  一、什么是勞動合同變更

  二、勞動合同變更程序:

  <1>及(ji)時向(xiang)對(dui)方提(ti)出(chu)變(bian)(bian)更勞(lao)動(dong)合(he)同的(de)要求,即(ji)提(ti)出(chu)變(bian)(bian)更勞(lao)動(dong)合(he)同的(de).主體可以是(shi)(shi)企業,也可以是(shi)(shi)職工,無論(lun)哪一方要求變(bian)(bian)更勞(lao)動(dong)合(he)同,都應當及(ji)時向(xiang)對(dui)方提(ti)出(chu)變(bian)(bian)更勞(lao)動(dong)合(he)同的(de)要求,說明變(bian)(bian)更勞(lao)動(dong)合(he)同的(de)理由(you)、內(nei)容、條件等;

  <3>雙(shuang)方達成(cheng)書面協(xie)(xie)(xie)議(yi),即當事人雙(shuang)方就變更勞(lao)動合(he)同(tong)(tong)的內(nei)容(rong)經過協(xie)(xie)(xie)商,取得一致(zhi)意見,應當達成(cheng)變更勞(lao)動合(he)同(tong)(tong)的書面協(xie)(xie)(xie)議(yi),書面協(xie)(xie)(xie)議(yi)應指(zhi)明(ming)對(dui)哪些(xie)條款作出(chu)變更,并應訂明(ming)變更后勞(lao)動合(he)同(tong)(tong)的生效(xiao)日期,書面協(xie)(xie)(xie)議(yi)經雙(shuang)方當事人簽字蓋(gai)章生效(xiao),并報企(qi)業主管部門或(huo)者上級勞(lao)動行政部門備案(an)。

  <2>企業經上(shang)級主管部門批(pi)準轉產(chan),原(yuan)來的(de)(de)組織(zhi)仍然存在,原(yuan)簽訂(ding)的(de)(de)勞動(dong)合同也仍然有效,只是由于生產(chan)方(fang)向的(de)(de)變化,原(yuan)來訂(ding)立的(de)(de)勞動(dong)合同中的(de)(de)某(mou)些條款與(yu)發展(zhan)變化的(de)(de)情況不(bu)相(xiang)適應(ying),需要(yao)作出(chu)相(xiang)應(ying)的(de)(de)修改;

  <3>上級主管機關決(jue)定(ding)(ding)改變企業的生(sheng)產(chan)任務,致使原來(lai)訂立的勞(lao)動合(he)同中有關產(chan)量(liang)、質量(liang)、生(sheng)產(chan)條件等都發生(sheng)了一定(ding)(ding)的變化,需要作出相應的修(xiu)改,否則(ze)原勞(lao)動合(he)同無法履行;

  <4>企(qi)業嚴重虧損或(huo)發生不可抗(kang)力的情況,確實無(wu)法履行勞動合同的規(gui)定;

  <5>當事人雙方協商一(yi)致,同(tong)(tong)意對勞動合同(tong)(tong)的(de)某些條款作出(chu)變更,但不得損害國家利益。

  勞動合同變更的程序是:<1>及時向對方提出變更勞動合同的要求,即提出變更勞動合同的主體可以是企業,也可以是職工,無論哪一方要求變更勞動合同,都應當及時向對方提出變更勞動合同的要求,說明變更勞動合同的理由、內容、條件等;<2>按期向對方作出答復,即當事人一方得知對方變更勞動合同的要求后,應在對方規定的期限內作出答復,不得對對方提出的變更勞動合同的要求置之不理;<3>雙方達成書面協議,即當事人雙方就變更勞動合同的內容經過協商,取得一致意見,應當達成變更勞動合同的書面協議,書面協議應指明對哪些條款作出變更,并應訂明變更后勞動合同的生效日期,書面協議經雙方當事人簽字蓋章生效,并報企業主管部門或者上級勞動行政部門備案。
