  (二)合同系雙方根(gen)據《中(zhong)華(hua)人(ren)(ren)民(min)共(gong)和(he)國(guo)(guo)中(zhong)外合資(zi)經營(ying)企(qi)業法》、《中(zhong)華(hua)人(ren)(ren)民(min)共(gong)和(he)國(guo)(guo)勞(lao)動(dong)法》、《中(zhong)華(hua)人(ren)(ren)民(min)共(gong)和(he)國(guo)(guo)工(gong)會法》、《中(zhong)華(hua)人(ren)(ren)民(min)共(gong)和(he)國(guo)(guo)中(zhong)外合資(zi)經營(ying)企(qi)業勞(lao)動(dong)管理規定》和(he)其他有(you)關法律和(he)法規,為促(cu)進公司發(fa)展,調動(dong)職工(gong)積極性,正確處理公司與職工(gong)的關系,本著平等互(hu)利原(yuan)則,通過平等和(he)友好協(xie)商簽訂。

  (三)公司應(ying)根據有關(guan)(guan)規(gui)定(ding)尊重工(gong)(gong)會(hui)維護和代表(biao)職(zhi)(zhi)(zhi)工(gong)(gong)利益(yi)的(de)權力,在研究決(jue)定(ding)有關(guan)(guan)工(gong)(gong)資、福利、安全生產(chan)(chan)以及(ji)勞動保險等涉及(ji)職(zhi)(zhi)(zhi)工(gong)(gong)切身利益(yi)的(de)規(gui)章制(zhi)度時應(ying)聽取工(gong)(gong)會(hui)的(de)意見。公司工(gong)(gong)會(hui)負責人有權列席(xi)有關(guan)(guan)討論公司的(de)發展規(gui)劃、生產(chan)(chan)經營活(huo)動及(ji)與職(zhi)(zhi)(zhi)工(gong)(gong)利益(yi)有關(guan)(guan)的(de)問題的(de)董事會(hui)會(hui)議,反映(ying)職(zhi)(zhi)(zhi)工(gong)(gong)的(de)意見和要(yao)求(qiu)。

  (四)工會應協助公(gong)司(si)搞好生(sheng)產(chan)、經(jing)營和管理,協助公(gong)司(si)合(he)(he)理使用各項基(ji)金,教(jiao)育職工認(ren)真履(lv)行個人勞動(dong)合(he)(he)同中載明的(de)義(yi)務(wu),配合(he)(he)公(gong)司(si)組織開(kai)展(zhan)合(he)(he)理化建議(yi)、技(ji)術革新,促進(jin)公(gong)司(si)提(ti)高經(jing)濟效益(yi)。

  第一條 定義

  (一)“雇(gu)員(yuan)”系指由公司雇(gu)用(yong)的取酬人(ren)員(yuan),但(dan)不包括合資合同第46條所述(shu)少(shao)數擔(dan)任(ren)總經(jing)理、副總經(jing)理和(he)部門經(jing)理的外籍高級管(guan)理人(ren)員(yuan)和(he)中方高級管(guan)理人(ren)員(yuan)。

  (二)“主(zhu)(zhu)管人員”指(zhi)任(ren)何在(zai)“公(gong)司”總經理領導下行使(shi)主(zhu)(zhu)管職能(neng)的任(ren)何雇(gu)員。

  第二條 職責

  (一)公司與員工的共同義務

  雇員(yuan)應勤奮(fen)地履行其職責并努力促(cu)進(jin)(jin)公(gong)司的(de)業(ye)務,公(gong)司應就雇員(yuan)的(de)勞動向其付酬,并促(cu)進(jin)(jin)雇員(yuan)福利(li)及努力改(gai)善雇員(yuan)的(de)文化生活。

  (二)雇(gu)員的(de)具體(ti)職責和義務

  1.每個雇員的責(ze)任(ren)將按照公司(si)的需要(yao)由董(dong)事會和(he)總(zong)經(jing)理隨時(shi)代表公司(si)予(yu)以確定。

  2.每(mei)個雇員必須按照其(qi)主管人(ren)員指示盡(jin)最大的(de)(de)(de)努力認真(zhen)執(zhi)行任(ren)務,與主管人(ren)員和同事合作,遵守本(ben)合同、個人(ren)勞動合同以及公司(si)頒布的(de)(de)(de)工作規章的(de)(de)(de)規定。

  3.所有雇員必須遵守以下各項:

  (1)小心操作交給他們的(de)設備(bei)和(he)工具;

  (2)堅守工作崗位,上班(ban)時不與其它雇員(yuan)隨便來往(wang);

  (3)不向公(gong)(gong)(gong)司外(wai)人(ren)(ren)員(yuan)或在履行職責時不需要了解有關情(qing)(qing)報的公(gong)(gong)(gong)司內人(ren)(ren)員(yuan)披露有關公(gong)(gong)(gong)司業(ye)務或經(jing)營的情(qing)(qing)報,除非經(jing)公(gong)(gong)(gong)布的法律或法規強制(zhi)要求公(gong)(gong)(gong)開這些(xie)情(qing)(qing)報;

  (4)受公司(si)雇(gu)用期(qi)間,除經公司(si)批準,不得受雇(gu)于公司(si)以外的(de)其它雇(gu)主;

  (5)避免有損公司聲望、名(ming)譽或業務的行為;

  (6)未經同意,不得為個人目的取用公司的金(jin)錢或財(cai)產。

  4.鼓勵雇(gu)員(yuan)提出(chu)(chu)改(gai)進公司(si)經營的(de)(de)意(yi)見(jian)(jian)和(he)方法(fa),其中包括,但(dan)不限于,生(sheng)產、安全(quan)、工(gong)作(zuo)環境、產品(pin)質量和(he)效(xiao)率(lv)方面的(de)(de)意(yi)見(jian)(jian)和(he)方法(fa),提出(chu)(chu)值得受獎(jiang)勵的(de)(de)意(yi)見(jian)(jian)或方法(fa)的(de)(de)雇(gu)員(yuan)將(jiang)按公司(si)有(you)關(guan)規定給予適當獎(jiang)金或獎(jiang)勵。 5.除(chu)經公司(si)管理部門明確授(shou)權,雇(gu)員(yuan)無(wu)權亦未被(bei)授(shou)權為公司(si)或代表公司(si)達成任何交易或訂(ding)立合同或作(zuo)出(chu)(chu)其它(ta)行為。

  (三)公(gong)司的具體職責

  1.公(gong)司將尊重雇(gu)員的人格和個(ge)性,并在可能(neng)(neng)的情況下,為(wei)其安排與其能(neng)(neng)力(li)相適應的任務。公(gong)司將建(jian)立職業培訓制度(du),有計劃地(di)對員工(gong)進行職業培訓。

  2.公司鼓勵管理部門(men)、主管人員(yuan)和(he)雇員(yuan)之間的和(he)睦(mu)關系(xi),并適(shi)時(shi)頒(ban)發公司業務有(you)秩序(xu)進行所必(bi)須的工作守(shou)則。

  3.公(gong)司按本合同第(di)五條和與雇員個(ge)人(ren)簽訂的(de)個(ge)人(ren)勞(lao)動合同所述(shu)發給雇員基本工(gong)資和提供補助。

  4.公(gong)司應按《合資(zi)法實施條例(li)》第九十(shi)九條規定,積(ji)極支持工會(hui)(hui)工作,為(wei)(wei)工會(hui)(hui)組織提供必(bi)要(yao)的辦公(gong)室和辦公(gong)設(she)備。公(gong)司每月按企(qi)業職工(包括外籍(ji)高級管理人員)實際(ji)工資(zi)總(zong)額(e)(e)的百分之二(2%)撥交工會(hui)(hui)經(jing)費,該筆金額(e)(e)應作為(wei)(wei)公(gong)司開支。工會(hui)(hui)可(ke)以按中華(hua)全國總(zong)工會(hui)(hui)的規定《工會(hui)(hui)經(jing)費管理辦法》使用工會(hui)(hui)經(jing)費。

  5.公司(si)將為雇員提供(gong)良(liang)好的(de)工(gong)作條(tiao)件,改善職(zhi)工(gong)文(wen)化設施(shi)和住房(fang)、膳食、醫療(liao)、托兒所、交通條(tiao)件,并提供(gong)其他與(yu)公司(si)經濟狀況相適應的(de)福利待遇。

  (四(si))工會(hui)的具(ju)體職(zhi)責

  公司(si)工(gong)(gong)會是職(zhi)工(gong)(gong)利益(yi)(yi)的(de)(de)代表,它的(de)(de)基(ji)本任務(wu)是:依法維護職(zhi)工(gong)(gong)的(de)(de)民(min)主權力和(he)(he)物質利益(yi)(yi);協(xie)助公司(si)安(an)排和(he)(he)合理使用職(zhi)工(gong)(gong)獎(jiang)勵及福利基(ji)金;組織(zhi)職(zhi)工(gong)(gong)學習(xi)政治、業(ye)務(wu)、科學和(he)(he)技術(shu)知識,開(kai)展文(wen)藝、體(ti)育活動(dong);教育職(zhi)工(gong)(gong)遵守勞動(dong)紀律,努力完成公司(si)的(de)(de)各(ge)項經濟任務(wu)。

  第三條 雇用手續

  (一)公司(si)作為(wei)中外合資企(qi)業,根據有(you)關法律享有(you)企(qi)業自主權(quan),有(you)權(quan)依法雇用(yong)和解雇其職(zhi)工。在錄用(yong)職(zhi)工時,除國家規(gui)定的(de)不適合婦(fu)(fu)女的(de)工種或者崗位外,不得以性別為(wei)由拒絕錄用(yong)婦(fu)(fu)女或者提高對婦(fu)(fu)女的(de)錄用(yong)標準。

  (二)公司董事會有權根(gen)據公司經營需要自行決定公司招聘雇員的(de)標準和(he)人數(shu)。

  (三)公司招聘(pin)計劃和(he)實施(shi)情況應(ying)向工(gong)會(hui)通(tong)報。

  (三)公(gong)司(si)雇員成(cheng)(cheng)為公(gong)司(si)正式雇員前應合格完成(cheng)(cheng)六個(ge)月(yue)的試用期。

  (五)公司將(jiang)與雇員簽定個人(ren)勞動合同(tong),個人(ren)勞動合同(tong)格(ge)式附后作(zuo)為(wei)本合同(tong)的附件(jian)a。

  (六)職工(gong)簽(qian)定個(ge)人勞(lao)動(dong)合同前,公司和工(gong)會應指導雇員明(ming)確(que)個(ge)人勞(lao)動(dong)合同載(zai)明(ming)權(quan)利、義務及(ji)違(wei)約責任(ren)。工(gong)會有權(quan)監督個(ge)人勞(lao)動(dong)合同的執行情況。

  (七(qi))從_________轉入_________的職工,其在(zai)_________的工齡應視為在(zai)_________的工齡。

  第四條 工作時間、節假日

  (一)工作時間

  1.公司董事會決定基本工作周,以(yi)適應全(quan)部生(sheng)產能力。

  2.雇員正常工(gong)作(zuo)(zuo)時(shi)(shi)(shi)間每天八小時(shi)(shi)(shi)(不(bu)(bu)包括用餐和(he)休息時(shi)(shi)(shi)間),平均每周工(gong)作(zuo)(zuo)不(bu)(bu)超過四十四小時(shi)(shi)(shi)。

  3.公司可(ke)隨時更改雇員的工(gong)作(zuo)日(ri)(ri)程,包(bao)括改動雇員工(gong)作(zuo)日(ri)(ri)的起始和(he)結(jie)束時間。由(you)于工(gong)作(zuo)需要(yao),經(jing)以工(gong)會和(he)員工(gong)協(xie)商后(hou)可(ke)以延長工(gong)作(zuo)時間,一般每(mei)日(ri)(ri)不得(de)超過(guo)(guo)一小(xiao)(xiao)時;在特殊(shu)情況下每(mei)日(ri)(ri)不得(de)超過(guo)(guo)三(san)小(xiao)(xiao)時,但是每(mei)月不得(de)超過(guo)(guo)三(san)十六(liu)小(xiao)(xiao)時。適用法律(lv)許可(ke)者除外。

  4.公司應嚴格控制(zhi)雇員加班(ban)(ban)時間,盡(jin)可能(neng)避(bi)免或減(jian)少加班(ban)(ban)情況。

  5.夏季高溫時期和其他(ta)特殊情況,為保障雇員健(jian)康,工會(hui)可建議公司(si)減少工作時間。

  6.雇(gu)員必須按(an)公司工作(zuo)規章規定的程序報(bao)告每天出勤情(qing)況。任何雇(gu)員由(you)于個(ge)人(ren)原因(yin)擬遲到(dao)、早(zao)退(tui)或缺(que)勤需事先取得主管(guan)人(ren)員的同意。遇有緊急情(qing)況不可(ke)能事先批準,雇(gu)員應盡快報(bao)告緊急情(qing)況的性質和未(wei)能提早(zao)報(bao)告的原因(yin),但最遲應在復工時立(li)即報(bao)告。 (二)節、假日

  雇員每年享有下列(lie)法(fa)定(ding)節(jie)(jie)(jie)、假日(ri)(ri)(在條件允許(xu)的(de)情況下,公司(si)可適當增(zeng)加(jia)節(jie)(jie)(jie)、假日(ri)(ri)休息天(tian)數):元旦(一月一日(ri)(ri))_________一天(tian);國(guo)際勞動節(jie)(jie)(jie) (五(wu)月一日(ri)(ri))_________一天(tian);國(guo)慶節(jie)(jie)(jie)(十月一日(ri)(ri))_________二天(tian);春節(jie)(jie)(jie)_________三天(tian);法(fa)律、法(fa)規規定(ding)的(de)其他休假節(jie)(jie)(jie)日(ri)(ri)。

  (三)有薪假期

  1.受(shou)公(gong)司連續雇用滿一(yi)年的職(zhi)工(gong)每年有(you)(you)(you)十二天(tian)有(you)(you)(you)薪假期(qi)。公(gong)司對(dui)有(you)(you)(you)貢獻(xian)的的職(zhi)工(gong)可適當增加休假天(tian)數。

  2.經公司批準,假(jia)期可分一次或多次享(xiang)用。

  (四(si))特殊(shu)性質的事假(jia)按(an)有關規(gui)定辦理(li)。

  (五)病假按公司有關規定執行。

  (六)婚(hun)假、產假按(an)中華人民共和(he)國有關婚(hun)姻法和(he)計劃生育政策規定執(zhi)行。

  (七)喪(sang)假按中華人民共和(he)國現行辦法執行。家有(you)喪(sang)事的雇(gu)員應立即報(bao)告其部門主管。

  (八)探親假

  1.按中華人(ren)民共和(he)國現行(xing)辦法執行(xing);但是(shi)享受探(tan)親假當年(nian)應不再享有年(nian)度(du)休假。

  2.有(you)資格(ge)依適用(yong)法規享(xiang)受(shou)探(tan)親假之(zhi)雇員可(ke)由公司自行(xing)決定,并事先取得總經理批(pi)準后享(xiang)用(yong)探(tan)親假。

  第五條 工資、補助和各項基金

  (一(yi))公(gong)司有(you)權根據(ju)有(you)關法律和(he)公(gong)司的(de)(de)利益(yi)和(he)需要,決定雇員工(gong)資(zi)、獎金(jin)和(he)各(ge)項(xiang)補(bu)貼的(de)(de)分(fen)配(pei)制(zhi)度,在經濟效(xiao)益(yi)提(ti)高的(de)(de)前提(ti)下并考慮消費、物價上漲的(de)(de)因素,應增(zeng)加雇員工(gong)資(zi)。公(gong)司制(zhi)訂和(he)修改上述分(fen)配(pei)制(zhi)度時(shi)應聽取工(gong)會的(de)(de)意見。

  (二(er))董(dong)事(shi)會根(gen)據資格決(jue)定中方高(gao)級管理人員的(de)工資和(he)福利(li)。

  (三)雇員有資格享受公司規定的(de)工(gong)資、津貼、獎金和(he)福利,以及適(shi)用法(fa)律規定的(de)其他補助。

  (四)公司將根據(ju)董事會(hui)制訂的(de)(de)方針(zhen),按雇員(yuan)的(de)(de)工作表現和對生產的(de)(de)貢獻以及公司的(de)(de)效益(yi),決定(ding)是否發(fa)給獎(jiang)(jiang)金(jin)及獎(jiang)(jiang)金(jin)數額(e)。

  (五)公(gong)司(si)(si)依法支付(fu)(fu)加(jia)班(ban)(ban)工(gong)(gong)資。對(dui)(dui)正(zheng)常工(gong)(gong)作日(ri)加(jia)班(ban)(ban)的(de)(de)雇員(yuan),公(gong)司(si)(si)按(an)雇員(yuan)小時(shi)工(gong)(gong)資之(zhi)百(bai)分(fen)(fen)之(zhi)一(yi)百(bai)五十(shi)(150%)支付(fu)(fu)加(jia)班(ban)(ban)費。對(dui)(dui)在公(gong)休日(ri)加(jia)班(ban)(ban)的(de)(de)雇員(yuan),公(gong)司(si)(si)按(an)雇員(yuan)小時(shi)工(gong)(gong)資的(de)(de)百(bai)分(fen)(fen)之(zhi)二百(bai)(200%)支付(fu)(fu)加(jia)班(ban)(ban)費。對(dui)(dui)在節假(jia)日(ri)加(jia)班(ban)(ban)的(de)(de)雇員(yuan),公(gong)司(si)(si)按(an)雇員(yuan)小時(shi)工(gong)(gong)資之(zhi)百(bai)分(fen)(fen)之(zhi)三(san)百(bai)(300%)支付(fu)(fu)加(jia)班(ban)(ban)費。如果(guo)雇員(yuan)因未在正(zheng)常工(gong)(gong)作時(shi)間認真(zhen)自覺(jue)履(lv)行其工(gong)(gong)作任務而(er)需加(jia)班(ban)(ban),公(gong)司(si)(si)不發給任何加(jia)班(ban)(ban)費。

  (六)公司應支付(fu)法律(lv)規定的任何其(qi)它(ta)金額,包括病假(jia)工(gong)資和節假(jia)日工(gong)資。

  (七)支(zhi)付雇員的工(gong)資、獎金和(he)津(jin)貼以及任何(he)其他付費應由(you)公(gong)(gong)司直接支(zhi)付給雇員本(ben)人,上(shang)述(shu)支(zhi)付如涉(she)及個人收入調節(jie)稅(shui)、所得(de)稅(shui)和(he)其它(ta)稅(shui)賦(fu)(fu)或(huo)費用(yong),該(gai)稅(shui)賦(fu)(fu)或(huo)費用(yong)應根據中國有(you)(you)關(guan)法律由(you)有(you)(you)關(guan)雇員本(ben)人負擔并由(you)公(gong)(gong)司扣繳。

  (八)如果公(gong)司(si)臨(lin)時(shi)停(ting)產,停(ting)產期間公(gong)司(si)應向雇員支付停(ting)產期工(gong)資,金額相(xiang)當于雇員平均工(gong)資的百(bai)分之七十(70%)。如果停(ting)產超過(guo)一個(ge)公(gong)歷月,公(gong)司(si)應決定采取(qu)相(xiang)應措施(shi),包(bao)括(kuo)本(ben)合同8.2款預期的措施(shi)。

  (九)除第(五(wu))款規定的費用外,公司將對下列(lie)費用負責(ze):

  1.每一上班雇(gu)員的午(wu)餐費;

  2.每一雇員工作服的費用;

  3.本(ben)合同第(di)七條第(di)(五(wu))款規定(ding)的雇員責(ze)任(ren)保(bao)險費(fei)用(yong);

  4.按董事會批準的“公司獎(jiang)勵(li)制度”,從職工獎(jiang)勵(li)和(he)福利基金(jin)中提取(qu)的獎(jiang)金(jin)和(he)福利費(fei)用(yong);

  5.按本合同第(di)六(liu)條第(di)(一)款(kuan)1.項,付(fu)給雇(gu)員(yuan)的款(kuan)項。

  (十)公司依照_________規定(ding),按比例提取各項費用和(he)基(ji)金;

  1.按月提取相(xiang)當于中方職(zhi)工(gong)實發工(gong)資(zi)總額百分之(zhi)七點五(7.5%)的中方職(zhi)工(gong)醫療基金(jin);

  2.按月提取(qu)相當(dang)于中(zhong)(zhong)方職(zhi)工實發工資總額發之二十(20%)的中(zhong)(zhong)方職(zhi)工日常勞保福利費用(yong)(包(bao)括辭(ci)退補償(chang)金);

  3.按月提取相當于中方職(zhi)工實發工資總額(e)百分(fen)之二十(20%)的中方職(zhi)工養老儲備金;

  4.按年提取相當(dang)于中方(fang)職(zhi)工(gong)實發工(gong)資總額百分之一(yi)點五(1.5%)的中方(fang)職(zhi)工(gong)日常(chang)教(jiao)育經(jing)費(fei);

  5.按中(zhong)方(fang)職工(gong)人(ren)數,按每人(ren)每月元(yuan)的標準向_________市(shi)財(cai)政局(ju)交納中(zhong)方(fang)職工(gong)糧(liang)、油(you)、燃料(liao)、副食、文(wen)教衛生(sheng)和其(qi)他各項(xiang)價格補貼(tie)費。公司評為產品(pin)出口企業或先進(jin)技術企業后,除按照(zhao)規定支付職工(gong)工(gong)資,提取中(zhong)方(fang)職工(gong)勞(lao)動保(bao)險、醫(yi)療、福(fu)利費用和住房(fang)補貼(tie)以外,不再上繳國(guo)家對中(zhong)方(fang)職工(gong)的各項(xiang)補貼(tie)。

  6.根(gen)據《_________》,公(gong)司(si)和職(zhi)工(gong)個人每月應交存工(gong)資(zi)總額10%作為中方(fang)職(zhi)工(gong)住房公(gong)積金。

  7.其它(ta)符合(he)規定的費用基金。

  (十一)公司應按有(you)關法律、法規(gui)的規(gui)定使用上(shang)述費用和基金,并定期(qi)向工會通報使用情況。

  第六條 獎勵、獎金和補助

  (一)公司對雇員(yuan)的(de)出色工(gong)作,長期、忠誠(cheng)的(de)服務,對公司有益的(de)行動和建議,給予表揚和嘉(jia)獎(jiang)或給予公司認為合(he)適的(de)獎(jiang)勵(li)(li),這類獎(jiang)勵(li)(li)可以用獎(jiang)金(jin)辦法頒發。

  (二)對下述特(te)別(bie)情(qing)況,將發給下述特(te)別(bie)補助:

  1.雇員結婚:人民(min)幣_________元(yuan);

  2.雇(gu)員第一次生育:人民(min)幣_________元;

  3.雇員由于長期生病(bing)被解雇:人民幣_________元。

  4.雇員父母(mu)亡故:人民幣_________元。

  (三)公(gong)司可因(yin)以下任(ren)何理由發給雇員(yuan)獎金:

  1.在達到(dao)生產目標、完成工作任務或增加生產效力方面取得杰出(chu)成就;

  2.模(mo)范執行公(gong)司工作規章;

  3.生產(chan)、技(ji)術的創造發明或改進生產(chan)方法和技(ji)術;

  4.對改進公司經(jing)營管理(li)或工作環境作出貢獻;

  5.提出有(you)用(yong)的建議,并因此防(fang)止意外發生和(he)/或防(fang)止公司遭受損失。

  6.其他應予(yu)物質獎(jiang)勵(li)的模范(fan)行為。

  獎金和(he)其它(ta)獎勵(li)可(ke)由公(gong)司直接支付(fu)給雇員本(ben)人(ren)。

  第七條 勞動保護和勞動保險

  (一)公(gong)(gong)司(si)應遵(zun)守適用于(yu)合資(zi)(zi)企(qi)業(ye)的(de)(de)關于(yu)勞(lao)(lao)動(dong)(dong)保護、勞(lao)(lao)動(dong)(dong)保險的(de)(de)法規,以保證(zheng)安全(quan)文明生(sheng)產,不斷改(gai)善勞(lao)(lao)動(dong)(dong)條件。公(gong)(gong)司(si)對(dui)女職(zhi)工和(he)未(wei)成年(nian)工實行特殊勞(lao)(lao)動(dong)(dong)保護。公(gong)(gong)司(si)和(he)工會有(you)責任教育雇(gu)員遵(zun)守公(gong)(gong)司(si)有(you)關安全(quan)生(sheng)產的(de)(de)規章制(zhi)度和(he)操(cao)作規程,組(zu)織雇(gu)員接受安全(quan)技(ji)術培訓。從事特種作業(ye)的(de)(de)員工必(bi)須經過(guo)專門培訓并取得(de)特種作業(ye)資(zi)(zi)格。

  (二)雇(gu)員每年體(ti)檢(jian)一次(ci)(ci),費(fei)用由公司負(fu)擔(dan)。身處(chu)有害環境(jing)的雇(gu)員可視情況(kuang)增加體(ti)檢(jian)次(ci)(ci)數。

  (三)雇員應遵守中國有關的安(an)全法規,以及隨時(shi)(shi)由公司(si)頒布的安(an)全規則。公司(si)在引進(jin)(jin)(jin)、推廣新(xin)技術、新(xin)設備時(shi)(shi)必須同時(shi)(shi)引進(jin)(jin)(jin)或采取可靠的勞動保(bao)護措(cuo)施并對職工進(jin)(jin)(jin)行培(pei)訓后方(fang)可投入使用。

  (四(si))員工對(dui)公(gong)司(si)管理人(ren)員違(wei)章(zhang)指揮(hui),強令冒險作(zuo)業有(you)權拒絕執行;對(dui)危害生命(ming)安全和身體(ti)健康的行為,有(you)權提(ti)出批評、檢舉和控告(gao)。

  (五(wu))如雇員(yuan)因(yin)工業(ye)(ye)事(shi)故死亡或受傷,或嚴重(zhong)職業(ye)(ye)中毒和(he)發生其它引(yin)起傷害的職業(ye)(ye)事(shi)故,公司應按(an)照國務院一九(jiu)九(jiu)一年頒布的《企(qi)業(ye)(ye)職工傷亡事(shi)故報告(gao)和(he)處理(li)(li)規定》及時向公司的主管部(bu)門和(he)當地勞動人事(shi)部(bu)門及工會組織報告(gao),并(bing)接受他們的調查和(he)處理(li)(li)。

  (六)公司負(fu)責購買全體雇(gu)員的(de)責任保險。

  (七)公司負責(ze)向職工提供勞保(bao)(bao)用品(pin)并(bing)制(zhi)定勞保(bao)(bao)用品(pin)發放細則,此類細則應(ying)足以(yi)在任(ren)何氣候(hou)和工作條件下對工人進行(xing)保(bao)(bao)護。

  (八)公司將執行(xing)政(zheng)(zheng)府有關合資(zi)職工的(de)(de)退(tui)休政(zheng)(zheng)策實行(xing)養老(lao)保險制度(du)。在(zai)遵(zun)守上述規定的(de)(de)前提下,公司可另行(xing)制定其認為適當的(de)(de)退(tui)休養老(lao)政(zheng)(zheng)策和制度(du)。

  第八條 處罰和解雇

  (一)解雇(gu)試用期內(nei)的雇(gu)員(yuan)

  試用期內任何(he)一(yi)方有權提前7天書面(mian)通知對(dui)方終止合(he)同。

  (二)因故解雇和(he)其它處(chu)罰

  1.公司解雇(gu)(gu)其(qi)正式雇(gu)(gu)員時,應提前三十天發給正式雇(gu)(gu)員和(he)工(gong)會書面通知。公司對于(yu)違(wei)反(fan)公司各項規章制度(du),違(wei)反(fan)勞動紀(ji)律(lv),造(zao)成一(yi)定后(hou)果的職工(gong),可(ke)分(fen)(fen)別情(qing)況給予批(pi)評(ping)、削減基本工(gong)資(zi)或停職等處(chu)分(fen)(fen),情(qing)節(jie)嚴重,屢(lv)教不(bu)改的可(ke)以開(kai)除。

  2.上述批評指(zhi)公司要求(qiu)雇(gu)員(yuan)作出書面道歉及公司指(zhi)示雇(gu)員(yuan)今后如何(he)改進的情況。削減(jian)基(ji)本工(gong)資指(zhi)公司要求(qiu)雇(gu)員(yuan)作出書面道歉,并對其(qi)第一次違章扣取其(qi)每(mei)月工(gong)資的百分之三十(30%)。但是,每(mei)一計薪(xin)期間(jian)(jian)因違章削減(jian)工(gong)資金額不(bu)能(neng)超(chao)過該計薪(xin)期間(jian)(jian)所發工(gong)資額的百分之六(liu)十(60%)。停(ting)職指(zhi)雇(gu)員(yuan)停(ting)薪(xin)停(ting)職,為期不(bu)超(chao)過七(7)天(tian)。

  (三)由于傷害(hai)或疾(ji)病原因引起的解(jie)雇

  1.公司制定公司有關(guan)病(bing)假(jia)的(de)規(gui)定和制度(du);員工(gong)(gong)患病(bing)或非因(yin)公負傷,醫療期(qi)滿(man)后,不能(neng)從(cong)事(shi)原工(gong)(gong)作(zuo)也不能(neng)從(cong)事(shi)由(you)公司另行安(an)排的(de)工(gong)(gong)作(zuo)的(de)。

  2.對屬于下列(lie)情況,公(gong)司不會按第八條(二)款(kuan)規定解雇雇員(yuan):

  (1)員工患職(zhi)業病或者因工負傷并被確認喪失或部分喪失勞動(dong)能(neng)力的;

  (2)員(yuan)工患病或者負(fu)傷,在(zai)規定的醫療期內的;

  (3)女員工在(zai)孕期(qi)、產期(qi)、哺乳期(qi)內的;

  (4)國家法律或政策禁止解除本合(he)同。

  (四)通知和備(bei)案

  公(gong)司(si)解雇(gu)雇(gu)員(yuan)時應提前一個月通知工(gong)會(hui)和(he)被(bei)解雇(gu)雇(gu)員(yuan),并報(bao)公(gong)司(si)主管部門和(he)公(gong)司(si)所在地(di)勞動人(ren)事(shi)部門備(bei)案(an)。

  (五)解雇費

  如(ru)果(guo)公(gong)司(si)(si)在集體勞動合同有效期(qi)內(nei)根據第(di)八條(tiao)(二)款和第(di)八條(tiao)(三(san))款1.解雇(gu)(gu)(gu)雇(gu)(gu)(gu)員或(huo)雇(gu)(gu)(gu)員個(ge)人勞動合同期(qi)滿(man)后公(gong)司(si)(si)未予續(xu)約(yue),被(bei)解雇(gu)(gu)(gu)的(de)雇(gu)(gu)(gu)員可(ke)根據其受公(gong)司(si)(si)雇(gu)(gu)(gu)用(yong)時間,每(mei)工(gong)作滿(man)一年可(ke)領(ling)取(qu)一個(ge)月的(de)公(gong)司(si)(si)平均工(gong)資(zi),工(gong)作滿(man)十年的(de)雇(gu)(gu)(gu)員自第(di)十一年起,每(mei)滿(man)一年領(ling)取(qu)一個(ge)半(ban)月的(de)公(gong)司(si)(si)平均工(gong)資(zi)。雇(gu)(gu)(gu)員由于長期(qi)生(sheng)病和因生(sheng)產技術條(tiao)件(jian)變(bian)化被(bei)解雇(gu)(gu)(gu)可(ke)酌情加發(fa)給(gei)雇(gu)(gu)(gu)員三(san)至六個(ge)月實得(de)工(gong)資(zi)。對開(kai)除的(de)雇(gu)(gu)(gu)員不發(fa)給(gei)解雇(gu)(gu)(gu)費。

  (六)由于公司違法引(yin)起(qi)的解(jie)雇

  因公(gong)司嚴重違(wei)反合同侵害雇員合法權益,雇員提出辭職時,公(gong)司需按規定(ding)支付解(jie)雇費。

  (七)工會代表

  對(dui)于公司雇員的(de)(de)解雇、辭退或懲罰,須征求工會(hui)意見,有(you)關(guan)雇員或就有(you)關(guan)問題向公司陳述其立場。工會(hui)如果認為(wei)不合理(li),有(you)權提出(chu)反對(dui)。工會(hui)可以派代(dai)表與代(dai)表董事會(hui)的(de)(de)管理(li)部門磋(cuo)商,尋(xun)求解決(jue)的(de)(de)辦法,但管理(li)部門有(you)作出(chu)終局(ju)決(jue)定的(de)(de)最終權利。如有(you)爭議按第十二(er)條(二(er))款執(zhi)行。

  (八(ba))被解(jie)雇的(de)雇員

  不管任何原(yuan)因被公(gong)司(si)解(jie)雇的雇員應立即(ji)向(xiang)公(gong)司(si)歸(gui)還所有(you)(you)公(gong)司(si)擁有(you)(you)的或公(gong)司(si)有(you)(you)所有(you)(you)權的文件、設(she)備和其(qi)它(ta)財產。

  第九條 辭職

  (一)一般性辭職

  在第(di)八條(二)款規定的(de)(de)前(qian)提下,要求辭(ci)(ci)職或退(tui)休的(de)(de)雇員在取得工(gong)會同意(yi)后,必須在建議的(de)(de)辭(ci)(ci)職日的(de)(de)三十(30)天前(qian)通(tong)知公司。具(ju)體說明有理(li)由辭(ci)(ci)職的(de)(de)特(te)別情況,對這類(lei)辭(ci)(ci)職的(de)(de)請求,公司不得無理(li)拒(ju)絕。辭(ci)(ci)職雇員無權獲得解雇費。

  (二)受過特別培訓(xun)雇員(yuan)的(de)辭職

  盡管有第(di)八條(一)的(de)規(gui)定,任(ren)何參加過公司(si)出資培(pei)訓的(de)公司(si)雇員(yuan),如在受訓結束起五(5)年(nian)內從公司(si)辭職(zhi),需向公司(si)償付培(pei)訓費用(yong),其金(jin)額(e)按(an)公司(si)有關制度執行,辭職(zhi)雇員(yuan)無權獲得(de)解(jie)雇費。

  第十條 保密、不競爭

  (一(yi))雇員同意(yi)對獲披(pi)露的有關公(gong)司或公(gong)司任(ren)(ren)何關聯商(shang)業(ye)實體的生產管理(li)過程和(he)技術、推銷或財務(wu)資(zi)料,及公(gong)司或公(gong)司任(ren)(ren)何關聯商(shang)業(ye)實體的客戶(hu)、產品、程序、業(ye)務(wu)和(he)服務(wu)資(zi)料嚴格保密,未(wei)經公(gong)司同意(yi),不以(yi)任(ren)(ren)何方式將(jiang)其(qi)披(pi)露給(gei)公(gong)司內外任(ren)(ren)何人士(shi),亦不將(jiang)其(qi)用以(yi)與(yu)公(gong)司進行(xing)競(jing)爭(zheng)或用作雇員履行(xing)本(ben)合同規定職責和(he)義務(wu)以(yi)外的其(qi)它用途。

  (二)公司與雇員個(ge)人勞動合同終止時,雇員應把(ba)其占有的全(quan)部公司圖(tu)紙、藍圖(tu)、備(bei)忘錄、客戶名錄、配方(fang)、財務報表或(huo)促銷(xiao)資料歸還公司。

  第十一條 發明

  本合同有(you)(you)效期內,雇(gu)員(yuan)因其工作(zuo)而作(zuo)出任(ren)何工藝產(chan)(chan)品或配方方面的(de)發(fa)明(“發(fa)明”),該等發(fa)明應(ying)是公司的(de)專(zhuan)(zhuan)有(you)(you)財產(chan)(chan),雇(gu)員(yuan)應(ying)立即將(jiang)其披露給公司,并采取必要步驟(zou)(包括(kuo)簽(qian)署文件),使公司擁有(you)(you)這(zhe)些發(fa)明的(de)產(chan)(chan)權和所有(you)(you)權。盡管有(you)(you)該規定,對雇(gu)員(yuan)在(zai)工作(zuo)時間外,在(zai)未(wei)使用或參考(kao)公司設(she)施、機密資料(liao)或材料(liao)情況作(zuo)出的(de)任(ren)何發(fa)明而獲得的(de)全部專(zhuan)(zhuan)利(li),雇(gu)員(yuan)應(ying)有(you)(you)權保留所有(you)(you)權。

  第十二條 監督檢查和爭議的解決

  (一)監督檢查

  為保障(zhang)勞動合(he)同(tong)(tong)的全面(mian)(mian)執行(xing),公司和工會將根據(ju)人數對等原則組成勞動合(he)同(tong)(tong)監督小組,監督合(he)同(tong)(tong)的執行(xing)情況。勞動合(he)同(tong)(tong)每(mei)年檢查(cha)一次(ci),檢查(cha)結果以書面(mian)(mian)報(bao)告形式提交雙方(fang)代表。雙方(fang)亦可應一方(fang)要求,不定(ding)期(qi)召開聯(lian)席會議,通報(bao)和協商有關(guan)公司和職工利益的重大事宜。

  (二)勞動糾紛

  公司內部(bu)出現的勞動糾紛應先由(you)公司勞動爭議調(diao)解(jie)(jie)委員會(hui)協商(shang)解(jie)(jie)決。如(ru)(ru)果不能(neng)協商(shang)解(jie)(jie)決,一(yi)方(fang)或雙方(fang)都可請_________市(shi)(shi)勞動部(bu)門仲裁(cai),如(ru)(ru)果有一(yi)方(fang)對(dui)仲裁(cai)結(jie)果不同意,該(gai)方(fang)可向_________市(shi)(shi)人民法院起訴。

  第十三條 臨時性人員的聘用

  (一)臨時性人員的(de)定義,指聘(pin)用期(qi)不超過(guo)一年,公司臨時聘(pin)用的(de)人員。

  (二)聘用(yong)(yong)程序,公司聘用(yong)(yong)臨(lin)時性(xing)人員由(you)總(zong)經(jing)理(li)和副(fu)總(zong)經(jing)理(li)討論(lun)同(tong)意,由(you)總(zong)經(jing)理(li)決(jue)定后,簽發聘書。

  (三)聘用臨時性(xing)人(ren)員(yuan)的工資(zi)和福利待遇需由(you)總經(jing)理和副總經(jing)理討論決(jue)定。

  (四)聘用臨時性人員需執行《中華人民共和(he)國中外合資經營企業(ye)勞動(dong)管理(li)規定》。

  第十四條 合同的解釋

  第十五條 生效和期限

  (一)在(zai)本合同簽署后(hou),雙方應立即將本合同報_________市勞動部門和公司主管部門備案。本合同自雙方簽署日起(qi)生效(xiao)。

  二、工作內容

  第四條(tiao) 乙(yi)方(fang)的(de)工作(zuo)任務和職責(ze)(ze)的(de)具體內容記載于甲方(fang)制定(ding)的(de)關于職務、崗位的(de)工作(zuo)要求(qiu)或職責(ze)(ze)的(de)相關規(gui)(gui)定(ding)和已經形成的(de)各項規(gui)(gui)章制度中,乙(yi)方(fang)簽訂本合同(tong)時知悉并(bing)同(tong)意受這些規(gui)(gui)定(ding)和制度的(de)約束。

  三、工作時間

  第五條(tiao) 每(mei)天(tian)工(gong)(gong)(gong)作8時。甲方(fang)因生產經營的需(xu)要或法定(ding)情形可調整乙方(fang)的休(xiu)假日、工(gong)(gong)(gong)作時間或安排(pai)乙方(fang)加(jia)班(ban)、加(jia)點;安排(pai)乙方(fang)加(jia)班(ban)的,應安排(pai)乙方(fang)同等時間補休(xiu)或依法支付加(jia)班(ban)工(gong)(gong)(gong)資;因甲方(fang)商場管理工(gong)(gong)(gong)作的特殊(shu)性,故全體職工(gong)(gong)(gong)不實(shi)行周末固定(ding)休(xiu)息制度,而實(shi)行輪休(xiu)制度。

  四、勞動保護和勞動條件

  第六條 甲(jia)方(fang)應(ying)在乙(yi)方(fang)上崗前對乙(yi)方(fang)進(jin)行職業安全、服務(wu)規(gui)范(fan)、職業道(dao)德、職業技能、甲(jia)方(fang)

  規章制度(du)方(fang)面(mian)的培訓(xun)。甲方(fang)按國家(jia)規定組織(zhi)對(dui)乙方(fang)進行健康檢查。甲方(fang)按照國家(jia)勞(lao)動安全衛生的有關規定為乙方(fang)提供(gong)必(bi)要的安全防護設(she)施。甲方(fang)加強安全生產(chan)管(guan)理(li),建立、健全安全生產(chan)責任制度(du),完(wan)善安全生產(chan)經營條件;健全服務質(zhi)量管(guan)理(li)制度(du),嚴(yan)格實施崗位質(zhi)量規范、質(zhi)量責任以及(ji)相(xiang)應的考核辦法。

  五、勞動報酬

  第七條 甲方(fang)遵循按勞分配原(yuan)則(ze)制定工(gong)(gong)資(zi)制度。試(shi)用期內月(yue)滿勤工(gong)(gong)資(zi) 元(含加班(ban)費)。試(shi)用期滿后(hou),月(yue)滿勤工(gong)(gong)資(zi) 元(含加班(ban)費)。各種獎金、津貼、補貼和工(gong)(gong)齡工(gong)(gong)資(zi)等(deng)項(xiang)目不計入加班(ban)費計算基(ji)數(shu),正常(chang)工(gong)(gong)作(zuo)時間工(gong)(gong)資(zi)按東莞市政府頒布的最低工(gong)(gong)資(zi)標準執(zhi)行(xing),加班(ban)費以正常(chang)工(gong)(gong)作(zuo)時間工(gong)(gong)資(zi)為計算基(ji)數(shu)。月(yue)滿勤為28天(各部門實際出(chu)勤和休息(xi),按現行(xing)制度執(zhi)行(xing))。

  第八條 乙(yi)方工資由甲方核算后以人民幣通(tong)過現金(jin)支付,每(mei)月25日發放上月工資,如遇(yu)節假日或休息日,則(ze)提前到最近的工作日支付。

  第九條 甲方依法(fa)(fa)安排乙方延長(chang)工(gong)作時間或(huo)(huo)者在休(xiu)息日、法(fa)(fa)定(ding)休(xiu)假(jia)日加(jia)班(ban)的(de),應按法(fa)(fa)律的(de)規(gui) 定(ding)支付(fu)加(jia)班(ban)工(gong)資或(huo)(huo)安排補休(xiu)。

  六、勞動紀律

  第八(ba)條 乙方(fang)應(ying)嚴格遵守(shou)甲(jia)(jia)方(fang)的(de)各項規(gui)章制度和(he)勞動紀律;按(an)時完成甲(jia)(jia)方(fang)規(gui)定的(de)工(gong)(gong)(gong)作(zuo)任(ren)務(wu)和(he)經(jing)濟指(zhi)標;服從甲(jia)(jia)方(fang)的(de)管(guan)理和(he)要(yao)求,不(bu)得(de)擅離職守(shou);保守(shou)甲(jia)(jia)方(fang)的(de)業(ye)務(wu)、技術及(ji)有關文件的(de)秘密;乙方(fang)不(bu)得(de)從事與(yu)甲(jia)(jia)方(fang)業(ye)務(wu)范圍相似的(de)任(ren)何第二職業(ye)或者直(zhi)接參(can)與(yu)同行業(ye)其他單位的(de)工(gong)(gong)(gong)作(zuo);乙方(fang)不(bu)得(de)利用(yong)所(suo)掌(zhang)握的(de)資(zi)料和(he)信(xin)息從甲(jia)(jia)方(fang)挖走商戶,散布(bu)對甲(jia)(jia)方(fang)不(bu)利的(de)謠言或信(xin)息;按(an)甲(jia)(jia)方(fang)的(de)工(gong)(gong)(gong)作(zuo)要(yao)求盡心工(gong)(gong)(gong)作(zuo);積極參(can)加甲(jia)(jia)方(fang)組(zu)織的(de)培訓(xun),提高自身(shen)素質。

  第九條 乙方(fang)違反勞(lao)動紀律(lv)和(he)規(gui)章(zhang)(zhang)制度(du)(du)以及服(fu)務(wu)規(gui)范(fan),甲(jia)(jia)方(fang)可依(yi)據(ju)規(gui)章(zhang)(zhang)制度(du)(du)和(he)勞(lao)動紀律(lv),給予(yu)紀律(lv)處(chu)分,嚴重違反的(de)(de),依(yi)法解除(chu)本合(he)同(tong)。乙方(fang)不能勝任工(gong)作(zuo),或(huo)不認真履行(xing)職(zhi)責,或(huo)利用職(zhi)務(wu)之便為(wei)自己或(huo)他(ta)人牟(mou)取私利,或(huo)者玩忽職(zhi)守的(de)(de),或(huo)者有(you)其他(ta)違反規(gui)章(zhang)(zhang)制度(du)(du)行(xing)為(wei)的(de)(de),甲(jia)(jia)方(fang)有(you)權(quan)調整(zheng)乙方(fang)崗(gang)位或(huo)解除(chu)本合(he)同(tong)。

  第十條 乙方(fang)(fang)不服從(cong)管理,違反(fan)安全操作(zuo)規范(fan)或操作(zuo)規程(cheng)的,甲方(fang)(fang)依照規章制度給予(yu)相應(ying)處分(fen);若造(zao)成(cheng)甲方(fang)(fang)經濟損失(shi),乙方(fang)(fang)須承擔賠償損失(shi)的責(ze)任;造(zao)成(cheng)重大(da)事(shi)(shi)故,構成(cheng)犯(fan)罪(zui)的,依據刑(xing)法有(you)關規定追(zhui)究刑(xing)事(shi)(shi)責(ze)任。

  第十一條 乙方(fang)患(huan)有崗(gang)位工種及行業禁忌(ji)的(de)疾病,應及時(shi)向甲(jia)方(fang)報告,并(bing)即時(shi)脫離(li)工作崗(gang)位。

  七、勞動合同的解除和終止

  第十二條(tiao) 本(ben)勞動合(he)同(tong)的(de)解(jie)除或終止,依(yi)《勞動合(he)同(tong)法》規(gui)定執行。乙方患崗位(wei)工(gong)種(zhong)及行業禁忌的(de)疾(ji)病,在醫療期滿后(hou)不符合(he)國(guo)家和本(ben)市從事有關行業、工(gong)種(zhong)崗位(wei)規(gui)定,甲方無法另行安排工(gong)作的(de),可以(yi)提(ti)前30日(ri)以(yi)書面形式通知乙方解(jie)除本(ben)合(he)同(tong)。

  第十(shi)三條 乙方(fang)(fang)(fang)辭職必須提前30天前通知甲(jia)方(fang)(fang)(fang),經(jing)甲(jia)方(fang)(fang)(fang)同意后(hou),按規定辦理(li)交接(jie)手續。乙方(fang)(fang)(fang)應歸還(huan)甲(jia)方(fang)(fang)(fang)之資料(liao)、物品,甲(jia)方(fang)(fang)(fang)為(wei)乙方(fang)(fang)(fang)辦理(li)正式離職手續,雙方(fang)(fang)(fang)解除勞動關系。乙方(fang)(fang)(fang)沒有交還(huan)其掌握(wo)的甲(jia)方(fang)(fang)(fang)重要機密文(wen)件資料(liao)而造成甲(jia)方(fang)(fang)(fang)經(jing)濟(ji)損失的,應依法承擔損失賠償責任。

  八、服務期和違約責任

  第十四(si)條 凡由甲方出資培訓(xun)招接收的人(ren)員(yuan),應遵守(shou)約定的服(fu)務期,如(ru)果服(fu)務期未滿而提(ti)前離職(zhi)的,應向甲方賠償(chang)培訓(xun)費和招接收費。服(fu)務期和賠償(chang)標(biao)準參(can)照(zhao)《教育培訓(xun)協議書(shu)》。

  九、保密約定及競業限制條款

  第十(shi)五條 乙方(fang)有義務保守其(qi)在職(zhi)期(qi)間所知悉或(huo)持有的商業秘密(mi)信息,且(qie)非經(jing)甲(jia)方(fang)書面同意,不得泄露、告(gao)知、交付或(huo)移轉他(ta)人,或(huo)對外(wai)發表(biao)、出版或(huo)自行使用前述機密(mi)信息,包括日常工作(zuo)事(shi)務及商戶信息均不得向(xiang)甲(jia)方(fang)以外(wai)的個人或(huo)者單位講(jiang)述或(huo)泄露。保密(mi)事(shi)項(xiang)及范圍以公司(si)相(xiang)關制度及其(qi)他(ta)相(xiang)關文件(jian)為準。

  第(di)十(shi)六(liu)條 乙(yi)方(fang)違(wei)反(fan)(fan)上述(shu)保密義務(wu),甲方(fang)有(you)權即時解除勞動合同(tong);造成(cheng)甲方(fang)經濟(ji)或商譽等損害的,乙(yi)方(fang)還應承擔(dan)賠(pei)償責任(ren);損失(shi)無(wu)法計算的,以乙(yi)方(fang)年(nian)度工資(zi)的五倍為準;違(wei)反(fan)(fan)刑法的,依法追究責任(ren)人的刑事責任(ren)。

  第十七條(tiao) 乙(yi)方(fang)屬(shu)于高級管理人員、高級技術人員和其(qi)他負有保密義務的人員的,在(zai)(zai)解除或者終止勞(lao)動合(he)同(tong)后二年(nian)內,不得在(zai)(zai)東莞(guan)市(包括各鎮區)及其(qi)周邊地區與本單(dan)位經(jing)(jing)營同(tong)類(lei)產(chan)品、從事同(tong)類(lei)業(ye)務的有競爭關(guan)系的單(dan)位任職,或者自(zi)己開業(ye)經(jing)(jing)營同(tong)類(lei)產(chan)品、從事同(tong)類(lei)業(ye)務;違反本條(tiao)規定(ding)的,乙(yi)方(fang)應支付相(xiang)當于離職前(qian)一年(nian)工資總額的五倍(bei)的違約金,給甲(jia)方(fang)造成經(jing)(jing)濟損失(shi)的,乙(yi)方(fang)還應承擔賠償責任。

  十、勞動爭議處理

  第(di)十八條 甲乙雙方發生勞動(dong)爭議(yi),可以協商解決,也可以依(yi)照《勞動(dong)爭議(yi)調解仲(zhong)(zhong)裁法》的(de)規定(ding)通過申請(qing)調解、仲(zhong)(zhong)裁和提(ti)起訴訟解決。

  十、其他

  第十(shi)九條(tiao) 乙方(fang)對本(ben)合(he)同約定的工(gong)時工(gong)作制(zhi)度、勞動報(bao)酬標準(zhun)無異議,并保證在本(ben)合(he)同解除或終(zhong)止時,不(bu)再就月工(gong)資和加(jia)班工(gong)資標準(zhun)等問(wen)題再提出(chu)任(ren)何(he)其他要求。

  第二十條 簽訂勞動合同前,乙(yi)(yi)方(fang)必須明確(que)與(yu)其他單位或個(ge)人沒有任何勞動關(guan)(guan)系,否則與(yu)此相關(guan)(guan)的法律(lv)后(hou)果和責任均由乙(yi)(yi)方(fang)承擔,甲(jia)方(fang)如有因法律(lv)規(gui)定需承擔的責任,則甲(jia)方(fang)有權向乙(yi)(yi)方(fang)追償。

  第二十一條(tiao) 乙方應如(ru)實(shi)提供(gong)(gong)合法真(zhen)實(shi)準確的(de)(de)年齡、身(shen)份(fen)、家庭(ting)住址、學歷、專業技術資質(zhi)(zhi)、從業資質(zhi)(zhi)的(de)(de)證件和(he)資料,并按甲(jia)方的(de)(de)要求提供(gong)(gong)相關(guan)證件以及與(yu)勞動合同直接相關(guan)的(de)(de)基本(ben)情況(kuang)。乙方違反本(ben)條(tiao)規定(ding),導致勞動合同無效的(de)(de),甲(jia)方依法辭(ci)退乙方,其法律后果(guo)和(he)責任由乙方承擔。

  第二十二條 下列文件或(huo)規(gui)定為本(ben)合同附件,與本(ben)合同具(ju)有(you)同等(deng)效力(li):

  關(guan)(guan)于勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)同的(de)定(ding)義,《布(bu)萊克法(fa)律辭典》規(gui)定(ding)為(wei)(wei):“勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)同是(shi)(shi)雇(gu)主(zhu)與(yu)雇(gu)員之間就勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)管(guan)理、工(gong)作條件(jian)、工(gong)資、津貼和懲罰做出(chu)的(de)約定(ding)。”而根據《中(zhong)華(hua)人(ren)(ren)(ren)(ren)民(min)共(gong)(gong)和國(guo)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)法(fa)》第(di)16條規(gui)定(ding):“勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)同是(shi)(shi)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者與(yu)用(yong)人(ren)(ren)(ren)(ren)單(dan)位(wei)確立(li)(li)(li)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)關(guan)(guan)系(xi)、明(ming)確雙方權利(li)和義務(wu)的(de)協議。"勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者和用(yong)人(ren)(ren)(ren)(ren)單(dan)位(wei)是(shi)(shi)根據該協議規(gui)定(ding)履行(xing)相關(guan)(guan)的(de)義務(wu)享受一定(ding)的(de)權利(li),如勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者為(wei)(wei)用(yong)人(ren)(ren)(ren)(ren)單(dan)位(wei)提供勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong),接受用(yong)人(ren)(ren)(ren)(ren)單(dan)位(wei)的(de)管(guan)理,用(yong)人(ren)(ren)(ren)(ren)單(dan)位(wei)向勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者支付勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)報酬(chou)、繳納社(she)會保(bao)險,同時要為(wei)(wei)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者提供勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)條件(jian)。因此勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)同作為(wei)(wei)認定(ding)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者與(yu)用(yong)人(ren)(ren)(ren)(ren)單(dan)位(wei)之間存(cun)在(zai)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)關(guan)(guan)系(xi)最直(zhi)接、最有效(xiao)的(de)書面證(zheng)據,具有重要的(de)作用(yong)。因此我國(guo)法(fa)律對勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)同的(de)簽(qian)訂做了明(ming)確規(gui)定(ding),《中(zhong)華(hua)人(ren)(ren)(ren)(ren)民(min)共(gong)(gong)和國(guo)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)法(fa)》第(di)16條規(gui)定(ding):“建(jian)立(li)(li)(li)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)關(guan)(guan)系(xi)應當訂立(li)(li)(li)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)同。”《中(zhong)華(hua)人(ren)(ren)(ren)(ren)民(min)共(gong)(gong)和國(guo)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)同法(fa)》第(di)10條規(gui)定(ding):“建(jian)立(li)(li)(li)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)關(guan)(guan)系(xi),應當訂立(li)(li)(li)書面勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)同。”

  (二)一(yi)般(ban)定義(yi)上的勞動合同終止(zhi)的概念

  從法(fa)理層面,勞(lao)動(dong)合同(tong)終止有廣義、狹義兩種理解。

  1.廣義的(de)(de)勞(lao)動(dong)合同(tong)終(zhong)止(zhi),泛指(zhi)勞(lao)動(dong)合同(tong)法律(lv)效力終(zhong)結(jie)的(de)(de)各種情形,包(bao)括勞(lao)動(dong)合同(tong)雙方當事人(ren)已將約定的(de)(de)權(quan)利(li)義務履(lv)行完畢或(huo)者勞(lao)動(dong)合同(tong)一方當事人(ren)滅失,以及(ji)因當事人(ren)對勞(lao)動(dong)合同(tong)作出的(de)(de)解除行為(wei)。

  2.狹義的(de)勞動合同終止,僅指勞動合同解除以外,出(chu)現法定情(qing)形(xing)使得勞動合同法律效力消滅(mie),導致所確立的(de)勞動關系終結的(de)情(qing)形(xing)。

  我(wo)國勞(lao)動(dong)(dong)(dong)法律(lv)體系中無論是《勞(lao)動(dong)(dong)(dong)法》,還是《勞(lao)動(dong)(dong)(dong)合同(tong)法》均采取了狹義理解(jie)。《勞(lao)動(dong)(dong)(dong)法》

  第23條明(ming)確(que)“勞動(dong)(dong)合(he)同(tong)期滿或者當事人(ren)約定的勞動(dong)(dong)合(he)同(tong)終止(zhi)(zhi)條件出現,勞動(dong)(dong)合(he)同(tong)即行終止(zhi)(zhi)”。《勞動(dong)(dong)合(he)同(tong)法(fa)》繼續延用了《勞動(dong)(dong)法(fa)》的劃(hua)分(fen)方式(shi),并以第四章(zhang)專門明(ming)確(que)規定了勞動(dong)(dong)合(he)同(tong)的解除和終止(zhi)(zhi)。因此,在勞動(dong)(dong)法(fa)律(lv)關(guan)系(xi)中,勞動(dong)(dong)合(he)同(tong)終止(zhi)(zhi)僅(jin)應(ying)當作狹義理解。

  (三)勞(lao)動合(he)同解(jie)除與(yu)終止的(de)差異(yi)分析(xi)

  1.勞動合(he)同解除(chu)的概念

  對于勞動合同的解除,不(bu)同的學(xue)者有不(bu)同的意見(jian),比較有代表性(xing)的觀(guan)點(dian)有:觀(guan)點(dian)一,“勞動合

  ①事人一方(fang)或(huo)雙方(fang)依法提前消滅勞(lao)動(dong)關系的法律行為";觀點三,“勞(lao)動(dong)合同的解(jie)除(chu),是指勞(lao)動(dong)合同

  依法訂立后,尚未全部履行之前(qian),因一(yi)定法律事(shi)實的出現,合同雙方當事(shi)人或一(yi)方當事(shi)人依法提前(qian)

  ②終止勞動合同的(de)法律效力(li)的(de)行為"。

  按照我國(guo)《勞(lao)(lao)(lao)動(dong)(dong)(dong)法(fa)(fa)(fa)(fa)(fa)》第二(er)十四條(tiao)規(gui)定:“經勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)當(dang)事人(ren)(ren)協(xie)商(shang)(shang)一(yi)(yi)致(zhi),勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)可(ke)(ke)以(yi)(yi)解(jie)(jie)(jie)(jie)除(chu)” 。因(yin)此從(cong)我國(guo)勞(lao)(lao)(lao)動(dong)(dong)(dong)法(fa)(fa)(fa)(fa)(fa)律(lv)理解(jie)(jie)(jie)(jie)來講,勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)解(jie)(jie)(jie)(jie)除(chu)是指(zhi)在勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)訂立后,在全部履行之前,簽約當(dang)事人(ren)(ren)雙(shuang)方,即用人(ren)(ren)單位和員工,提前終(zhong)止(zhi)(zhi)勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)的(de)法(fa)(fa)(fa)(fa)(fa)律(lv)效力,解(jie)(jie)(jie)(jie)除(chu)雙(shuang)方的(de)權利和義務。它可(ke)(ke)以(yi)(yi)分(fen)為法(fa)(fa)(fa)(fa)(fa)定解(jie)(jie)(jie)(jie)除(chu)和協(xie)商(shang)(shang)解(jie)(jie)(jie)(jie)除(chu)。法(fa)(fa)(fa)(fa)(fa)定解(jie)(jie)(jie)(jie)除(chu)是指(zhi)因(yin)發(fa)生法(fa)(fa)(fa)(fa)(fa)律(lv)、法(fa)(fa)(fa)(fa)(fa)規(gui)或(huo)勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)規(gui)定的(de)情況,提前終(zhong)止(zhi)(zhi)勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)的(de)法(fa)(fa)(fa)(fa)(fa)律(lv)效力。協(xie)商(shang)(shang)解(jie)(jie)(jie)(jie)除(chu),是指(zhi)當(dang)事人(ren)(ren)雙(shuang)方因(yin)某(mou)種(zhong)(zhong)原因(yin),協(xie)商(shang)(shang)同(tong)(tong)意提前終(zhong)止(zhi)(zhi)勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)的(de)法(fa)(fa)(fa)(fa)(fa)律(lv)效力。勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)的(de)解(jie)(jie)(jie)(jie)除(chu)可(ke)(ke)以(yi)(yi)由當(dang)事人(ren)(ren)雙(shuang)方協(xie)商(shang)(shang)一(yi)(yi)致(zhi)而(er)解(jie)(jie)(jie)(jie)除(chu)勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong),也(ye)可(ke)(ke)以(yi)(yi)由當(dang)事人(ren)(ren)一(yi)(yi)方依(yi)法(fa)(fa)(fa)(fa)(fa)提出(chu)解(jie)(jie)(jie)(jie)除(chu)勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)。相對于終(zhong)止(zhi)(zhi)來講,解(jie)(jie)(jie)(jie)除(chu)勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)的(de)法(fa)(fa)(fa)(fa)(fa)律(lv)規(gui)定給(gei)了用人(ren)(ren)單位和勞(lao)(lao)(lao)動(dong)(dong)(dong)者自由選擇對方的(de)法(fa)(fa)(fa)(fa)(fa)律(lv)依(yi)據,是對勞(lao)(lao)(lao)動(dong)(dong)(dong)力作為一(yi)(yi)種(zhong)(zhong)資源、一(yi)(yi)種(zhong)(zhong)特殊商(shang)(shang)品(pin)回歸市場提供了法(fa)(fa)(fa)(fa)(fa)律(lv)上的(de)支持(chi)。

  2.勞動(dong)合同終止和解除的差異(yi)

  勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)終(zhong)(zhong)止(zhi)和勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)解(jie)除(chu)存在(zai)相(xiang)同(tong)(tong)之處,即雙方所導致的(de)(de)(de)后果(guo)是一致的(de)(de)(de),也即依法終(zhong)(zhong)結(jie)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)當(dang)事(shi)(shi)(shi)人(ren)之間(jian)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)關系(xi)及相(xiang)應(ying)的(de)(de)(de)權利義(yi)務。但兩者之間(jian)存在(zai)明顯區別,主(zhu)要表現為(wei):其一,終(zhong)(zhong)結(jie)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)關系(xi)的(de)(de)(de)情形(xing)不(bu)同(tong)(tong)。勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)終(zhong)(zhong)止(zhi)基(ji)于(yu)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)履行(xing)完(wan)畢之后的(de)(de)(de)正常終(zhong)(zhong)結(jie)或主(zhu)體滅失(shi)導致勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)不(bu)能(neng)履行(xing)的(de)(de)(de)不(bu)得不(bu)終(zhong)(zhong)結(jie),均(jun)屬于(yu)非(fei)當(dang)事(shi)(shi)(shi)人(ren)主(zhu)觀(guan)(guan)意志(zhi)所能(neng)決定的(de)(de)(de)法律事(shi)(shi)(shi)實。勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)解(jie)除(chu)基(ji)于(yu)當(dang)事(shi)(shi)(shi)人(ren)一方或雙方主(zhu)觀(guan)(guan)意思表示的(de)(de)(de)提前終(zhong)(zhong)結(jie);其二,終(zhong)(zhong)結(jie)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)關系(xi)的(de)(de)(de)程(cheng)序不(bu)同(tong)(tong)。勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)終(zhong)(zhong)止(zhi)在(zai)于(yu)非(fei)當(dang)事(shi)(shi)(shi)人(ren)主(zhu)觀(guan)(guan)意志(zhi)所能(neng)決定的(de)(de)(de)法律事(shi)(shi)(shi)實,因(yin)此(ci)程(cheng)序要求(qiu)比(bi)較簡單,法律事(shi)(shi)(shi)實一旦發生勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)即行(xing)終(zhong)(zhong)止(zhi)。勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)解(jie)除(chu)在(zai)于(yu)當(dang)事(shi)(shi)(shi)人(ren)主(zhu)觀(guan)(guan)意志(zhi)決定的(de)(de)(de)行(xing)為(wei),因(yin)此(ci)應(ying)當(dang)符合(he)(he)法定解(jie)除(chu)情形(xing)并(bing)履行(xing)一定的(de)(de)(de)法定程(cheng)序。此(ci)外,勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)終(zhong)(zhong)止(zhi)與(yu)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)解(jie)除(chu),當(dang)事(shi)(shi)(shi)人(ren)所應(ying)當(dang)承擔的(de)(de)(de)權利義(yi)務也存在(zai)差異,比(bi)如經濟

  ③補償(chang)金的給付等(deng)。

  二、國(guo)外關(guan)于(yu)勞動(dong)合同終(zhong)止制度的(de)相(xiang)關(guan)規定

  針對勞(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)同(tong)終(zhong)(zhong)止(zhi),德(de)國(guo)、英(ying)國(guo)、法國(guo)等國(guo)家在勞(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)同(tong)相關立法中對用人單(dan)位(wei)可以(yi)(yi)解(jie)除或終(zhong)(zhong)止(zhi)勞(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)同(tong)的(de)條(tiao)件、程序,以(yi)(yi)及違法解(jie)除或終(zhong)(zhong)止(zhi)勞(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)同(tong)應當(dang)承擔的(de)法律責任進行了明(ming)確的(de)規定(ding)。 1.終(zhong)(zhong)止(zhi)條(tiao)件。其(qi)中大多數國(guo)家規定(ding),對于(yu)無固定(ding)期限的(de)勞(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)同(tong),只(zhi)要提(ti)出(chu)終(zhong)(zhong)止(zhi)申明(ming)并遵(zun)守一(yi)定(ding)的(de)預告期限即可;對于(yu)定(ding)期勞(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)同(tong)則只(zhi)有(you)在一(yi)定(ding)條(tiao)件下才可以(yi)(yi)終(zhong)(zhong)止(zhi)合(he)(he)同(tong)。英(ying)國(guo)、法國(guo)規定(ding)當(dang)雇員(yuan)犯有(you)嚴重(zhong)錯誤或企業遇到不可抗力的(de)情況時,雇主(zhu)才可以(yi)(yi)單(dan)方面終(zhong)(zhong)止(zhi)定(ding)期勞(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)同(tong)。

  同時(shi),有(you)些國(guo)家還規定了限制雇(gu)主(zhu)單方(fang)面終止(zhi)勞動(dong)合同的情形:比(bi)利時(shi)雇(gu)用合同法(fa)規定,任(ren)何以工人結婚、懷孕為(wei)由終止(zhi)勞動(dong)合同的都屬無效。

  2.終止(zhi)程序。法國規定,雇(gu)主終止(zhi)勞動合同(tong)(tong),需要經過下(xia)列程序:(1)預先(xian)談話(hua):企(qi)業打算和(he)某個雇(gu)員(yuan)(yuan)終止(zhi)勞動合同(tong)(tong),必須以(yi)掛號信(xin)或親手交付(fu)信(xin)件并簽收(shou)發(fa)條(tiao)的方式,通(tong)(tong)(tong)知(zhi)(zhi)雇(gu)員(yuan)(yuan)預先(xian)談話(hua)。該通(tong)(tong)(tong)知(zhi)(zhi)中應(ying)當說明談話(hua)的目的,談話(hua)的時(shi)間和(he)地點,并告知(zhi)(zhi)雇(gu)員(yuan)(yuan),在企(qi)業內部(bu)沒有(you)員(yuan)(yuan)工代表的情況下(xia),有(you)權自愿選擇一名(ming)顧問和(he)他(ta)一起參加談話(hua),同(tong)(tong)時(shi)提(ti)供(gong)顧問名(ming)單。預先(xian)談話(hua)只能在雇(gu)員(yuan)(yuan)收(shou)到通(tong)(tong)(tong)知(zhi)(zhi)5天(tian)后(hou)進行(xing)。談話(hua)過程中,企(qi)業應(ying)當向雇(gu)員(yuan)(yuan)說明其終止(zhi)勞動合同(tong)(tong)的理由,并聽取雇(gu)員(yuan)(yuan)的解釋。(2)辭退(tui)(tui)通(tong)(tong)(tong)知(zhi)(zhi)書:企(qi)業最早只能在預先(xian)談話(hua)的一天(tian)之后(hou)發(fa)出(chu)辭退(tui)(tui)通(tong)(tong)(tong)知(zhi)(zhi)書。辭退(tui)(tui)通(tong)(tong)(tong)知(zhi)(zhi)書必須以(yi)帶回執的掛號信(xin)方式發(fa)出(chu),其內容必須詳(xiang)細列明辭退(tui)(tui)的理由。

  3.違(wei)法(fa)終(zhong)止(zhi)勞(lao)動合(he)同(tong)(tong)的責任。德國解(jie)雇(gu)保護法(fa)規(gui)定(ding),雇(gu)主違(wei)法(fa)終(zhong)止(zhi)勞(lao)動合(he)同(tong)(tong),雇(gu)員(yuan)(yuan)可(ke)(ke)以在解(jie)雇(gu)后3周內向地方(fang)勞(lao)動法(fa)院訴訟(song),申(shen)請(qing)合(he)同(tong)(tong)終(zhong)止(zhi)無(wu)效(xiao)。如(ru)(ru)法(fa)院判決無(wu)效(xiao),雇(gu)員(yuan)(yuan)愿(yuan)(yuan)意(yi)回去(qu)繼續(xu)工作,雇(gu)主應該繼續(xu)安排其工作,如(ru)(ru)工人(ren)不愿(yuan)(yuan)意(yi)與(yu)雇(gu)主繼續(xu)維持勞(lao)動關系(xi),雇(gu)主應當支付適(shi)當的一次(ci)性補償金(jin)(jin)。法(fa)國規(gui)定(ding),如(ru)(ru)果(guo)企(qi)業(ye)(ye)(ye)違(wei)反法(fa)律(lv)規(gui)定(ding)的合(he)同(tong)(tong)終(zhong)止(zhi)程(cheng)序,需要(yao)重新完成程(cheng)序,并(bing)向雇(gu)員(yuan)(yuan)支付最多為一個月工資的補償金(jin)(jin),償還事業(ye)(ye)(ye)組織由此(ci)支付給雇(gu)員(yuan)(yuan)的失業(ye)(ye)(ye)救濟金(jin)(jin)(以6個月為限)。如(ru)(ru)果(guo)企(qi)業(ye)(ye)(ye)違(wei)反法(fa)律(lv)規(gui)定(ding)的終(zhong)止(zhi)理(li)由,法(fa)庭將建議恢復雇(gu)員(yuan)(yuan)工作,但企(qi)業(ye)(ye)(ye)和(he)雇(gu)員(yuan)(yuan)都(dou)可(ke)(ke)以拒絕。在此(ci)情況下,企(qi)業(ye)(ye)(ye)應支付雇(gu)員(yuan)(yuan)不低于6個月工資的補償。

  4.支(zhi)(zhi)付經濟補(bu)(bu)(bu)(bu)(bu)償(chang)(chang)(chang)(chang)(chang)金(jin)(jin)(jin)(jin)的(de)(de)(de)標準(zhun)和(he)條件。英(ying)(ying)國(guo)規(gui)定(ding)(ding)(ding)(ding)(ding)(ding):(1)如果(guo)是(shi)(shi)不(bu)當解(jie)(jie)(jie)雇(gu)(gu)(gu)(gu)(gu)(gu)的(de)(de)(de)情(qing)況,法(fa)院可(ke)判定(ding)(ding)(ding)(ding)(ding)(ding)雇(gu)(gu)(gu)(gu)(gu)(gu)主支(zhi)(zhi)付補(bu)(bu)(bu)(bu)(bu)償(chang)(chang)(chang)(chang)(chang)金(jin)(jin)(jin)(jin)。補(bu)(bu)(bu)(bu)(bu)償(chang)(chang)(chang)(chang)(chang)金(jin)(jin)(jin)(jin)分三部(bu)(bu)分:一(yi)是(shi)(shi)基(ji)本補(bu)(bu)(bu)(bu)(bu)償(chang)(chang)(chang)(chang)(chang)金(jin)(jin)(jin)(jin)。其(qi)數(shu)額(e)根據雇(gu)(gu)(gu)(gu)(gu)(gu)員(yuan)的(de)(de)(de)年齡和(he)服務期限的(de)(de)(de)不(bu)同(tong)(tong)(tong)而(er)有(you)所區別,最(zui)(zui)高(gao)可(ke)達(da)6300英(ying)(ying)鎊;二是(shi)(shi)賠償(chang)(chang)(chang)(chang)(chang)性補(bu)(bu)(bu)(bu)(bu)償(chang)(chang)(chang)(chang)(chang)金(jin)(jin)(jin)(jin)。根據雇(gu)(gu)(gu)(gu)(gu)(gu)員(yuan)所遭(zao)受(shou)的(de)(de)(de)損失確定(ding)(ding)(ding)(ding)(ding)(ding)補(bu)(bu)(bu)(bu)(bu)償(chang)(chang)(chang)(chang)(chang)的(de)(de)(de)金(jin)(jin)(jin)(jin)額(e),最(zui)(zui)高(gao)可(ke)達(da)11300英(ying)(ying)鎊;三是(shi)(shi)補(bu)(bu)(bu)(bu)(bu)充補(bu)(bu)(bu)(bu)(bu)償(chang)(chang)(chang)(chang)(chang)金(jin)(jin)(jin)(jin),如果(guo)產業法(fa)庭做出撤銷不(bu)當解(jie)(jie)(jie)雇(gu)(gu)(gu)(gu)(gu)(gu)而(er)重新雇(gu)(gu)(gu)(gu)(gu)(gu)用的(de)(de)(de)命令(ling),但雇(gu)(gu)(gu)(gu)(gu)(gu)主未(wei)執行,則雇(gu)(gu)(gu)(gu)(gu)(gu)員(yuan)可(ke)以(yi)(yi)要求補(bu)(bu)(bu)(bu)(bu)充補(bu)(bu)(bu)(bu)(bu)償(chang)(chang)(chang)(chang)(chang)金(jin)(jin)(jin)(jin)。補(bu)(bu)(bu)(bu)(bu)充補(bu)(bu)(bu)(bu)(bu)償(chang)(chang)(chang)(chang)(chang)金(jin)(jin)(jin)(jin)可(ke)按(an)(an)13至26周(zhou)的(de)(de)(de)工(gong)(gong)資(zi)標準(zhun)來支(zhi)(zhi)付;如果(guo)解(jie)(jie)(jie)雇(gu)(gu)(gu)(gu)(gu)(gu)屬(shu)于歧(qi)視性的(de)(de)(de),則補(bu)(bu)(bu)(bu)(bu)償(chang)(chang)(chang)(chang)(chang)金(jin)(jin)(jin)(jin)可(ke)按(an)(an)26至52周(zhou)工(gong)(gong)資(zi)標準(zhun)支(zhi)(zhi)付,但最(zui)(zui)高(gao)周(zhou)工(gong)(gong)資(zi)額(e)限于210英(ying)(ying)鎊。(2)定(ding)(ding)(ding)(ding)(ding)(ding)期勞(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)終止后,雇(gu)(gu)(gu)(gu)(gu)(gu)員(yuan)有(you)權(quan)得到(dao)旨(zhi)在補(bu)(bu)(bu)(bu)(bu)償(chang)(chang)(chang)(chang)(chang)其(qi)不(bu)穩定(ding)(ding)(ding)(ding)(ding)(ding)狀態的(de)(de)(de)補(bu)(bu)(bu)(bu)(bu)貼(tie)。此項(xiang)補(bu)(bu)(bu)(bu)(bu)貼(tie)依據雇(gu)(gu)(gu)(gu)(gu)(gu)員(yuan)的(de)(de)(de)報(bao)酬和(he)合(he)同(tong)(tong)(tong)期限來計算(suan)(suan),比例由集(ji)(ji)體(ti)(ti)合(he)同(tong)(tong)(tong)或集(ji)(ji)體(ti)(ti)協定(ding)(ding)(ding)(ding)(ding)(ding)確定(ding)(ding)(ding)(ding)(ding)(ding);如果(guo)無此集(ji)(ji)體(ti)(ti)合(he)同(tong)(tong)(tong)或集(ji)(ji)體(ti)(ti)協定(ding)(ding)(ding)(ding)(ding)(ding),則在征求代表(biao)性的(de)(de)(de)雇(gu)(gu)(gu)(gu)(gu)(gu)主組(zu)織(zhi)和(he)工(gong)(gong)會(hui)的(de)(de)(de)意見后,頒布(bu)法(fa)令(ling)確定(ding)(ding)(ding)(ding)(ding)(ding)(一(yi)般為勞(lao)(lao)(lao)動(dong)(dong)報(bao)酬的(de)(de)(de)6%)。此外,在合(he)同(tong)(tong)(tong)期間未(wei)能享(xiang)受(shou)帶薪休(xiu)假的(de)(de)(de)雇(gu)(gu)(gu)(gu)(gu)(gu)員(yuan),在合(he)同(tong)(tong)(tong)終止時,還(huan)可(ke)以(yi)(yi)得到(dao)帶薪休(xiu)假的(de)(de)(de)補(bu)(bu)(bu)(bu)(bu)貼(tie)(一(yi)般為全部(bu)(bu)勞(lao)(lao)(lao)動(dong)(dong)報(bao)酬的(de)(de)(de)10%)。(3)對于終止不(bu)定(ding)(ding)(ding)(ding)(ding)(ding)期勞(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong),有(you)法(fa)定(ding)(ding)(ding)(ding)(ding)(ding)的(de)(de)(de)辭(ci)退補(bu)(bu)(bu)(bu)(bu)償(chang)(chang)(chang)(chang)(chang)金(jin)(jin)(jin)(jin)和(he)約(yue)定(ding)(ding)(ding)(ding)(ding)(ding)的(de)(de)(de)辭(ci)退補(bu)(bu)(bu)(bu)(bu)償(chang)(chang)(chang)(chang)(chang)金(jin)(jin)(jin)(jin)。法(fa)定(ding)(ding)(ding)(ding)(ding)(ding)的(de)(de)(de)辭(ci)退補(bu)(bu)(bu)(bu)(bu)償(chang)(chang)(chang)(chang)(chang)金(jin)(jin)(jin)(jin)只適用于企業單方面(mian)解(jie)(jie)(jie)除合(he)同(tong)(tong)(tong)的(de)(de)(de)情(qing)況,并且雇(gu)(gu)(gu)(gu)(gu)(gu)員(yuan)沒(mei)有(you)嚴(yan)重過(guo)錯。辭(ci)退補(bu)(bu)(bu)(bu)(bu)償(chang)(chang)(chang)(chang)(chang)金(jin)(jin)(jin)(jin)以(yi)(yi)雇(gu)(gu)(gu)(gu)(gu)(gu)員(yuan)最(zui)(zui)后3個月的(de)(de)(de)平均(jun)工(gong)(gong)資(zi)為計算(suan)(suan)基(ji)數(shu)。約(yue)定(ding)(ding)(ding)(ding)(ding)(ding)的(de)(de)(de)辭(ci)退補(bu)(bu)(bu)(bu)(bu)償(chang)(chang)(chang)(chang)(chang)金(jin)(jin)(jin)(jin)規(gui)定(ding)(ding)(ding)(ding)(ding)(ding),集(ji)(ji)體(ti)(ti)合(he)同(tong)(tong)(tong)或勞(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)可(ke)以(yi)(yi)約(yue)定(ding)(ding)(ding)(ding)(ding)(ding)比法(fa)律(lv)更(geng)加有(you)利的(de)(de)(de)享(xiang)受(shou)條件,如工(gong)(gong)齡更(geng)短、數(shu)額(e)更(geng)高(gao)。甚至可(ke)規(gui)定(ding)(ding)(ding)(ding)(ding)(ding),在雇(gu)(gu)(gu)(gu)(gu)(gu)員(yuan)犯有(you)嚴(yan)重過(guo)錯的(de)(de)(de)情(qing)況下,也能享(xiang)受(shou)到(dao)辭(ci)退補(bu)(bu)(bu)(bu)(bu)償(chang)(chang)(chang)(chang)(chang)金(jin)(jin)(jin)(jin)。

  三、我國法(fa)律關于(yu)勞動合同終(zhong)止的(de)規定及存在的(de)主要問題

  (一)目前我國法律對勞動合(he)同(tong)終止的主要規定(ding)

  我國對(dui)勞(lao)(lao)動合(he)同(tong)(tong)的(de)終(zhong)止(zhi)(zhi)設(she)定(ding)(ding)了嚴(yan)格的(de)條件(jian),并且對(dui)終(zhong)止(zhi)(zhi)的(de)情形(xing)做了明確的(de)限制(zhi),根據《勞(lao)(lao)動合(he)同(tong)(tong)法實(shi)施(shi)條例(li)》第十三條的(de)規(gui)定(ding)(ding),用(yong)人(ren)單位(wei)與勞(lao)(lao)動者不得(de)在(zai)《勞(lao)(lao)動合(he)同(tong)(tong)法》第四十四條規(gui)定(ding)(ding)的(de)勞(lao)(lao)動合(he)同(tong)(tong)終(zhong)止(zhi)(zhi)情形(xing)之外約定(ding)(ding)勞(lao)(lao)動合(he)同(tong)(tong)終(zhong)止(zhi)(zhi)條件(jian)。可見,終(zhong)止(zhi)(zhi)的(de)情形(xing)是法定(ding)(ding)的(de),不允許用(yong)人(ren)單位(wei)和(he)勞(lao)(lao)動者在(zai)此(ci)之外設(she)定(ding)(ding)任何的(de)終(zhong)止(zhi)(zhi)情形(xing)。

  1.勞動合(he)同終止的6種法定情形和拓展(zhan)分析

  根據《勞(lao)動(dong)(dong)合同法(fa)》第四(si)(si)十四(si)(si)條的(de)規定,有下(xia)列情(qing)形之一的(de),勞(lao)動(dong)(dong)合同終止:①勞(lao)動(dong)(dong)合同期滿的(de)。②勞(lao)動(dong)(dong)者開(kai)始依法(fa)享(xiang)受(shou)基本養(yang)老保險待遇的(de);③勞(lao)動(dong)(dong)者死亡,或者被(bei)人(ren)(ren)民法(fa)院宣告死亡或者宣告失蹤的(de);④用人(ren)(ren)單位被(bei)依法(fa)宣告破產的(de);⑤用人(ren)(ren)單位被(bei)吊銷營(ying)業執照、責令(ling)關閉(bi)、撤銷或者用人(ren)(ren)單位決(jue)定提前解散的(de);⑥法(fa)律、行政法(fa)規規定的(de)其他情(qing)形。

  一般來講,合(he)(he)(he)(he)同(tong)(tong)是有(you)期限的(de)(de)(de)(de)(de)法律關系(xi),不(bu)可(ke)能永久存續,在(zai)出現當(dang)(dang)事人約(yue)定的(de)(de)(de)(de)(de)合(he)(he)(he)(he)同(tong)(tong)期滿或法律規(gui)定的(de)(de)(de)(de)(de)某些情形時,合(he)(he)(he)(he)同(tong)(tong)關系(xi)在(zai)客(ke)觀上將不(bu)復存在(zai),合(he)(he)(he)(he)同(tong)(tong)權利和義務(wu)歸于消(xiao)(xiao)滅,此即合(he)(he)(he)(he)同(tong)(tong)的(de)(de)(de)(de)(de)終止。需要說(shuo)明的(de)(de)(de)(de)(de)是,合(he)(he)(he)(he)同(tong)(tong)終止不(bu)僅包(bao)括履(lv)行(xing)(xing)的(de)(de)(de)(de)(de)終止,而且包(bao)括合(he)(he)(he)(he)同(tong)(tong)關系(xi)的(de)(de)(de)(de)(de)消(xiao)(xiao)滅。合(he)(he)(he)(he)同(tong)(tong)履(lv)行(xing)(xing)的(de)(de)(de)(de)(de)終止是指(zhi)當(dang)(dang)事人因該(gai)合(he)(he)(he)(he)同(tong)(tong)產(chan)生的(de)(de)(de)(de)(de)合(he)(he)(he)(he)同(tong)(tong)權利與(yu)合(he)(he)(he)(he)同(tong)(tong)義務(wu)歸于消(xiao)(xiao)滅,并面向將來消(xiao)(xiao)滅合(he)(he)(he)(he)同(tong)(tong)履(lv)行(xing)(xing)的(de)(de)(de)(de)(de)效力。然(ran)而,合(he)(he)(he)(he)同(tong)(tong)履(lv)行(xing)(xing)的(de)(de)(de)(de)(de)終止并不(bu)消(xiao)(xiao)滅當(dang)(dang)事人因此所應承擔的(de)(de)(de)(de)(de)返還財產(chan)、賠償損失等責任;合(he)(he)(he)(he)同(tong)(tong)關系(xi)的(de)(de)(de)(de)(de)消(xiao)(xiao)滅是指(zhi)當(dang)(dang)事人因該(gai)合(he)(he)(he)(he)同(tong)(tong)所產(chan)生的(de)(de)(de)(de)(de)一切權利義務(wu)關系(xi)完全不(bu)復存在(zai),當(dang)(dang)事人不(bu)再履(lv)行(xing)(xing)合(he)(he)(he)(he)同(tong)(tong)義務(wu),由合(he)(he)(he)(he)同(tong)(tong)引起的(de)(de)(de)(de)(de)債

  ④權債務(wu)關系全部溯及既往地歸于消滅。

  2.勞動(dong)合(he)同終止的若干(gan)限制條件

  因(yin)當事人主體滅失導致勞(lao)(lao)動(dong)(dong)(dong)合同(tong)(tong)(tong)無法繼續履行的(de)自然終止(zhi)(zhi)已不存在限制(zhi)終止(zhi)(zhi)的(de)前提,因(yin)此,勞(lao)(lao)動(dong)(dong)(dong)合同(tong)(tong)(tong)終止(zhi)(zhi)的(de)限制(zhi)只(zhi)能限于勞(lao)(lao)動(dong)(dong)(dong)合同(tong)(tong)(tong)期(qi)滿(man)(man)終止(zhi)(zhi)或(huo)約(yue)定(ding)終止(zhi)(zhi),這也可以看作勞(lao)(lao)動(dong)(dong)(dong)合同(tong)(tong)(tong)期(qi)滿(man)(man)終止(zhi)(zhi)的(de)例(li)外情形。

  (1)特殊(shu)情形下的續(xu)延終止

  《勞(lao)(lao)動合同法(fa)(fa)》第45條(tiao)明確(que)規(gui)(gui)定:“勞(lao)(lao)動合同期(qi)滿(man),有(you)本(ben)法(fa)(fa)第四(si)十二(er)條(tiao)規(gui)(gui)定情(qing)(qing)形(xing)之一的(de),勞(lao)(lao)動合同應(ying)當續(xu)延至相應(ying)的(de)情(qing)(qing)形(xing)消失(shi)(shi)時(shi)終(zhong)(zhong)(zhong)止(zhi)。但是,本(ben)法(fa)(fa)第四(si)十二(er)條(tiao)第二(er)項規(gui)(gui)定喪(sang)失(shi)(shi)或者部分喪(sang)失(shi)(shi)勞(lao)(lao)動能力勞(lao)(lao)動者的(de)勞(lao)(lao)動合同的(de)終(zhong)(zhong)(zhong)止(zhi),按(an)照國(guo)家有(you)關工(gong)(gong)傷(shang)保險(xian)的(de)規(gui)(gui)定執行(xing)(xing)。”也即(ji),勞(lao)(lao)動者存在(zai)(zai)以(yi)下情(qing)(qing)形(xing)的(de),勞(lao)(lao)動合同期(qi)滿(man)不得即(ji)行(xing)(xing)終(zhong)(zhong)(zhong)止(zhi),而有(you)待該情(qing)(qing)形(xing)消失(shi)(shi)時(shi)再(zai)進(jin)行(xing)(xing)終(zhong)(zhong)(zhong)止(zhi):①從事接(jie)觸(chu)職(zhi)業病危害(hai)作業的(de)勞(lao)(lao)動者未進(jin)行(xing)(xing)離崗前職(zhi)業健康檢查,或者疑似(si)職(zhi)業病病人在(zai)(zai)診斷(duan)或者醫(yi)學觀察期(qi)間(jian)的(de); ②在(zai)(zai)本(ben)單(dan)位(wei)患職(zhi)業病或者因(yin)工(gong)(gong)負傷(shang)并被確(que)認喪(sang)失(shi)(shi)或者部分喪(sang)失(shi)(shi)勞(lao)(lao)動能力的(de);③患病或者非因(yin)工(gong)(gong)負傷(shang),在(zai)(zai)規(gui)(gui)定的(de)醫(yi)療(liao)期(qi)內的(de);④女職(zhi)工(gong)(gong)在(zai)(zai)孕(yun)期(qi)、產期(qi)、哺乳期(qi)的(de);⑤在(zai)(zai)本(ben)單(dan)位(wei)連續(xu)工(gong)(gong)作滿(man)十五(wu)年,且(qie)距法(fa)(fa)定退休年齡不足五(wu)年的(de);⑥法(fa)(fa)律、行(xing)(xing)政法(fa)(fa)規(gui)(gui)規(gui)(gui)定的(de)其(qi)他情(qing)(qing)形(xing)。以(yi)上情(qing)(qing)形(xing)中(zhong),第一種情(qing)(qing)形(xing)屬于(yu)必將(jiang)消失(shi)(shi)但可能轉化(hua)的(de)情(qing)(qing)形(xing),比如最終(zhong)(zhong)(zhong)被認定為(wei)患職(zhi)業病,則應(ying)當按(an)工(gong)(gong)傷(shang)保險(xian)的(de)規(gui)(gui)定進(jin)行(xing)(xing)處理。第二(er)、三、四(si)種情(qing)(qing)

  形均屬于必(bi)將消失的(de)(de)(de)情形。第五(wu)種情形實質是要求單(dan)位在(zai)(zai)此情形下(xia)不得終止(zhi)勞動合同(tong),而是順延至勞動者(zhe)退(tui)休時才能(neng)終止(zhi)。實踐中由于男職(zhi)工(gong)在(zai)(zai)55周歲左右、女職(zhi)工(gong)在(zai)(zai)45周歲左右提(ti)供的(de)(de)(de)服務因為年(nian)(nian)齡(ling)的(de)(de)(de)關系而有(you)所下(xia)降,而這一群(qun)體(ti)又(you)以提(ti)供體(ti)力(li)勞動的(de)(de)(de)勞動者(zhe)居多,這些群(qun)體(ti)收入較少,沒有(you)多少積蓄,生活相(xiang)對(dui)困難(nan),如(ru)果再次就業(ye),很難(nan)找到合適的(de)(de)(de)工(gong)作(zuo),就必(bi)然加大政府(fu)的(de)(de)(de)壓力(li),并(bing)且如(ru)果在(zai)(zai)這個(ge)階段終止(zhi)合同(tong),顯然對(dui)勞動者(zhe)來講是不公平的(de)(de)(de)。該條規定有(you)力(li)的(de)(de)(de)保(bao)護(hu)了(le)這個(ge)年(nian)(nian)齡(ling)階段的(de)(de)(de)勞動者(zhe)的(de)(de)(de)合法權(quan)益。

  (2)向無固定(ding)期(qi)限勞動合同的轉化

o)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong)(tong)(tong)(tong)(tong)(tong)。這意(yi)(yi)味著第(di)(di)(di)二(er)次(ci)(ci)固(gu)(gu)定(ding)(ding)期(qi)(qi)限(xian)(xian)勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong)(tong)(tong)(tong)(tong)(tong)期(qi)(qi)滿(man)(man),用人(ren)(ren)單位(wei)(wei)(wei)仍然具有到期(qi)(qi)終(zhong)止(zhi)權(quan),但用人(ren)(ren)單位(wei)(wei)(wei)表(biao)(biao)示存(cun)(cun)續(xu)(xu)勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)關(guan)系的(de)(de)(de),則(ze)(ze)喪(sang)失(shi)訂立(li)何種(zhong)(zhong)勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong)(tong)(tong)(tong)(tong)(tong)的(de)(de)(de)選擇權(quan)。從文字表(biao)(biao)述(shu)看,第(di)(di)(di)(一)、(二(er))種(zhong)(zhong)情形(xing)(xing)均未(wei)有“續(xu)(xu)訂勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong)(tong)(tong)(tong)(tong)(tong)的(de)(de)(de)”的(de)(de)(de)表(biao)(biao)述(shu),而(er)第(di)(di)(di)(三(san)(san))種(zhong)(zhong)情形(xing)(xing)則(ze)(ze)專門(men)描述(shu)。根據(ju)訂立(li)勞(lao)(lao)(lao)(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong)(tong)(tong)(tong)(tong)(tong)應(ying)(ying)當遵(zun)循協商一致的(de)(de)(de)原則(ze)(ze),筆(bi)者認為應(ying)(ying)當按(an)第(di)(di)(di)二(er)種(zhong)(zhong)理解(jie)執行。

  3.勞動合同(tong)終止后經濟補償的界定和分析

  勞(lao)動(dong)法(fa)上規定的(de)“經(jing)濟補償金(jin)”這個(ge)概念(nian),是指在勞(lao)動(dong)合(he)(he)同解除或終止時,企業按照《勞(lao)動(dong)法(fa)》及其(qi)相關規章制度的(de)規定,支付給職工(gong)一(yi)定數(shu)額的(de)補償金(jin)。而(er)勞(lao)動(dong)法(fa)上對(dui)于經(jing)濟補償金(jin)的(de)規定也是依據終止勞(lao)動(dong)合(he)(he)同行為(wei)進行規定的(de)。主要分為(wei)以下(xia)幾個(ge)方面:

  (1)合同期滿終止(zhi)無需支付(fu)經濟補償(chang)的規定(ding)

  ①勞(lao)動(dong)者(zhe)不(bu)同(tong)意(yi)(yi)續(xu)簽合同(tong)。《勞(lao)動(dong)合同(tong)法(fa)(fa)》第四十六條第五款(kuan)規(gui)定:除(chu)用(yong)人(ren)單位維(wei)持或(huo)者(zhe)提高勞(lao)動(dong)合同(tong)約(yue)定條件續(xu)訂(ding)勞(lao)動(dong)合同(tong),勞(lao)動(dong)者(zhe)不(bu)同(tong)意(yi)(yi)續(xu)訂(ding)的(de)(de)情(qing)形(xing)外,依照本(ben)法(fa)(fa)第四十四條第一(yi)款(kuan)規(gui)定終止固(gu)定期限勞(lao)動(dong)合同(tong)的(de)(de),用(yong)人(ren)單位應當(dang)向勞(lao)動(dong)者(zhe)支(zhi)付經(jing)濟補償(chang)。據此,當(dang)勞(lao)動(dong)合同(tong)期滿,用(yong)人(ren)單位同(tong)意(yi)(yi)續(xu)訂(ding)勞(lao)動(dong)合同(tong),而勞(lao)動(dong)者(zhe)不(bu)同(tong)意(yi)(yi)續(xu)訂(ding)的(de)(de)情(qing)況下終止勞(lao)動(dong)合同(tong)時,用(yong)人(ren)單位不(bu)用(yong)支(zhi)付經(jing)濟補償(chang)。此規(gui)定或(huo)許是考慮(lv)到在勞(lao)動(dong)者(zhe)不(bu)愿續(xu)簽勞(lao)動(dong)合同(tong)時用(yong)人(ren)單位另行招聘(pin)員工會有一(yi)定的(de)(de)經(jing)營損(sun)失(shi)。而勞(lao)動(dong)者(zhe)可能已經(jing)有更好(hao)的(de)(de)規(gui)劃(hua)或(huo)找到了更好(hao)的(de)(de)機(ji)會,即便有損(sun)失(shi)也(ye)是勞(lao)動(dong)者(zhe)自(zi)愿選擇的(de)(de)結果,不(bu)存在支(zhi)付經(jing)濟補償(chang)的(de)(de)基礎。

  ②動者存在過錯(cuo)而期滿(man)終止合(he)同(tong)(tong)。根據《勞(lao)動合(he)同(tong)(tong)法(fa)》第三十九條的(de)(de)規定,由于勞(lao)動者有過錯(cuo),用(yong)人(ren)(ren)單(dan)位(wei)可以解除(chu)勞(lao)動合(he)同(tong)(tong)且不(bu)用(yong)支(zhi)付(fu)經(jing)濟(ji)補償(chang)金。因此,如果存在以下法(fa)定情節,勞(lao)動合(he)同(tong)(tong)期滿(man)終止,用(yong)人(ren)(ren)單(dan)位(wei)不(bu)用(yong)支(zhi)付(fu)經(jing)濟(ji)補償(chang)。主要有:一是(shi)嚴重(zhong)違反(fan)用(yong)人(ren)(ren)單(dan)位(wei)的(de)(de)規章制度的(de)(de)。二是(shi)嚴重(zhong)失職,營(ying)私舞弊,給(gei)用(yong)人(ren)(ren)單(dan)位(wei)造成重(zhong)大損害的(de)(de)。三是(shi)勞(lao)動者同(tong)(tong)時與其他用(yong)人(ren)(ren)單(dan)位(wei)建(jian)立(li)勞(lao)動關系(xi),對完成本單(dan)位(wei)的(de)(de)工作(zuo)任務(wu)造成嚴重(zhong)影響(xiang),或者經(jing)用(yong)人(ren)(ren)單(dan)位(wei)提(ti)出,拒不(bu)改正的(de)(de)。四是(shi)被依法(fa)追究刑事責任的(de)(de)。

  ③用(yong)人(ren)(ren)單(dan)(dan)位(wei)存在經(jing)營(ying)(ying)(ying)(ying)困難(nan)而期滿終(zhong)止(zhi)合(he)同(tong)。根據《勞動(dong)合(he)同(tong)法》第(di)四十一條(tiao)的規(gui)定,由于(yu)企(qi)業(ye)(ye)經(jing)營(ying)(ying)(ying)(ying)困難(nan)或生(sheng)產經(jing)營(ying)(ying)(ying)(ying)調整等(deng)需要裁(cai)減(jian)人(ren)(ren)員(yuan)(yuan)二十人(ren)(ren)以(yi)(yi)上或者裁(cai)減(jian)不足(zu)二十人(ren)(ren)但占企(qi)業(ye)(ye)職(zhi)工(gong)總數百分(fen)之十以(yi)(yi)上的,用(yong)人(ren)(ren)單(dan)(dan)位(wei)提前三十日(ri)向(xiang)工(gong)會(hui)或者全(quan)體職(zhi)工(gong)說明情(qing)況,聽取(qu)工(gong)會(hui)或者職(zhi)工(gong)的意見(jian)后(hou),裁(cai)減(jian)人(ren)(ren)員(yuan)(yuan)方案經(jing)向(xiang)勞動(dong)行政部門報告,可以(yi)(yi)裁(cai)減(jian)人(ren)(ren)員(yuan)(yuan)。依(yi)照(zhao)規(gui)定,用(yong)人(ren)(ren)單(dan)(dan)位(wei)解除(chu)勞動(dong)合(he)同(tong)并(bing)在特定情(qing)形下無需支(zhi)付經(jing)濟(ji)補償金的情(qing)節包括:一是生(sheng)產經(jing)營(ying)(ying)(ying)(ying)發(fa)生(sheng)嚴(yan)重困難(nan)的。二是企(qi)業(ye)(ye)轉(zhuan)產、重大(da)技術革新或者經(jing)營(ying)(ying)(ying)(ying)方式調整,經(jing)變更勞動(dong)合(he)同(tong)后(hou),仍需裁(cai)減(jian)人(ren)(ren)員(yuan)(yuan)的。三是其他因勞動(dong)合(he)同(tong)訂立(li)時所依(yi)據的客觀(guan)經(jing)濟(ji)情(qing)況發(fa)生(sheng)重大(da)變化,致使勞動(dong)合(he)同(tong)無法履(lv)行的。

  ④勞動(dong)(dong)合同(tong)(tong)依據法律(lv)規定(ding)期滿終止。根據《勞動(dong)(dong)合同(tong)(tong)法》第四(si)(si)十四(si)(si)條的規定(ding),勞動(dong)(dong)合同(tong)(tong)可(ke)以終

  止,如果合(he)同期(qi)滿,具有下列(lie)法定(ding)理由,亦無需支付經濟補(bu)償金:一是勞動(dong)(dong)者(zhe)開(kai)始依法享受基本養老保險待遇的(de)。二是勞動(dong)(dong)者(zhe)死亡(wang),或者(zhe)被(bei)人(ren)民法院宣告(gao)死亡(wang)或者(zhe)宣告(gao)失(shi)蹤的(de)。

  (2)需支付經濟補(bu)償(chang)金的規定(ding)

  在用(yong)(yong)人單(dan)位(wei)(wei)、勞動(dong)者(zhe)都沒(mei)有過(guo)錯(cuo)的情(qing)況(kuang)下,固(gu)定(ding)期(qi)限的勞動(dong)合(he)(he)同(tong)(tong)到(dao)期(qi)終止,出(chu)(chu)于對勞動(dong)者(zhe)的關(guan)懷(huai)和保護(hu),用(yong)(yong)人單(dan)位(wei)(wei)需要支付(fu)(fu)(fu)經(jing)(jing)濟補償金(jin)。因此(ci),除勞動(dong)者(zhe)拒(ju)絕續簽合(he)(he)同(tong)(tong)、存在嚴重(zhong)過(guo)錯(cuo)或(huo)企(qi)業經(jing)(jing)營困難等可(ke)以(yi)不支付(fu)(fu)(fu)經(jing)(jing)濟補償金(jin),違(wei)法(fa)終止合(he)(he)同(tong)(tong)需支付(fu)(fu)(fu)經(jing)(jing)濟賠(pei)償二倍(bei)標準的賠(pei)償金(jin)以(yi)及喪(sang)失(shi)勞動(dong)能力的特殊情(qing)形以(yi)外,在合(he)(he)同(tong)(tong)期(qi)限屆滿終止,用(yong)(yong)人單(dan)位(wei)(wei)都需要支付(fu)(fu)(fu)經(jing)(jing)濟補償金(jin),包括(kuo)經(jing)(jing)雙(shuang)方協商同(tong)(tong)意(yi)終止合(he)(he)同(tong)(tong)、勞動(dong)者(zhe)主動(dong)提出(chu)(chu)終止合(he)(he)同(tong)(tong)但用(yong)(yong)人單(dan)位(wei)(wei)存在《勞動(dong)合(he)(he)同(tong)(tong)法(fa)》第三十八條規定(ding)的違(wei)法(fa)情(qing)節等。

  (3)合同期滿終止的特(te)殊規定

  《勞(lao)動合同法》第四十(shi)五(wu)條規定,在(zai)本單位患職業病或(huo)者(zhe)因工負傷(shang)并(bing)被確(que)認喪失或(huo)者(zhe)部分喪失勞(lao)動能力的(de)勞(lao)動者(zhe)的(de)勞(lao)動合同的(de)終止(zhi),按照國(guo)家有(you)關工傷(shang)保險的(de)規定執行。《工傷(shang)保險條例》第三(san)十(shi)五(wu)、三(san)十(shi)六、三(san)十(shi)七條,根據勞(lao)動者(zhe)的(de)傷(shang)殘等級,分別對(dui)其應享有(you)的(de)待遇及(ji)與用人單位勞(lao)動關系的(de)處理作(zuo)出(chu)了(le)明(ming)確(que)規定。

  (二)我國(guo)法律關于勞(lao)動合(he)同終止存(cun)在的主要問題(ti)

  1.我國法(fa)律關于勞動合同終(zhong)止沒(mei)有對“農(nong)民工”這一特(te)殊(shu)群體(ti)作出專門的保護規定

  農(nong)民(min)工(gong)是我國社會(hui)的(de)一個特殊群體(ti)(ti),長期以(yi)來(lai),他們一直處在(zai)農(nong)民(min)與(yu)城(cheng)(cheng)市人的(de)邊緣化狀態。在(zai)城(cheng)(cheng)市,絕大多數農(nong)民(min)工(gong)屬(shu)于一個“游擊”群體(ti)(ti),工(gong)作(zuo)不(bu)穩定,收(shou)入(ru)微(wei)薄,住所簡(jian)陋。他們沒有城(cheng)(cheng)市戶口,不(bu)能能享受城(cheng)(cheng)市人的(de)同等(deng)待遇,他們做的(de)是最(zui)臟最(zui)累的(de)活(huo),過的(de)是最(zui)辛(xin)苦的(de)生(sheng)活(huo),但是卻難以(yi)融(rong)入(ru)城(cheng)(cheng)市人的(de)生(sheng)活(huo),處于一種生(sheng)活(huo)無保障狀態。現階段農(nong)民(min)工(gong)勞(lao)動關系中存在(zai)的(de)主要問題:

  (1)低薪、欠薪問題。盡管農(nong)民(min)工(gong)(gong)(gong)在城市極其賣命(ming)地干著累活或(huo)臟活,然而,在他(ta)們身上出現的(de)(de)低薪、欠薪問題卻(que)最為常(chang)見。農(nong)民(min)工(gong)(gong)(gong)的(de)(de)工(gong)(gong)(gong)資(zi)一(yi)般是(shi)按季、按年甚至是(shi)按活計完成(cheng)的(de)(de)階段發放的(de)(de)。在沒有(you)勞動合同保障的(de)(de)情況(kuang)下,更是(shi)出現項(xiang)目(mu)做(zuo)完了,卻(que)領不到工(gong)(gong)(gong)資(zi)的(de)(de)狀況(kuang),拖欠工(gong)(gong)(gong)資(zi)已經成(cheng)了家(jia)常(chang)便飯。一(yi)到逢年過(guo)節,各地常(chang)報道出有(you)因拖欠民(min)工(gong)(gong)(gong)血(xue)汗錢(qian)而引發群體紛(fen)爭或(huo)民(min)工(gong)(gong)(gong)跳樓、割(ge)腕等極端事件,嚴重影(ying)響社會秩序的(de)(de)穩定。

  (2)超時(shi)工(gong)(gong)作。用(yong)(yong)人(ren)單(dan)(dan)位為(wei)了延長工(gong)(gong)作時(shi)間(jian),最大限度(du)的(de)榨取農民工(gong)(gong)的(de)剩余價值,一般都采用(yong)(yong)計件工(gong)(gong)資(zi),多(duo)勞多(duo)得,所(suo)以,很(hen)多(duo)企業根本不存在(zai)八小時(shi)工(gong)(gong)作制的(de)規定,也不存在(zai)加(jia)(jia)班和加(jia)(jia)班費(fei)之說(shuo)。也就是說(shuo)農民工(gong)(gong)基本很(hen)少有休息(xi)日的(de)。高強度(du)、長時(shi)間(jian)的(de)透支體力工(gong)(gong)作,對身(shen)心(xin)的(de)損(sun)傷(shang)(shang)是顯而易見的(de),而用(yong)(yong)人(ren)單(dan)(dan)位也不可能(neng)建立有效(xiao)的(de)工(gong)(gong)傷(shang)(shang)制度(du)來保障農民工(gong)(gong)的(de)自身(shen)權(quan)利(li),這就使(shi)得大多(duo)數農民工(gong)(gong)身(shen)體長期(qi)處于(yu)亞健康狀態(tai),甚至出現(xian)嚴重的(de)職業病。

  (3)社會(hui)保(bao)障(zhang)得不(bu)到(dao)落實。因為大多數(shu)用人單位不(bu)與農民工簽(qian)訂(ding)勞動合同,就(jiu)更不(bu)用說(shuo)辦理社會(hui)保(bao)險了(le)。農民工的(de)醫(yi)療(liao)、教育等社會(hui)保(bao)障(zhang)問題十分嚴(yan)重。遇到(dao)工傷(shang),往(wang)往(wang)得不(bu)到(dao)應有的(de)賠(pei)償,甚

  ⑤至(zhi)必須的(de)治療都(dou)得不到(dao)保(bao)證(zheng),因工(gong)傷(shang)致殘、致死(si)的(de)農民工(gong)屢有發生(sheng)。至(zhi)于生(sheng)育、養老(lao)等(deng)方面(mian)的(de)保(bao)障

  就更(geng)不能奢望(wang)了(le)。

  (4)企(qi)業(ye)(ye)單方面隨意(yi)(yi)解(jie)除或終止勞動合同。部分企(qi)業(ye)(ye)再與農民工簽訂勞動合同后,出于(yu)企(qi)業(ye)(ye)發展用工的(de)需要,單方面隨意(yi)(yi)解(jie)除或者終止農民工勞動合同,由于(yu)農民工法律意(yi)(yi)識(shi)淡薄(bo),法律知識(shi)貧(pin)乏,一般選擇忍氣吞聲,導致自身(shen)權益得不到維護。

  雖(sui)然(ran)(ran)近年來,國家對農(nong)(nong)民(min)工(gong)(gong)問(wen)題(ti)越來越重(zhong)(zhong)視(shi),但是(shi)(shi)動(dong)(dong)企業隨意解除或終止農(nong)(nong)民(min)工(gong)(gong)勞動(dong)(dong)合同,侵犯農(nong)(nong)民(min)工(gong)(gong)權(quan)益的(de)(de)(de)現象仍然(ran)(ran)普遍存在,而(er)(er)目前我(wo)國勞動(dong)(dong)法(fa)律(lv)中沒有(you)對此有(you)明確的(de)(de)(de)規定。在勞動(dong)(dong)立法(fa)中對婦女和未成(cheng)年工(gong)(gong)是(shi)(shi)有(you)特殊(shu)(shu)保(bao)護(hu)規定的(de)(de)(de),而(er)(er)對婦女和未成(cheng)年工(gong)(gong)進(jin)行保(bao)護(hu)的(de)(de)(de)原因(yin)就是(shi)(shi)他(ta)們(men)有(you)其自身的(de)(de)(de)特殊(shu)(shu)性,也可以說他(ta)們(men)是(shi)(shi)弱(ruo)勢群體。同樣的(de)(de)(de)道理我(wo)們(men)當然(ran)(ran)也可以對農(nong)(nong)民(min)工(gong)(gong)這一(yi)特殊(shu)(shu)的(de)(de)(de)群體進(jin)行專門的(de)(de)(de)規定,這樣一(yi)來從法(fa)律(lv)上對農(nong)(nong)民(min)工(gong)(gong)重(zhong)(zhong)視(shi)起(qi)來農(nong)(nong)民(min)工(gong)(gong)的(de)(de)(de)權(quan)益才會得到更(geng)好的(de)(de)(de)保(bao)護(hu),因(yin)此將對農(nong)(nong)民(min)工(gong)(gong)勞動(dong)(dong)合同保(bao)護(hu)的(de)(de)(de)特殊(shu)(shu)規定寫入《勞動(dong)(dong)合同法(fa)》是(shi)(shi)非常有(you)必要的(de)(de)(de)。

  2.我國法律關于勞動合(he)同終止經濟補償差異不足分析

  (1)勞動合同終(zhong)止補償差異分析(xi)

  在用人(ren)單位(wei)、勞(lao)動者(zhe)都沒有過錯(cuo)的(de)情(qing)(qing)況下,固(gu)定期(qi)限的(de)勞(lao)動合同(tong)到期(qi)終止,出(chu)于對勞(lao)動者(zhe)的(de)關懷和(he)保(bao)護,用人(ren)單位(wei)需(xu)要(yao)支付經濟補償金。但現實操作中的(de)情(qing)(qing)形卻復雜得多,有可能出(chu)現客觀情(qing)(qing)況

  一、勞動合同法辭職的規定條款

  《中(zhong)華人(ren)民(min)共和國勞動合(he)同法》

  第(di)三十八條 用人單位(wei)有下列情形之一的,勞動者可以(yi)解(jie)除(chu)勞動合同:

  (一)未按(an)照勞(lao)動合同約定(ding)提供勞(lao)動保護或者勞(lao)動條(tiao)件(jian)的(de);

  (二)未(wei)及時足額支付勞動報酬(chou)的;

  (三)未(wei)依(yi)法為勞動者繳(jiao)納社會保險(xian)費(fei)的;

  (四)用人單位的規章制度違反(fan)法律、法規的規定,損害(hai)勞(lao)動者(zhe)權益的;

  (五)因本法(fa)第二(er)十(shi)六條第一款(kuan)規定的情形致使勞(lao)動合同(tong)無效的;

  (六)法律、行政法規規定勞(lao)動者可以解(jie)除勞(lao)動合同的其他情形(xing)。

  用(yong)人(ren)(ren)(ren)單(dan)位以暴力、威脅或者非法(fa)限制人(ren)(ren)(ren)身自由的手段強(qiang)迫勞動(dong)者勞動(dong)的,或者用(yong)人(ren)(ren)(ren)單(dan)位違章指(zhi)揮、強(qiang)令冒險作業危及勞動(dong)者人(ren)(ren)(ren)身安全的,勞動(dong)者可以立即解除勞動(dong)合同,不(bu)需事先告(gao)知用(yong)人(ren)(ren)(ren)單(dan)位。

  第九十條 勞動者(zhe)違反本法規定解除勞動合同,或者(zhe)違反勞動合同中約定的(de)保密(mi)義務或者(zhe)競(jing)業限(xian)制,給(gei)用人(ren)單位造成(cheng)損失的(de),應(ying)當承(cheng)擔賠償責任(ren)。

  二、《違反〈勞動法〉有關勞動合同規定的賠償辦法》關于辭職的規定

  第四(si)條勞動(dong)者違反規定或勞動(dong)合同的(de)約定解除勞動(dong)合同,對(dui)用(yong)人(ren)單位(wei)造成(cheng)損(sun)失的(de),勞動(dong)者應賠(pei)償用(yong)人(ren)單位(wei)下列損(sun)失:

  (一)用(yong)人單位招收錄(lu)用(yong)其所支付的費用(yong);

  (二)用人(ren)單位為其支付的培訓費用,雙方(fang)另有約(yue)定的按約(yue)定辦理;

  (三)對(dui)生產、經(jing)營(ying)和工作造(zao)成(cheng)的直接(jie)經(jing)濟損失(shi);

  勞動合同約定(ding)的其他(ta)賠(pei)償(chang)費用(yong)。

  三、《中華人民共和國勞動法》關于辭職的規定

  《中華人民共和國勞動法》第31條規定:“勞(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)解(jie)(jie)除勞(lao)(lao)(lao)(lao)動(dong)(dong)合同(tong),應(ying)當提(ti)(ti)前(qian)(qian)30日以(yi)(yi)書(shu)面形(xing)式(shi)通知用(yong)人(ren)(ren)單(dan)(dan)位”,這(zhe)就明確賦(fu)予了職工辭職的(de)權(quan)利,而且這(zhe)種權(quan)利是(shi)絕對(dui)的(de),勞(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)單(dan)(dan)方(fang)面解(jie)(jie)除勞(lao)(lao)(lao)(lao)動(dong)(dong)合同(tong)無須任何實(shi)質條(tiao)件,只需(xu)要履行提(ti)(ti)前(qian)(qian)通知的(de)義務即可(ke)。原勞(lao)(lao)(lao)(lao)動(dong)(dong)部辦(ban)公廳在《關于勞(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)解(jie)(jie)除勞(lao)(lao)(lao)(lao)動(dong)(dong)合同(tong)有關問題的(de)復函》中(zhong)也指出(chu):“勞(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)提(ti)(ti)前(qian)(qian)30日以(yi)(yi)書(shu)面形(xing)式(shi)通知用(yong)人(ren)(ren)單(dan)(dan)位,既是(shi)解(jie)(jie)除勞(lao)(lao)(lao)(lao)動(dong)(dong)合同(tong)的(de)程(cheng)序,也是(shi)解(jie)(jie)除勞(lao)(lao)(lao)(lao)動(dong)(dong)合同(tong)的(de)條(tiao)件。勞(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)提(ti)(ti)前(qian)(qian)30日以(yi)(yi)書(shu)面形(xing)式(shi)通知用(yong)人(ren)(ren)單(dan)(dan)位,解(jie)(jie)除勞(lao)(lao)(lao)(lao)動(dong)(dong)合同(tong),無須征得用(yong)人(ren)(ren)單(dan)(dan)位的(de)同(tong)意。超過30日,勞(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)向用(yong)人(ren)(ren)單(dan)(dan)位提(ti)(ti)出(chu)辦(ban)理(li)(li)解(jie)(jie)除勞(lao)(lao)(lao)(lao)動(dong)(dong)合同(tong)手(shou)續,用(yong)人(ren)(ren)單(dan)(dan)位應(ying)予以(yi)(yi)辦(ban)理(li)(li)。”

  《勞動法》一方面賦予了職工絕對的辭職權,另一方面又賦予了用人單位一定的請求賠償損失的權利。《勞動法》第102條規定:“勞動者違反本法規定的條件解除勞動合同或者違反勞動合同中約定的保密事項,對用人單位造成經濟損失的,應當依法承擔賠償責任”;原勞動部在《違反<勞動法>有(you)關勞(lao)(lao)(lao)動(dong)合同(tong)規(gui)定(ding)(ding)的(de)賠償(chang)辦法》的(de)第4條(tiao)明確規(gui)定(ding)(ding)了賠償(chang)的(de)范圍:“勞(lao)(lao)(lao)動(dong)者違(wei)反規(gui)定(ding)(ding)或勞(lao)(lao)(lao)動(dong)合同(tong)的(de)約定(ding)(ding)解除勞(lao)(lao)(lao)動(dong)合同(tong),對用(yong)人單(dan)位造(zao)成損失的(de),勞(lao)(lao)(lao)動(dong)者應賠償(chang)用(yong)人單(dan)位下列(lie)損失:

  1、用人單(dan)位招收錄用其所支付的費(fei)用;

  2、用(yong)人單位為(wei)其支付的培(pei)訓費用(yong),雙方另有約(yue)定的按(an)約(yue)定辦(ban)理;

  職工(gong)主(zhu)動(dong)提出與(yu)企業解除勞動(dong)合(he)同后(hou),部分職工(gong)在以(yi)書(shu)面通知用(yong)(yong)人單(dan)(dan)位(wei)(wei)30日后(hou)主(zhu)動(dong)離職,不理會(hui)用(yong)(yong)人單(dan)(dan)位(wei)(wei)的(de)賠償要求,用(yong)(yong)人單(dan)(dan)位(wei)(wei)則(ze)可能(neng)不給(gei)職工(gong)辦(ban)理人事關系和檔案(an)的(de)調轉手續。職工(gong)離職后(hou)人事關系和檔案(an)長期(qi)滯留在原用(yong)(yong)人單(dan)(dan)位(wei)(wei),會(hui)造成職工(gong)在新的(de)工(gong)作單(dan)(dan)位(wei)(wei)不能(neng)辦(ban)理正(zheng)常的(de)錄用(yong)(yong)手續,拿不到包(bao)括檔案(an)在內的(de)個(ge)人材料,也不能(neng)繳納勞動(dong)保險。

  在這里特別要提(ti)醒讀者的(de)是,當你合(he)同中有服務期限或保護商業秘密約(yue)定,因而有違約(yue)金的(de)約(yue)定的(de)話,雖然你提(ti)前30天仍可以辭(ci)職,但是必(bi)須(xu)按合(he)同違約(yue)金的(de)規定給予賠償(chang)。

  第二條工作內容

  第四條勞動紀律

  第七條保險福利

  2、甲方可(ke)以根據(ju)本(ben)企業的具體(ti)情(qing)況(kuang),依法制定內部(bu)職(zhi)工福利待遇實(shi)施細則(ze)。乙方有權依此享受甲方規定的福利待遇。

  第八(ba)條合同的變更(geng)

  具有下列情形之一的,雙方可以(yi)變更(geng)本合同:

  1、雙方協商同意的(de);

  2、由(you)于不可抗力或合(he)同(tong)訂立時依據的其他客觀情況發生(sheng)重大(da)變化致使本合(he)同(tong)無法履(lv)行的。本項(xiang)所稱重大(da)變化主(zhu)要(yao)指甲(jia)方調整生(sheng)產項(xiang)目,機構調整、撤并等。

  具(ju)有下列(lie)情形之一,本合同應即終止(zhi):

  第十條(tiao)合同的(de)解除(chu)

  1、甲(jia)乙雙(shuang)方協商一致可(ke)以(yi)解除本合同。

  2、乙方具有下列情形之(zhi)一(yi)的,甲方可以解(jie)除本合(he)同:

  (1)在試(shi)用期內被證明不符合錄用條件的;

  (2)嚴重違反勞動紀(ji)律或甲方依法制定的規(gui)章制度的;

  (3)嚴重失職,營私(si)舞弊(bi),給甲方利益造成(cheng)重大損害的;

  (4)《勞動合同(tong)法》第三十(shi)九條規定的其(qi)他(ta)情形。

  3、具(ju)有下列情形(xing)之一的,甲方提(ti)前三十日(ri)以(yi)書面形(xing)式通(tong)知乙(yi)方,或者額外支付乙(yi)方個月(yue)工資(zi)后,可以(yi)解除本合(he)同。

  (1)、乙方(fang)患病或者非因工(gong)(gong)負傷的,醫療期滿后(hou)不能從(cong)事原工(gong)(gong)作(zuo)也不能從(cong)事由(you)甲方(fang)另(ling)行安排的工(gong)(gong)作(zuo)的;

  (2)、乙方不能勝任工作,經甲方培訓或調整工作崗位(wei)后仍不能勝任工作的;

  (3)、雙(shuang)方不(bu)能依本合同第八條第3項的規定(ding)就變更合同達(da)成協議(yi)的;

  4、乙(yi)方具有(you)下列情(qing)形之一的,甲(jia)方不(bu)得(de)依據前款的規(gui)定解除本合同;

  (1)、患職業病或因工(gong)負(fu)傷并被勞動(dong)鑒定委員會確認喪失或部(bu)分(fen)喪失勞動(dong)能(neng)力的;

  (2)、患病(bing)或非因工負傷,在規(gui)定醫療期(qi)內的(de);
