dan)(dan)位(wei)(wei)(wei)也是應該支付經(jing)濟(ji)補償,即N。 法(fa)律(lv)基礎(chu)

  《勞(lao)動(dong)(dong)法(fa)(fa)(fa)(fa)》第(di)(di)17條(tiao)明確規(gui)(gui)定(ding)(ding)(ding),訂立和變(bian)(bian)更(geng)(geng)勞(lao)動(dong)(dong)合(he)同(tong)(tong)(tong),應遵循自愿、協(xie)(xie)商(shang)一(yi)致(zhi)(zhi)的(de)(de)原則(ze),不得(de)違(wei)(wei)反法(fa)(fa)(fa)(fa)律、行(xing)(xing)政(zheng)法(fa)(fa)(fa)(fa)規(gui)(gui)的(de)(de)規(gui)(gui)定(ding)(ding)(ding)。勞(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)依法(fa)(fa)(fa)(fa)訂立即具(ju)有(you)法(fa)(fa)(fa)(fa)律約(yue)束力,當(dang)事(shi)(shi)人必(bi)須(xu)履(lv)(lv)行(xing)(xing)勞(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)規(gui)(gui)定(ding)(ding)(ding)的(de)(de)義務。同(tong)(tong)(tong)時(shi),《勞(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)法(fa)(fa)(fa)(fa)》第(di)(di)35條(tiao)規(gui)(gui)定(ding)(ding)(ding),“用人單位與勞(lao)動(dong)(dong)者(zhe)協(xie)(xie)商(shang)一(yi)致(zhi)(zhi),可以(yi)變(bian)(bian)更(geng)(geng)勞(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)約(yue)定(ding)(ding)(ding)的(de)(de)內(nei)(nei)容(rong)。變(bian)(bian)更(geng)(geng)勞(lao)動(dong)(dong)合(he)同(tong)(tong)(tong),應當(dang)采用書面形式(shi)。”按照(zhao)上述規(gui)(gui)定(ding)(ding)(ding),用人單位合(he)法(fa)(fa)(fa)(fa)地變(bian)(bian)更(geng)(geng)勞(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)必(bi)須(xu)同(tong)(tong)(tong)時(shi)具(ju)備三個條(tiao)件:一(yi)是雙(shuang)方當(dang)事(shi)(shi)人在(zai)平等自愿的(de)(de)基礎上提出或(huo)接受變(bian)(bian)更(geng)(geng)合(he)同(tong)(tong)(tong)的(de)(de)條(tiao)件;二是必(bi)須(xu)遵守(shou)協(xie)(xie)商(shang)一(yi)致(zhi)(zhi)的(de)(de)原則(ze),在(zai)變(bian)(bian)更(geng)(geng)合(he)同(tong)(tong)(tong)過程中,雙(shuang)方當(dang)事(shi)(shi)人必(bi)須(xu)對(dui)變(bian)(bian)更(geng)(geng)的(de)(de)內(nei)(nei)容(rong)進行(xing)(xing)協(xie)(xie)商(shang),在(zai)取得(de)一(yi)致(zhi)(zhi)意(yi)(yi)見(jian)的(de)(de)情況(kuang)下(xia)進行(xing)(xing)變(bian)(bian)更(geng)(geng);三是不得(de)違(wei)(wei)反法(fa)(fa)(fa)(fa)律、行(xing)(xing)政(zheng)法(fa)(fa)(fa)(fa)規(gui)(gui)的(de)(de)規(gui)(gui)定(ding)(ding)(ding),也(ye)就是說,變(bian)(bian)更(geng)(geng)勞(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)的(de)(de)程序和內(nei)(nei)容(rong)都要(yao)(yao)符合(he)法(fa)(fa)(fa)(fa)律和有(you)關規(gui)(gui)定(ding)(ding)(ding)。因(yin)此,在(zai)勞(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)履(lv)(lv)行(xing)(xing)過程中,一(yi)方當(dang)事(shi)(shi)人單方面變(bian)(bian)更(geng)(geng)勞(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)是不合(he)法(fa)(fa)(fa)(fa)的(de)(de)。如果企(qi)業因(yin)生產(chan)工(gong)(gong)作需要(yao)(yao),確需變(bian)(bian)動(dong)(dong)職工(gong)(gong)工(gong)(gong)作崗(gang)位時(shi),要(yao)(yao)先同(tong)(tong)(tong)職工(gong)(gong)協(xie)(xie)商(shang),取得(de)一(yi)致(zhi)(zhi)意(yi)(yi)見(jian)后再變(bian)(bian)動(dong)(dong)。如果職工(gong)(gong)不同(tong)(tong)(tong)意(yi)(yi)變(bian)(bian)更(geng)(geng),企(qi)業也(ye)要(yao)(yao)做好(hao)思想工(gong)(gong)作,不能以(yi)行(xing)(xing)使自主權為(wei)由(you)強(qiang)行(xing)(xing)變(bian)(bian)更(geng)(geng),甚至在(zai)職工(gong)(gong)一(yi)方不同(tong)(tong)(tong)意(yi)(yi)的(de)(de)情況(kuang)下(xia),作出停(ting)發工(gong)(gong)資(zi)、限(xian)期(qi)調離等決定(ding)(ding)(ding),這樣做顯然是侵(qin)犯職工(gong)(gong)合(he)法(fa)(fa)(fa)(fa)權益(yi)的(de)(de)行(xing)(xing)為(wei),也(ye)是一(yi)種違(wei)(wei)法(fa)(fa)(fa)(fa)行(xing)(xing)為(wei),按照(zhao)法(fa)(fa)(fa)(fa)律規(gui)(gui)定(ding)(ding)(ding)應當(dang)支付賠償金。
