[簽訂勞動合同通知書之疑問]“沈律師您好,我有一個朋友,在單位工作了6年,08年以后簽訂了兩次固定期限勞動合同,現在是第三次簽約,單位沒有讓她簽正式勞動合同,而是給他一個勞動合同續訂通知書,上面寫著“我愿與單位簽約 年” 。我的朋友填寫了兩年,到底有什么影響。單位到底是什么意思呢?是不是新勞(lao)動(dong)(dong)合(he)同法規定,只要是第三次簽約,就需簽訂無固定期限期的(de)勞(lao)動(dong)(dong)合(he)同的(de),對嗎?麻煩您百忙之中解答(da)一下,謝謝!”

一、關于無固定期限勞動(dong)合同的勞動(dong)法知識:

1、無固定期限勞動合同的概念:

無(wu)(wu)固(gu)(gu)定(ding)期限(xian)勞動合(he)同,是指用人單(dan)位與勞動者約定(ding)無(wu)(wu)確(que)定(ding)終(zhong)止(zhi)時(shi)間的(de)勞動合(he)同。“無(wu)(wu)確(que)定(ding)終(zhong)止(zhi)時(shi)間”不是無(wu)(wu)終(zhong)止(zhi)時(shi)間,而是指沒有(you)確(que)定(ding)的(de)終(zhong)止(zhi)時(shi)間,即期限(xian)長(chang)短(duan)無(wu)(wu)法提前預料和確(que)定(ding)。沒有(you)固(gu)(gu)定(ding)的(de)合(he)同終(zhong)止(zhi)期限(xian),是無(wu)(wu)固(gu)(gu)定(ding)期限(xian)勞動合(he)同與固(gu)(gu)定(ding)期限(xian)勞動合(he)同之(zhi)間的(de)最大區別。

2、用(yong)人單位拒不(bu)簽無固定期限(xian)勞動合同的.法律后(hou)果:

用人(ren)單(dan)位違反(fan)勞(lao)動(dong)合同法規定(ding)不與勞(lao)動(dong)者(zhe)訂(ding)立(li)(li)無固定(ding)期(qi)限勞(lao)動(dong)合同的,自應當(dang)訂(ding)立(li)(li)無固定(ding)期(qi)限勞(lao)動(dong)合同之日起向(xiang)勞(lao)動(dong)者(zhe)每月支付(fu)二倍的工資(zi)。

二、2008年以后(hou),連續簽訂(ding)兩次(ci)固定(ding)(ding)期限(xian)勞動(dong)(dong)合(he)同(tong),用(yong)人(ren)單位(wei)能否終止勞動(dong)(dong)合(he)同(tong)而不簽訂(ding)無固定(ding)(ding)期限(xian)勞動(dong)(dong)合(he)同(tong)?
