  六、合(he)同的變更、解(jie)除、終止(zhi)和續簽

  (一)合(he)同(tong)的變更

  在(zai)下列情況下,經雙方協商(shang)同意,可以變更合同:

  1、甲方根據實際工作(zuo)(zuo)需要(yao)(yao)認為(wei)有(you)必要(yao)(yao)調(diao)整(zheng)乙方工作(zuo)(zuo)崗位(wei)的。

  2、乙方根據所從事的(de)工作及(ji)自己貢獻情況認(ren)為(wei)有關條款需要變更的(de)。

  3、合同訂立時(shi)所依據的(de)法(fa)律、法(fa)規(gui)和規(gui)章政策已(yi)經修改的(de)。

  (二)合同的(de)解除

  1、乙方有下列(lie)情況(kuang)之一的,甲方可以隨時解除合(he)同:

  (1)在試用期間被證明不符合聘任條件的(de);

  (2)嚴重失職(zhi),營私(si)舞弊,對用人單位利(li)益造成重大(da)損失的;

  (3)不履(lv)行(xing)職責義(yi)務(wu),經(jing)多次教育仍(reng)無轉(zhuan)變的;

  (4)不(bu)能勝(sheng)任(ren)工作,經過(guo)培訓(xun)或調整工作崗位(wei),仍不(bu)能勝(sheng)任(ren)的;

  (5)被依(yi)法追(zhui)究刑事責任的。

  2、乙方(fang)有(you)下列(lie)情況(kuang)之一的,甲方(fang)可以解(jie)除聘任合(he)同(tong),但必須提前30天通知乙方(fang):

  (1)患病或非因更負傷,醫(yi)療(liao)期欺滿后不(bu)能從(cong)事原工作,也不(bu)能從(cong)事用人單位另(ling)行(xing)安排的適當工作的;

  (2)訂立(li)合同(tong)時所(suo)依據(ju)的客觀情況(kuang)發生重大變(bian)化(hua),致使原合同(tong)無法(fa)履行,經(jing)雙方協(xie)商不能(neng)就變(bian)更(geng)合同(tong)達成協(xie)議的。

  3、有(you)下(xia)列(lie)情形之一的,乙(yi)方(fang)可以解除合同:

  (1)甲(jia)方不履行(xing)合(he)同應承擔的(de)義務(wu)或侵害乙方合(he)法權(quan)益的(de)';

  (2)履行公民義務,批準應(ying)征入伍(wu)的。

  (三)合同終止

  1、本合同執行期滿之日,聘(pin)用合同即行終止(zhi)。

  2、合同期內,乙方因被判刑(xing)、勞動教養、開除、除名,從(cong)決定之(zhi)日起,聘(pin)任合同自行終止(zhi)。

  3、合同(tong)期內,由于不可抗力致使本合同(tong)無法(fa)履行的,合同(tong)自行終止。

  (四)合同續簽

  因(yin)工作(zuo)需要(yao),任(ren)何一方均(jun)可(ke)以在本合(he)同終(zhong)止前30天內通知對(dui)方,經另一方同意,可(ke)續簽(qian)合(he)同。

  合(he)同(tong)到(dao)期后(hou)未辦(ban)理續(xu)簽(qian)手(shou)(shou)續(xu)但事實聘(pin)任關系仍然(ran)存在的,視為續(xu)簽(qian)與原合(he)同(tong)相等期限的合(he)同(tong),可(ke)補辦(ban)續(xu)簽(qian)手(shou)(shou)續(xu)。

  七、雙方約定的其(qi)它條款(kuan)

  1、甲方對作(zuo)為優(you)秀(xiu)人才(cai)引(yin)進的乙方,根據其(qi)學(xue)歷層次、教學(xue)和科研(yan)水平,按照《陜西(xi)教育學(xue)院優(you)秀(xiu)人才(cai)引(yin)進管理暫行辦法》中的有關規定,提供(gong)相應的住房、購房補貼(tie)、安家費(fei)和科研(yan)啟動費(fei)等費(fei)用。

  2、乙(yi)(yi)方(fang)在聘期(qi)內嚴格(ge)執行合(he)同約(yue)(yue)定的(de)義務,如(ru)乙(yi)(yi)方(fang)違反約(yue)(yue)定,需向甲(jia)方(fang)退還有關(guan)費用,并按約(yue)(yue)定向甲(jia)方(fang)支付聘期(qi)年限補償費和違約(yue)(yue)金。

  八、違約責任

  十、本聘(pin)用合同期(qi)限(xian)不受法定代表人(ren)變更的限(xian)制。

  簽訂無固定期限勞(lao)動(dong)合同的相關法律條款

  一、《勞動合同法》

  第十四條 無(wu)固定期限勞(lao)動合同(tong),是指用人單位與(yu)勞(lao)動者(zhe)約定無(wu)確定終(zhong)止(zhi)時間的勞(lao)動合同(tong)。 用人單位與(yu)勞(lao)動者(zhe)協商一(yi)致(zhi),可以(yi)訂立無(wu)固定期限勞(lao)動合同(tong)。有下列情形之一(yi),勞(lao)動立無(wu)固定期限勞(lao)動合同(tong):

  (一)勞動者在該用人(ren)單位連續工(gong)作滿十年的;

  用人單(dan)位(wei)自用工之日起滿一(yi)年不與勞動(dong)者訂(ding)立(li)書面勞動(dong)合(he)同的,視(shi)為用人單(dan)位(wei)與勞動(dong)者已(yi)訂(ding)立(li)無(wu)固定期限勞動(dong)合(he)同。

  第(di)八十二條 用人單(dan)位自用工之日(ri)起超(chao)過一個月不滿一年未(wei)與(yu)勞(lao)動(dong)者訂立書面勞(lao)動(dong)合同的,應當向勞(lao)動(dong)者每月支付二倍的工資。

  第九條

  【解(jie)讀】本(ben)條是關于無固定期限勞動(dong)合(he)同的(de)規定。

  一、無固定期限勞動合同的含義

  無固定期限勞(lao)(lao)(lao)動(dong)合同,是指用人單(dan)位與勞(lao)(lao)(lao)動(dong)者約定無確定終止時(shi)間的(de)`勞(lao)(lao)(lao)動(dong)合同。

  由于缺乏對無(wu)(wu)(wu)固(gu)(gu)(gu)定(ding)期(qi)(qi)限(xian)勞(lao)(lao)動合(he)同(tong)制度的(de)(de)正確認識,不(bu)(bu)少人(ren)(ren)認為(wei)無(wu)(wu)(wu)固(gu)(gu)(gu)定(ding)期(qi)(qi)限(xian)勞(lao)(lao)動合(he)同(tong)是(shi)“鐵飯碗”、“終身制”,認為(wei)無(wu)(wu)(wu)固(gu)(gu)(gu)定(ding)期(qi)(qi)限(xian)勞(lao)(lao)動合(he)同(tong)一經簽(qian)訂就不(bu)(bu)能解除(chu)。因此,很(hen)多勞(lao)(lao)動者把無(wu)(wu)(wu)固(gu)(gu)(gu)定(ding)期(qi)(qi)限(xian)勞(lao)(lao)動合(he)同(tong)視為(wei)“護身符”,千方(fang)(fang)百計要與用人(ren)(ren)單位(wei)簽(qian)訂無(wu)(wu)(wu)固(gu)(gu)(gu)定(ding)期(qi)(qi)限(xian)勞(lao)(lao)動合(he)同(tong)。另一方(fang)(fang)面(mian),用人(ren)(ren)單位(wei)則將無(wu)(wu)(wu)固(gu)(gu)(gu)定(ding)期(qi)(qi)限(xian)勞(lao)(lao)動合(he)同(tong)看成了“終身包袱(fu)”,想方(fang)(fang)設法逃避簽(qian)訂無(wu)(wu)(wu)固(gu)(gu)(gu)定(ding)期(qi)(qi)限(xian)勞(lao)(lao)動合(he)同(tong)的(de)(de)法律(lv)義務。

  這里所說的(de)(de)無(wu)(wu)確(que)定終(zhong)止時(shi)間,是(shi)指勞(lao)動合(he)(he)同(tong)沒有(you)一(yi)個確(que)切的(de)(de)終(zhong)止時(shi)間,勞(lao)動合(he)(he)同(tong)的(de)(de)期限長短不(bu)能(neng)(neng)確(que)定,但并不(bu)是(shi)沒有(you)終(zhong)止時(shi)間。只要沒有(you)出(chu)(chu)現法(fa)律(lv)規定的(de)(de)條(tiao)件或者(zhe)雙(shuang)方(fang)約定的(de)(de)條(tiao)件,雙(shuang)方(fang)當事(shi)人就(jiu)要繼(ji)續履(lv)行勞(lao)動合(he)(he)同(tong)規定的(de)(de)義務。一(yi)旦出(chu)(chu)現了法(fa)律(lv)規定的(de)(de)情形,無(wu)(wu)固定期限勞(lao)動合(he)(he)同(tong)也同(tong)樣能(neng)(neng)夠(gou)解除。

  二、如何解除和變更無固定期限勞動合同

  無(wu)固定(ding)(ding)期限(xian)(xian)的(de)(de)(de)(de)勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)也(ye)是(shi)勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)的(de)(de)(de)(de)一(yi)(yi)(yi)種類型,在履(lv)行過程中,任何一(yi)(yi)(yi)方由于某種原因希(xi)望或(huo)已提(ti)出(chu)(chu)解(jie)(jie)除勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong),另一(yi)(yi)(yi)方只(zhi)要表示同(tong)(tong)意,雙(shuang)方達成(cheng)一(yi)(yi)(yi)致意見,就可(ke)以(yi)(yi)(yi)依據本(ben)法(fa)第(di)三十六條(tiao)(tiao)的(de)(de)(de)(de)規定(ding)(ding)解(jie)(jie)除勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)。當法(fa)律(lv)規定(ding)(ding)的(de)(de)(de)(de)可(ke)以(yi)(yi)(yi)解(jie)(jie)除勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)的(de)(de)(de)(de)條(tiao)(tiao)件(jian)(jian)出(chu)(chu)現,或(huo)當事(shi)人(ren)(ren)在合(he)(he)同(tong)(tong)中約(yue)定(ding)(ding)的(de)(de)(de)(de)可(ke)以(yi)(yi)(yi)解(jie)(jie)除勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)的(de)(de)(de)(de)條(tiao)(tiao)件(jian)(jian)出(chu)(chu)現,無(wu)固定(ding)(ding)期限(xian)(xian)的(de)(de)(de)(de)勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)就可(ke)以(yi)(yi)(yi)依法(fa)定(ding)(ding)條(tiao)(tiao)件(jian)(jian)或(huo)約(yue)定(ding)(ding)條(tiao)(tiao)件(jian)(jian)解(jie)(jie)除。如勞(lao)(lao)(lao)動(dong)(dong)者(zhe)有(you)本(ben)法(fa)第(di)三十九條(tiao)(tiao)規定(ding)(ding)的(de)(de)(de)(de)情(qing)(qing)形(xing)之一(yi)(yi)(yi)出(chu)(chu)現時,用(yong)人(ren)(ren)單(dan)位就可(ke)以(yi)(yi)(yi)解(jie)(jie)除勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)。用(yong)人(ren)(ren)單(dan)位有(you)本(ben)法(fa)第(di)三十八條(tiao)(tiao)規定(ding)(ding)的(de)(de)(de)(de)情(qing)(qing)形(xing)之一(yi)(yi)(yi)時,勞(lao)(lao)(lao)動(dong)(dong)者(zhe)就可(ke)以(yi)(yi)(yi)解(jie)(jie)除勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)。由此可(ke)見,無(wu)固定(ding)(ding)期限(xian)(xian)合(he)(he)同(tong)(tong)并(bing)不是(shi)沒有(you)終止時間(jian)的(de)(de)(de)(de)“鐵飯碗”,只(zhi)要符合(he)(he)法(fa)律(lv)規定(ding)(ding)的(de)(de)(de)(de)條(tiao)(tiao)件(jian)(jian),勞(lao)(lao)(lao)動(dong)(dong)者(zhe)與用(yong)人(ren)(ren)單(dan)位都可(ke)以(yi)(yi)(yi)依法(fa)解(jie)(jie)除勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)。

  另外,有很多錯誤觀點認為無(wu)(wu)固(gu)(gu)定期限(xian)勞(lao)(lao)動(dong)(dong)合同(tong)(tong)是不能(neng)變(bian)更(geng)的“死合同(tong)(tong)”。無(wu)(wu)固(gu)(gu)定期限(xian)勞(lao)(lao)動(dong)(dong)合同(tong)(tong)和其他類型的合同(tong)(tong)一樣,也適用勞(lao)(lao)動(dong)(dong)法(fa)(fa)與(yu)(yu)本法(fa)(fa)的協(xie)商(shang)(shang)變(bian)更(geng)原則。按(an)照勞(lao)(lao)動(dong)(dong)法(fa)(fa)的規(gui)定,用人單位與(yu)(yu)勞(lao)(lao)動(dong)(dong)者協(xie)商(shang)(shang)一致,可(ke)(ke)以變(bian)更(geng)勞(lao)(lao)動(dong)(dong)合同(tong)(tong)約定的內(nei)容(rong)。除(chu)了(le)勞(lao)(lao)動(dong)(dong)合同(tong)(tong)期限(xian)以外,雙方當事(shi)人還可(ke)(ke)以就工作內(nei)容(rong)、勞(lao)(lao)動(dong)(dong)報酬、勞(lao)(lao)動(dong)(dong)條(tiao)件和違反勞(lao)(lao)動(dong)(dong)合同(tong)(tong)的賠償責任等方面協(xie)商(shang)(shang),進(jin)行(xing)變(bian)更(geng)。在變(bian)更(geng)合同(tong)(tong)條(tiao)款時,應當按(an)照自愿、平等原則進(jin)行(xing)協(xie)商(shang)(shang),不能(neng)采取脅迫、欺詐、隱瞞事(shi)實等非法(fa)(fa)手(shou)段(duan),同(tong)(tong)時還必須(xu)注意變(bian)更(geng)后的內(nei)容(rong)不違法(fa)(fa),否則,這種變(bian)更(geng)是無(wu)(wu)效的。

  三、無固定期限勞動合同的優勢

  訂立無(wu)固定(ding)期限的(de)勞動(dong)(dong)合同(tong),勞動(dong)(dong)者可以長期在一個單位(wei)或部門工作。這(zhe)種合同(tong)適用(yong)于(yu)工作保密(mi)性(xing)強、技(ji)術復(fu)雜(za)、工作又需要保持人員穩(wen)定(ding)的(de)崗位(wei)。這(zhe)種合同(tong)對于(yu)用(yong)人單位(wei)來(lai)說,有利于(yu)維護其經濟利益,減少頻繁更換關鍵崗位(wei)的(de)關鍵人員而(er)帶(dai)來(lai)的(de)損失。對于(yu)勞動(dong)(dong)者來(lai)說,也有利于(yu)實(shi)現長期穩(wen)定(ding)職業(ye),鉆(zhan)研業(ye)務技(ji)術。

  四、無固定期限勞動合同的訂立

  訂(ding)立無固定期限勞動合(he)同有兩(liang)種情形。

  (一)用(yong)人單位(wei)與勞動者協(xie)商一致,可(ke)以訂立無固(gu)定期(qi)限(xian)勞動合同(tong)。

  根據本法規定(ding),訂(ding)立(li)勞動(dong)合(he)同應當遵循平等自愿、協商一致的(de)原(yuan)則。只要用人單位與勞動(dong)者協商一致,沒有(you)采取脅(xie)迫、欺詐、隱瞞事(shi)實等非法手段,符(fu)合(he)法律的(de)有(you)關規定(ding),就可以訂(ding)立(li)無固(gu)定(ding)期(qi)限(xian)勞動(dong)合(he)同。

  (二(er))在法律規(gui)定(ding)的情形出現時,勞動(dong)者提出或(huo)者同(tong)意續訂勞動(dong)合(he)同(tong)的,應(ying)當訂立無固定(ding)期(qi)限(xian)勞動(dong)合(he)同(tong)。

  無(wu)固定(ding)期限合(he)同(tong)一(yi)(yi)經簽(qian)(qian)訂,雙方就建立了一(yi)(yi)種相對(dui)穩(wen)固和長遠的(de)勞(lao)動(dong)關(guan)系,只要(yao)不出(chu)現法律(lv)規(gui)定(ding)的(de)條(tiao)件或(huo)者(zhe)雙方約定(ding)的(de)條(tiao)件,勞(lao)動(dong)合(he)同(tong)就不能解(jie)除。因此(ci),法律(lv)對(dui)無(wu)固定(ding)期限勞(lao)動(dong)合(he)同(tong)的(de)簽(qian)(qian)訂條(tiao)件作(zuo)了嚴格的(de)規(gui)定(ding),當(dang)事人一(yi)(yi)方并不能隨意的(de)要(yao)求簽(qian)(qian)訂或(huo)者(zhe)拒絕簽(qian)(qian)訂無(wu)固定(ding)期限勞(lao)動(dong)合(he)同(tong)。

  根據本(ben)條(tiao)(tiao)規(gui)(gui)定(ding),只(zhi)要出現了本(ben)條(tiao)(tiao)規(gui)(gui)定(ding)的(de)三種(zhong)情形(xing),在勞(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)主動(dong)(dong)(dong)(dong)提(ti)出續訂勞(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)或者(zhe)用(yong)(yong)人單位(wei)提(ti)出續訂勞(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)勞(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)同(tong)意的(de)情況下,就應當訂立無固定(ding)期限勞(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)。這種(zhong)續訂勞(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)意愿的(de)主動(dong)(dong)(dong)(dong)權掌握在勞(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)手中,無論(lun)用(yong)(yong)人單位(wei)是(shi)否同(tong)意續訂勞(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong),只(zhi)

  要勞(lao)動者提出(chu)(chu),用人(ren)單位(wei)就必須同(tong)意續(xu)訂(ding)(ding),而(er)且是訂(ding)(ding)立(li)無(wu)固定期限勞(lao)動合(he)同(tong)。如果用人(ren)單位(wei)提出(chu)(chu)續(xu)訂(ding)(ding)勞(lao)動合(he)同(tong),勞(lao)動者有權不同(tong)意。勞(lao)動者同(tong)意的,應(ying)當訂(ding)(ding)立(li)無(wu)固定期限勞(lao)動合(he)同(tong)。這三種情形如下:

  1、勞(lao)(lao)(lao)動者(zhe)已在(zai)該用(yong)人(ren)單(dan)(dan)位(wei)(wei)連續工(gong)作(zuo)(zuo)(zuo)滿(man)十年的(de)。簽訂無固定期(qi)限勞(lao)(lao)(lao)動合(he)同的(de)勞(lao)(lao)(lao)動者(zhe)必須在(zai)同一單(dan)(dan)位(wei)(wei)連續工(gong)作(zuo)(zuo)(zuo)了十年以上,是(shi)這個情形的(de)最基本的(de)內(nei)容。具(ju)體是(shi)指勞(lao)(lao)(lao)動者(zhe)與同一用(yong)人(ren)單(dan)(dan)位(wei)(wei)簽訂的(de)勞(lao)(lao)(lao)動合(he)同的(de)期(qi)限不間斷達(da)到十年。如有的(de)勞(lao)(lao)(lao)動者(zhe)在(zai)用(yong)人(ren)單(dan)(dan)位(wei)(wei)工(gong)作(zuo)(zuo)(zuo)五年后(hou),離職(zhi)到

  別的單(dan)位去工(gong)(gong)作(zuo)了(le)兩(liang)年(nian),然后又回(hui)到了(le)這(zhe)個(ge)用(yong)(yong)(yong)人(ren)(ren)(ren)單(dan)位工(gong)(gong)作(zuo)五年(nian)。雖然累計時間達到了(le)十年(nian),但是勞(lao)動合同(tong)(tong)期限有(you)(you)所間斷,不符合在“該(gai)用(yong)(yong)(yong)人(ren)(ren)(ren)單(dan)位連續工(gong)(gong)作(zuo)滿十年(nian)”的條件。勞(lao)動者工(gong)(gong)作(zuo)時間不足十年(nian)的,即使提(ti)出訂(ding)立無(wu)(wu)固定(ding)期限勞(lao)動合同(tong)(tong),用(yong)(yong)(yong)人(ren)(ren)(ren)單(dan)位也有(you)(you)權不接(jie)受。法(fa)律作(zuo)這(zhe)樣的規定(ding),主要是為了(le)維持(chi)勞(lao)動關(guan)系(xi)的穩(wen)定(ding)。如果一個(ge)勞(lao)動者在該(gai)用(yong)(yong)(yong)人(ren)(ren)(ren)單(dan)位工(gong)(gong)作(zuo)了(le)十年(nian),就能說明他(ta)已經能夠勝任這(zhe)份工(gong)(gong)作(zuo),而用(yong)(yong)(yong)人(ren)(ren)(ren)單(dan)位的這(zhe)個(ge)工(gong)(gong)作(zuo)崗位也確實需要保(bao)持(chi)人(ren)(ren)(ren)員的相對穩(wen)定(ding)。在這(zhe)種情況下(xia),如果勞(lao)動者愿意(yi),用(yong)(yong)(yong)人(ren)(ren)(ren)單(dan)位應當與勞(lao)動者訂(ding)立無(wu)(wu)固定(ding)期限勞(lao)動合同(tong)(tong),維持(chi)較長(chang)的勞(lao)動關(guan)系(xi)。

  2、用(yong)(yong)(yong)人單(dan)位(wei)(wei)初次實行勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong)制(zhi)(zhi)(zhi)(zhi)(zhi)度(du)(du)或者國(guo)(guo)(guo)有企業(ye)(ye)改(gai)(gai)(gai)制(zhi)(zhi)(zhi)(zhi)(zhi)重新訂(ding)立勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong)時,勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者在(zai)該用(yong)(yong)(yong)人單(dan)位(wei)(wei)連(lian)續工(gong)作(zuo)滿十年(nian)(nian)且距法定(ding)退休年(nian)(nian)齡不(bu)足十年(nian)(nian)的(de)(de)。勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong)制(zhi)(zhi)(zhi)(zhi)(zhi)是以簽訂(ding)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong)的(de)(de)形(xing)式,明確規定(ding)用(yong)(yong)(yong)工(gong)單(dan)位(wei)(wei)和勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者雙方的(de)(de)權力、責任、利(li)益,把用(yong)(yong)(yong)工(gong)與經濟責任制(zhi)(zhi)(zhi)(zhi)(zhi)相結合(he)(he)的(de)(de)一種新的(de)(de)用(yong)(yong)(yong)工(gong)制(zhi)(zhi)(zhi)(zhi)(zhi)度(du)(du)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong)制(zhi)(zhi)(zhi)(zhi)(zhi)度(du)(du)。1986年(nian)(nian)7月(yue),我(wo)國(guo)(guo)(guo)決(jue)定(ding)改(gai)(gai)(gai)革國(guo)(guo)(guo)營(ying)企業(ye)(ye)的(de)(de)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)用(yong)(yong)(yong)工(gong)制(zhi)(zhi)(zhi)(zhi)(zhi)度(du)(du),自1986年(nian)(nian)10月(yue)1日起,國(guo)(guo)(guo)營(ying)企業(ye)(ye)在(zai)新招收工(gong)人中普遍(bian)推行勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong)制(zhi)(zhi)(zhi)(zhi)(zhi)。隨(sui)著勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)法合(he)(he)同(tong)(tong)(tong)法的(de)(de)施行,勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong)制(zhi)(zhi)(zhi)(zhi)(zhi)度(du)(du)在(zai)各類企業(ye)(ye)當(dang)中廣泛推行。 國(guo)(guo)(guo)有企業(ye)(ye)改(gai)(gai)(gai)制(zhi)(zhi)(zhi)(zhi)(zhi)在(zai)二十世紀八十年(nian)(nian)代中期(qi)開始,在(zai)二十世紀九十年(nian)(nian)代成為國(guo)(guo)(guo)有企業(ye)(ye)改(gai)(gai)(gai)革的(de)(de)核(he)心內容,企業(ye)(ye)通過(guo)改(gai)(gai)(gai)變企業(ye)(ye)形(xing)態,改(gai)(gai)(gai)變企業(ye)(ye)股(gu)權結構,改(gai)(gai)(gai)變企業(ye)(ye)的(de)(de)基本制(zhi)(zhi)(zhi)(zhi)(zhi)度(du)(du),轉(zhuan)變為符合(he)(he)自身特點的(de)(de)企業(ye)(ye)資產組(zu)織形(xing)式。

  在(zai)推行(xing)勞(lao)動(dong)(dong)合同(tong)(tong)制度(du)前(qian),或是在(zai)國有(you)企業進(jin)行(xing)改制前(qian),用(yong)人(ren)單(dan)(dan)(dan)位的(de)(de)(de)(de)(de)有(you)些(xie)(xie)職(zhi)工(gong)(gong)已經在(zai)本單(dan)(dan)(dan)位工(gong)(gong)作了(le)很(hen)長時(shi)間。推行(xing)新的(de)(de)(de)(de)(de)制度(du)以(yi)后(hou),很(hen)多老職(zhi)工(gong)(gong)難以(yi)適應(ying)這種新型的(de)(de)(de)(de)(de)勞(lao)動(dong)(dong)關系,一旦讓其進(jin)入市(shi)場,確實存(cun)在(zai)著(zhu)競(jing)爭力弱難以(yi)適應(ying)的(de)(de)(de)(de)(de)問題,年齡的(de)(de)(de)(de)(de)局限(xian)又使其沒有(you)充足(zu)的(de)(de)(de)(de)(de)條(tiao)件來提(ti)高(gao)改進(jin),應(ying)當說這是由于(yu)歷(li)史的(de)(de)(de)(de)(de)原(yuan)因造成的(de)(de)(de)(de)(de)。他們(men)擔心(xin)的(de)(de)(de)(de)(de)不(bu)僅(jin)是能否(fou)與原(yuan)單(dan)(dan)(dan)位簽訂勞(lao)動(dong)(dong)合同(tong)(tong)的(de)(de)(de)(de)(de)問題,還存(cun)在(zai)著(zhu)雖然簽了(le)勞(lao)動(dong)(dong)合同(tong)(tong)但(dan)期限(xian)很(hen)短,在(zai)其尚未退(tui)(tui)休前(qian)合同(tong)(tong)到期卻沒有(you)用(yong)人(ren)單(dan)(dan)(dan)位再(zai)與其簽訂勞(lao)動(dong)(dong)合同(tong)(tong)的(de)(de)(de)(de)(de)問題。我(wo)們(men)在(zai)制定(ding)法(fa)律和政策(ce)的(de)(de)(de)(de)(de)同(tong)(tong)時(shi),應(ying)當考慮(lv)那些(xie)(xie)給國家和企業作出過很(hen)多貢獻的(de)(de)(de)(de)(de)老職(zhi)工(gong)(gong)的(de)(de)(de)(de)(de)利益。因此,對于(yu)已在(zai)該用(yong)人(ren)單(dan)(dan)(dan)位連續工(gong)(gong)作滿十(shi)年并且(qie)距法(fa)定(ding)退(tui)(tui)休年齡不(bu)足(zu)十(shi)年的(de)(de)(de)(de)(de)勞(lao)動(dong)(dong)者(zhe),在(zai)訂立(li)勞(lao)動(dong)(dong)合同(tong)(tong)時(shi),允許(xu)勞(lao)動(dong)(dong)者(zhe)提(ti)出簽訂無(wu)固(gu)定(ding)期限(xian)勞(lao)動(dong)(dong)合同(tong)(tong)。如果一個勞(lao)動(dong)(dong)者(zhe)以(yi)在(zai)該用(yong)人(ren)單(dan)(dan)(dan)位滿十(shi)年,但(dan)距離法(fa)定(ding)退(tui)(tui)休年齡超過十(shi)年,則不(bu)屬于(yu)本項規定(ding)的(de)(de)(de)(de)(de)情形。

  3、連續訂(ding)立二次固定期(qi)限勞動(dong)合同且勞動(dong)者(zhe)沒有本法第(di)三十(shi)九條規定的情(qing)形續訂(ding)勞動(dong)合同的。

  根據(ju)這(zhe)一(yi)項規定,在勞(lao)(lao)動(dong)(dong)者沒(mei)有(you)本法(fa)第三十九條規定的用人單位(wei)(wei)可以解除勞(lao)(lao)動(dong)(dong)合同(tong)(tong)(tong)的情形(xing)下(xia),如果(guo)用人單位(wei)(wei)與(yu)勞(lao)(lao)動(dong)(dong)者簽(qian)訂了一(yi)次(ci)固定期(qi)限勞(lao)(lao)動(dong)(dong)合同(tong)(tong)(tong),在簽(qian)訂第二次(ci)固定期(qi)限勞(lao)(lao)動(dong)(dong)合同(tong)(tong)(tong)時(shi),就意味(wei)著下(xia)一(yi)次(ci)必須簽(qian)訂無(wu)固定期(qi)限勞(lao)(lao)動(dong)(dong)合同(tong)(tong)(tong)。所以在第一(yi)次(ci)勞(lao)(lao)動(dong)(dong)合同(tong)(tong)(tong)期(qi)滿,用人單位(wei)(wei)與(yu)勞(lao)(lao)動(dong)(dong)者準備訂立第二次(ci)固定期(qi)限勞(lao)(lao)動(dong)(dong)合同(tong)(tong)(tong)時(shi),應當作出慎重考(kao)慮。

  在制定(ding)(ding)(ding)(ding)本法(fa)時(shi),這(zhe)(zhe)一(yi)項(xiang)規定(ding)(ding)(ding)(ding)引起了(le)(le)較大(da)(da)的(de)(de)(de)(de)(de)(de)爭(zheng)議。有(you)(you)一(yi)些意(yi)見認為,連續簽(qian)(qian)(qian)訂(ding)(ding)兩(liang)次(ci)(ci)(ci)固定(ding)(ding)(ding)(ding)期(qi)(qi)(qi)(qi)(qi)限(xian)的(de)(de)(de)(de)(de)(de)勞(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)(tong)(tong),有(you)(you)可能(neng)累(lei)計時(shi)間卻(que)很短(duan)(duan)。這(zhe)(zhe)一(yi)項(xiang)規定(ding)(ding)(ding)(ding)僅以簽(qian)(qian)(qian)訂(ding)(ding)固定(ding)(ding)(ding)(ding)期(qi)(qi)(qi)(qi)(qi)限(xian)勞(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)(tong)(tong)的(de)(de)(de)(de)(de)(de)次(ci)(ci)(ci)數(shu)為判斷標(biao)準,容易導(dao)致(zhi)(zhi)用(yong)(yong)人單位(wei)(wei)(wei)對一(yi)些低(di)技能(neng)、崗位(wei)(wei)(wei)專業性不強的(de)(de)(de)(de)(de)(de)勞(lao)動(dong)(dong)(dong)(dong)(dong)者采(cai)取到期(qi)(qi)(qi)(qi)(qi)不續簽(qian)(qian)(qian)的(de)(de)(de)(de)(de)(de)做法(fa),從而規避簽(qian)(qian)(qian)訂(ding)(ding)無(wu)固定(ding)(ding)(ding)(ding)期(qi)(qi)(qi)(qi)(qi)限(xian)勞(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)(tong)(tong)的(de)(de)(de)(de)(de)(de)法(fa)律義務,加(jia)重了(le)(le)勞(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)(tong)(tong)短(duan)(duan)期(qi)(qi)(qi)(qi)(qi)化的(de)(de)(de)(de)(de)(de)問(wen)題(ti)。這(zhe)(zhe)一(yi)項(xiang)之所(suo)以這(zhe)(zhe)樣設(she)計,就是(shi)為了(le)(le)解(jie)決勞(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)(tong)(tong)短(duan)(duan)期(qi)(qi)(qi)(qi)(qi)化的(de)(de)(de)(de)(de)(de)問(wen)題(ti)。根據規定(ding)(ding)(ding)(ding),用(yong)(yong)人單位(wei)(wei)(wei)在與勞(lao)動(dong)(dong)(dong)(dong)(dong)者簽(qian)(qian)(qian)訂(ding)(ding)一(yi)次(ci)(ci)(ci)固定(ding)(ding)(ding)(ding)期(qi)(qi)(qi)(qi)(qi)限(xian)勞(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)(tong)(tong)后,再次(ci)(ci)(ci)簽(qian)(qian)(qian)訂(ding)(ding)固定(ding)(ding)(ding)(ding)期(qi)(qi)(qi)(qi)(qi)限(xian)的(de)(de)(de)(de)(de)(de)勞(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)(tong)(tong)時(shi),就意(yi)味(wei)著下一(yi)次(ci)(ci)(ci)只(zhi)要勞(lao)動(dong)(dong)(dong)(dong)(dong)者提(ti)出(chu)或者同(tong)(tong)(tong)(tong)意(yi)續訂(ding)(ding)勞(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)(tong)(tong),就必(bi)須簽(qian)(qian)(qian)訂(ding)(ding)無(wu)固定(ding)(ding)(ding)(ding)期(qi)(qi)(qi)(qi)(qi)限(xian)的(de)(de)(de)(de)(de)(de)勞(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)(tong)(tong)。企(qi)業為了(le)(le)不簽(qian)(qian)(qian)訂(ding)(ding)無(wu)固定(ding)(ding)(ding)(ding)期(qi)(qi)(qi)(qi)(qi)限(xian)的(de)(de)(de)(de)(de)(de)勞(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)(tong)(tong),但又(you)能(neng)同(tong)(tong)(tong)(tong)時(shi)保(bao)持用(yong)(yong)工(gong)的(de)(de)(de)(de)(de)(de)穩定(ding)(ding)(ding)(ding)性,防止(zhi)因頻繁更(geng)換勞(lao)動(dong)(dong)(dong)(dong)(dong)力(li)而加(jia)大(da)(da)用(yong)(yong)工(gong)成本,就會延長每一(yi)次(ci)(ci)(ci)固定(ding)(ding)(ding)(ding)期(qi)(qi)(qi)(qi)(qi)限(xian)勞(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)(tong)(tong)的(de)(de)(de)(de)(de)(de)期(qi)(qi)(qi)(qi)(qi)限(xian),從而解(jie)決了(le)(le)合(he)(he)(he)同(tong)(tong)(tong)(tong)短(duan)(duan)期(qi)(qi)(qi)(qi)(qi)化的(de)(de)(de)(de)(de)(de)問(wen)題(ti)。有(you)(you)的(de)(de)(de)(de)(de)(de)意(yi)見認為,這(zhe)(zhe)一(yi)項(xiang)規定(ding)(ding)(ding)(ding)限(xian)制了(le)(le)用(yong)(yong)人單位(wei)(wei)(wei)的(de)(de)(de)(de)(de)(de)用(yong)(yong)工(gong)自主權(quan)。這(zhe)(zhe)種認識(shi)是(shi)錯誤的(de)(de)(de)(de)(de)(de)。因為勞(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)(tong)(tong)是(shi)由雙方當(dang)事人協(xie)商(shang)(shang)一(yi)致(zhi)(zhi)訂(ding)(ding)立(li)的(de)(de)(de)(de)(de)(de),勞(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)(tong)(tong)的(de)(de)(de)(de)(de)(de)期(qi)(qi)(qi)(qi)(qi)限(xian)長短(duan)(duan)、訂(ding)(ding)立(li)次(ci)(ci)(ci)數(shu)都由雙方協(xie)商(shang)(shang)一(yi)致(zhi)(zhi)確定(ding)(ding)(ding)(ding),選擇什么樣的(de)(de)(de)(de)(de)(de)勞(lao)動(dong)(dong)(dong)(dong)(dong)者的(de)(de)(de)(de)(de)(de)決定(ding)(ding)(ding)(ding)權(quan)仍掌握在企(qi)業手(shou)中(zhong)。只(zhi)不過在法(fa)律規定(ding)(ding)(ding)(ding)的(de)(de)(de)(de)(de)(de)情形(xing)出(chu)現(xian)時(shi),用(yong)(yong)人單位(wei)(wei)(wei)才必(bi)須與勞(lao)動(dong)(dong)(dong)(dong)(dong)者簽(qian)(qian)(qian)訂(ding)(ding)無(wu)固定(ding)(ding)(ding)(ding)期(qi)(qi)(qi)(qi)(qi)限(xian)勞(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)(tong)(tong)。而且這(zhe)(zhe)種勞(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)(tong)(tong)也不是(shi)“終身(shen)制”的(de)(de)(de)(de)(de)(de),在法(fa)律規定(ding)(ding)(ding)(ding)的(de)(de)(de)(de)(de)(de)條(tiao)件或是(shi)雙方協(xie)商(shang)(shang)約定(ding)(ding)(ding)(ding)的(de)(de)(de)(de)(de)(de)條(tiao)件出(chu)現(xian)時(shi),用(yong)(yong)人單位(wei)(wei)(wei)可以解(jie)除(chu)勞(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)(tong)(tong)。

  五、關于視為無固定期限勞動合同

  本法第十(shi)條規(gui)(gui)定(ding),建立(li)(li)(li)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)關系,應(ying)當訂立(li)(li)(li)書(shu)面勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)同(tong)。但在(zai)現實(shi)中(zhong)有(you)很多用人單(dan)(dan)位(wei)為了(le)逃避義務,使(shi)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)關系處于(yu)一(yi)種不明(ming)確(que)的(de)(de)(de)狀態,在(zai)發(fa)(fa)生勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)爭議的(de)(de)(de)時(shi)候(hou)也(ye)無(wu)據(ju)可查,經(jing)常有(you)不訂立(li)(li)(li)書(shu)面勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)同(tong)的(de)(de)(de)情況發(fa)(fa)生。對此,本法作(zuo)了(le)相關規(gui)(gui)定(ding)。對于(yu)已(yi)經(jing)建立(li)(li)(li)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)關系,但沒有(you)同(tong)時(shi)訂立(li)(li)(li)書(shu)面勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)同(tong)的(de)(de)(de)情況,要求用人單(dan)(dan)位(wei)與勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)應(ying)當自(zi)用工(gong)之(zhi)(zhi)日起(qi)(qi)一(yi)個月內訂立(li)(li)(li)書(shu)面勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)同(tong)。用人單(dan)(dan)位(wei)未在(zai)用工(gong)的(de)(de)(de)同(tong)時(shi)訂立(li)(li)(li)書(shu)面勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)同(tong),與勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)約定(ding)的(de)(de)(de)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)報酬(chou)不明(ming)確(que)的(de)(de)(de),新招用的(de)(de)(de)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)的(de)(de)(de)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)報酬(chou)應(ying)當按照企業的(de)(de)(de)或者(zhe)行(xing)業的(de)(de)(de)集(ji)體(ti)(ti)合(he)同(tong)規(gui)(gui)定(ding)的(de)(de)(de)標(biao)準執(zhi)行(xing);沒有(you)集(ji)體(ti)(ti)合(he)同(tong)或者(zhe)集(ji)體(ti)(ti)合(he)同(tong)未作(zuo)規(gui)(gui)定(ding)的(de)(de)(de),用人單(dan)(dan)位(wei)應(ying)當對勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)實(shi)行(xing)同(tong)工(gong)同(tong)酬(chou)。用人單(dan)(dan)位(wei)自(zi)用工(gong)之(zhi)(zhi)日起(qi)(qi)超過一(yi)個月但不滿一(yi)年未與勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)訂立(li)(li)(li)書(shu)面勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)同(tong)的(de)(de)(de),應(ying)當向勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)支付(fu)二倍的(de)(de)(de)月工(gong)資。

  根據本(ben)條規定,用(yong)人(ren)(ren)單(dan)(dan)位(wei)(wei)自用(yong)工之日起滿一年不(bu)(bu)與(yu)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)訂立(li)(li)書面(mian)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合同(tong)的(de)(de),視(shi)為(wei)用(yong)人(ren)(ren)單(dan)(dan)位(wei)(wei)與(yu)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)已(yi)訂立(li)(li)無固定期限(xian)(xian)(xian)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合同(tong)。但(dan)(dan)需(xu)要注意的(de)(de)是,雖然已(yi)經視(shi)為(wei)用(yong)人(ren)(ren)單(dan)(dan)位(wei)(wei)與(yu)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)簽(qian)訂了(le)無固定期限(xian)(xian)(xian)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合同(tong),但(dan)(dan)并不(bu)(bu)代表用(yong)人(ren)(ren)單(dan)(dan)位(wei)(wei)已(yi)經與(yu)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)簽(qian)訂了(le)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合同(tong)。實踐中很多用(yong)人(ren)(ren)單(dan)(dan)位(wei)(wei)無視(shi)法律的(de)(de)規定,仍然不(bu)(bu)與(yu)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)訂立(li)(li)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合同(tong)。對于這種情(qing)況,本(ben)法第八十一條第二(er)款(kuan)規定:“用(yong)人(ren)(ren)單(dan)(dan)位(wei)(wei)違反本(ben)法規定不(bu)(bu)與(yu)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)訂立(li)(li)無固定期限(xian)(xian)(xian)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合同(tong)的(de)(de),應當(dang)向勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)支付二(er)倍的(de)(de)月工資(zi)。”

  一、簽訂無固定期限勞動合同對企業的利弊

  好處:

  1、企(qi)業(ye)留(liu)人(ren)的一種方式,表示企(qi)業(ye)對員工的忠(zhong)誠(cheng)度和能力的肯定。

  二、簽訂無固定期限勞動合同對勞動者的利弊

  簽(qian)訂無固定(ding)期(qi)限勞動合同對(dui)于勞動者來說是一種保護,讓勞動者擁有更加穩定(ding)的工(gong)作環境,所(suo)以不存在法律(lv)意義上的風險。

  溫馨提示所有的勞動者知道如下情況:

  用人單位自用工之(zhi)(zhi)日起(qi)滿一(yi)年(nian)不與(yu)勞動者簽訂(ding)(ding)書面勞動合(he)同的,視為雙方之(zhi)(zhi)間已(yi)訂(ding)(ding)立無固定(ding)期限(xian)勞動合(he)同。

簽訂固定期限勞動合同7

  在符合簽(qian)訂無固定期(qi)限(xian)勞動合同的情形(xing)下,用人(ren)單(dan)位應當簽(qian)訂。未簽(qian)訂的則(ze)自應當簽(qian)訂之日起一(yi)年內應當按(an)月支付二倍工資。即最長可主張一(yi)年(部分地區(qu)在簽(qian)訂的時候,會給(gei)予一(yi)個月的寬限(xian)期(qi),則(ze)最長為11個月)。超過一(yi)年未簽(qian)訂的,則(ze)視為已訂立無固定期(qi)限(xian)勞動合同。

  申請勞動(dong)仲裁的(de)時效為一(yi)年(nian),從當(dang)事(shi)人知道或者應當(dang)知道其權利被(bei)侵(qin)害之(zhi)日(ri)起(qi)計(ji)算(suan)。二倍(bei)工資賠(pei)償的(de)時效自應當(dang)簽(qian)訂之(zhi)日(ri)起(qi)滿一(yi)年(nian)的(de)次(ci)日(ri)開始計(ji)算(suan)。

  法律依據:《勞動合同法》

  第(di)十四(si)條無(wu)固定期限(xian)勞(lao)動(dong)合(he)同(tong),是指用(yong)人單位與勞(lao)動(dong)者約(yue)定無(wu)確定終止時間(jian)的勞(lao)動(dong)合(he)同(tong)。

  用人單位(wei)與勞(lao)動(dong)(dong)(dong)者協商一(yi)致,可以訂(ding)立無固定期限(xian)(xian)勞(lao)動(dong)(dong)(dong)合(he)(he)同(tong)。有下列情形之(zhi)一(yi),勞(lao)動(dong)(dong)(dong)者提出或者同(tong)意(yi)續(xu)訂(ding)、訂(ding)立勞(lao)動(dong)(dong)(dong)合(he)(he)同(tong)的,除(chu)勞(lao)動(dong)(dong)(dong)者提出訂(ding)立固定期限(xian)(xian)勞(lao)動(dong)(dong)(dong)合(he)(he)同(tong)外,應當訂(ding)立無固定期限(xian)(xian)勞(lao)動(dong)(dong)(dong)合(he)(he)同(tong):

  (一)勞動者(zhe)在該用人單(dan)位連(lian)續工(gong)作滿十年的;

  (二)用人單位初次實行勞動合(he)同(tong)制度或(huo)者(zhe)國有企業(ye)改制重新訂(ding)立勞動合(he)同(tong)時,勞動者(zhe)在(zai)該用人單位連(lian)續(xu)工(gong)作滿十年且距法定(ding)退(tui)休(xiu)年齡不(bu)足十年的;

  (三(san))連續(xu)(xu)訂(ding)立二次固(gu)定期(qi)限勞動(dong)合(he)同(tong)(tong),且勞動(dong)者沒(mei)有本法(fa)第三(san)十九條(tiao)和第四(si)十條(tiao)第一(yi)項(xiang)、第二項(xiang)規定的情形,續(xu)(xu)訂(ding)勞動(dong)合(he)同(tong)(tong)的。

  用人單位自用工之日起滿一年(nian)不與勞(lao)動者(zhe)訂(ding)立(li)書面(mian)勞(lao)動合(he)同的,視(shi)為(wei)用人單位與勞(lao)動者(zhe)已訂(ding)立(li)無(wu)固定期限勞(lao)動合(he)同。

  第八十二條用(yong)人(ren)單位(wei)自用(yong)工之日起超過一個(ge)月(yue)不滿一年未與勞動者(zhe)訂立書面勞動合同的(de),應當向(xiang)勞動者(zhe)每(mei)月(yue)支付二倍的(de)工資(zi)。

  用人單位違反(fan)本法規定(ding)不與(yu)勞動者訂立無(wu)固定(ding)期限勞動合同的,自(zi)應當訂立無(wu)固定(ding)期限勞動合同之日起向勞動者每(mei)月支付(fu)二倍的工資(zi)。

  《勞動爭議調解仲裁法(fa)》

  第二十七條勞動爭議申請仲(zhong)裁的時效(xiao)期間為一年。仲(zhong)裁時效(xiao)期間從當事人(ren)知道或者(zhe)應(ying)當知道其權(quan)利被(bei)侵害之日起計算。

  前款規定的仲(zhong)裁時(shi)效,因當(dang)事人(ren)一方(fang)向(xiang)對方(fang)當(dang)事人(ren)主(zhu)張(zhang)權利(li),或(huo)(huo)者(zhe)向(xiang)有關部(bu)門請求權利(li)救濟,或(huo)(huo)者(zhe)對方(fang)當(dang)事人(ren)同意(yi)履(lv)行(xing)義務而(er)中(zhong)斷。從中(zhong)斷時(shi)起,仲(zhong)裁時(shi)效期間重新計算。

  因不可抗力或者有其他(ta)正(zheng)當理由,當事人(ren)不能在本條第一款規(gui)定的(de)(de)仲裁(cai)(cai)時效期(qi)間申請(qing)仲裁(cai)(cai)的(de)(de),仲裁(cai)(cai)時效中止。從中止時效的(de)(de)原因消除(chu)之日起,仲裁(cai)(cai)時效期(qi)間繼續計算。

  勞動(dong)(dong)(dong)關(guan)系存續(xu)期間(jian)因(yin)拖欠勞動(dong)(dong)(dong)報酬發生(sheng)爭議的(de)(de),勞動(dong)(dong)(dong)者申請仲(zhong)裁(cai)不(bu)受本條第一(yi)款規定的(de)(de)仲(zhong)裁(cai)時效期間(jian)的(de)(de)限制;但是,勞動(dong)(dong)(dong)關(guan)系終(zhong)止的(de)(de),應當自(zi)勞動(dong)(dong)(dong)關(guan)系終(zhong)止之日起一(yi)年內提出。

  簽訂(ding)無(wu)固(gu)定(ding)(ding)期限(xian)(xian)勞(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)同方面出(chu)現的(de)問題(ti)主(zhu)要有兩種:一(yi)是用(yong)(yong)人單位(wei)(wei)自用(yong)(yong)工(gong)之日起滿一(yi)年不與勞(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)訂(ding)立書面勞(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)同的(de),最(zui)終導致(zhi)“視為用(yong)(yong)人單位(wei)(wei)與勞(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)已訂(ding)立無(wu)固(gu)定(ding)(ding)期限(xian)(xian)勞(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)同”;二是在(zai)(zai)應當按照(zhao)《勞(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)同法(fa)》第14條第2款規定(ding)(ding)的(de)三(san)種應簽訂(ding)無(wu)固(gu)定(ding)(ding)期限(xian)(xian)勞(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)同的(de)情形下,由于用(yong)(yong)人單位(wei)(wei)工(gong)作疏漏,在(zai)(zai)勞(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)未提出(chu)簽訂(ding)固(gu)定(ding)(ding)期限(xian)(xian)勞(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)同的(de)情形下,簽訂(ding)了固(gu)定(ding)(ding)期限(xian)(xian)勞(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)同且已經實際履行。

  對第一(yi)(yi)種情(qing)形,《實施條(tiao)例》第7條(tiao)規定(ding):“用(yong)人單位自用(yong)工(gong)之日(ri)(ri)起(qi)滿(man)一(yi)(yi)年(nian)(nian)未與(yu)(yu)勞(lao)(lao)動(dong)(dong)者(zhe)訂立(li)書(shu)面(mian)(mian)(mian)勞(lao)(lao)動(dong)(dong)合(he)同(tong)的(de)(de),自用(yong)工(gong)之日(ri)(ri)起(qi)滿(man)一(yi)(yi)個月(yue)的(de)(de).次日(ri)(ri)至滿(man)一(yi)(yi)年(nian)(nian)的(de)(de)前一(yi)(yi)日(ri)(ri)應(ying)(ying)當(dang)依照《勞(lao)(lao)動(dong)(dong)合(he)同(tong)法》第82條(tiao)的(de)(de)規定(ding)向勞(lao)(lao)動(dong)(dong)者(zhe)每月(yue)支付兩倍(bei)的(de)(de)工(gong)資,并視(shi)為自用(yong)工(gong)之日(ri)(ri)起(qi)滿(man)一(yi)(yi)年(nian)(nian)的(de)(de)當(dang)日(ri)(ri)已經(jing)與(yu)(yu)勞(lao)(lao)動(dong)(dong)者(zhe)訂立(li)無固定(ding)期限勞(lao)(lao)動(dong)(dong)合(he)同(tong),應(ying)(ying)當(dang)立(li)即與(yu)(yu)勞(lao)(lao)動(dong)(dong)者(zhe)補訂書(shu)面(mian)(mian)(mian)勞(lao)(lao)動(dong)(dong)合(he)同(tong)。”根據這(zhe)一(yi)(yi)規定(ding),一(yi)(yi)旦出現用(yong)人單位超過一(yi)(yi)年(nian)(nian)不與(yu)(yu)勞(lao)(lao)動(dong)(dong)者(zhe)訂立(li)書(shu)面(mian)(mian)(mian)勞(lao)(lao)動(dong)(dong)合(he)同(tong)的(de)(de)情(qing)形,就視(shi)為滿(man)一(yi)(yi)年(nian)(nian)的(de)(de)當(dang)日(ri)(ri)已經(jing)與(yu)(yu)勞(lao)(lao)動(dong)(dong)者(zhe)訂立(li)無固定(ding)期限勞(lao)(lao)動(dong)(dong)合(he)同(tong),并應(ying)(ying)該(gai)支付前11個月(yue)的(de)(de)雙倍(bei)工(gong)資,且(qie)立(li)即補訂書(shu)面(mian)(mian)(mian)勞(lao)(lao)動(dong)(dong)合(he)同(tong)。

  在第二種(zhong)情形下,用(yong)(yong)人(ren)單(dan)位(wei)如果沒有(you)證據證明是由勞(lao)(lao)動(dong)者(zhe)(zhe)提出訂(ding)立(li)固定(ding)(ding)期(qi)(qi)(qi)限(xian)(xian)勞(lao)(lao)動(dong)合(he)(he)(he)同(tong)的,則適用(yong)(yong)《勞(lao)(lao)動(dong)合(he)(he)(he)同(tong)法(fa)(fa)》第82條2款規(gui)定(ding)(ding):“用(yong)(yong)人(ren)單(dan)位(wei)違反本法(fa)(fa)規(gui)定(ding)(ding)不與勞(lao)(lao)動(dong)者(zhe)(zhe)訂(ding)立(li)無固定(ding)(ding)期(qi)(qi)(qi)限(xian)(xian)勞(lao)(lao)動(dong)合(he)(he)(he)同(tong)的,自應(ying)當(dang)訂(ding)立(li)無固定(ding)(ding)期(qi)(qi)(qi)限(xian)(xian)勞(lao)(lao)動(dong)合(he)(he)(he)同(tong)之(zhi)日起向(xiang)勞(lao)(lao)動(dong)者(zhe)(zhe)每月支(zhi)付(fu)二倍的工資(zi)。”但第82條2款沒有(you)確(que)定(ding)(ding)兩倍工資(zi)的支(zhi)付(fu)期(qi)(qi)(qi)限(xian)(xian),筆者(zhe)(zhe)認為(wei),從為(wei)保護(hu)勞(lao)(lao)動(dong)者(zhe)(zhe)的合(he)(he)(he)法(fa)(fa)權益的角度(du)出發,這(zhe)個期(qi)(qi)(qi)限(xian)(xian),應(ying)從雙(shuang)方(fang)應(ying)簽無固定(ding)(ding)期(qi)(qi)(qi)限(xian)(xian)勞(lao)(lao)動(dong)合(he)(he)(he)同(tong)時(shi)(shi)起,直至雙(shuang)方(fang)將勞(lao)(lao)動(dong)合(he)(he)(he)同(tong)期(qi)(qi)(qi)限(xian)(xian)變更(geng)為(wei)無固定(ding)(ding)期(qi)(qi)(qi)限(xian)(xian)時(shi)(shi)止(zhi)。

  你(ni)(ni)20xx年1月1日開始,相當于沒有(you)簽(qian)(qian)訂合(he)同(tong),你(ni)(ni)應(ying)該(gai)及時提出勞(lao)動仲(zhong)裁(cai),現(xian)在超過(guo)了(le)一年,很可能(neng)不被承認在勞(lao)動仲(zhong)裁(cai)時限(xian)之內。未簽(qian)(qian)訂勞(lao)動合(he)同(tong),屬于單位的(de)原因,你(ni)(ni)可以要(yao)求雙倍工資,最長(chang)11個月。但(dan)是(shi)這個現(xian)在很難獲得支持了(le),國家會偏(pian)向(xiang)用(yong)工單位的(de)。

  你(ni)要明白,國家推出這一規(gui)定的目(mu)的是防止單(dan)位欺負員(yuan)工,故意(yi)損害勞動者(zhe)利(li)益。如果(guo)單(dan)位合同到期,并沒有(you)損害你(ni)的利(li)益,就算沒有(you)續簽勞動合同,國家也會(hui)容(rong)許(xu)單(dan)位改錯的。

  無(wu)固定(ding)期限勞動(dong)(dong)合(he)同的(de)立法目的(de)一樣,就是(shi)保證單位應該簽(qian)訂故(gu)意不(bu)簽(qian)訂、員(yuan)工提出仍(reng)不(bu)簽(qian)訂無(wu)固定(ding)期限勞動(dong)(dong)合(he)同的(de)行(xing)為(wei),因為(wei)這些行(xing)為(wei)對(dui)勞動(dong)(dong)者造成(cheng)了損害(hai)。如果單位并沒有主觀上的(de)故(gu)意行(xing)為(wei),國家一般會(hui)給單位一個改錯的(de)機會(hui)。

  第十四條 無固(gu)(gu)定(ding)(ding)(ding)期(qi)限(xian)勞(lao)動(dong)(dong)(dong)合同(tong)(tong),是指用(yong)人單位(wei)與(yu)勞(lao)動(dong)(dong)(dong)者(zhe)約定(ding)(ding)(ding)無確(que)定(ding)(ding)(ding)終(zhong)止(zhi)時間(jian)的(de)勞(lao)動(dong)(dong)(dong)合同(tong)(tong)。 用(yong)人單位(wei)與(yu)勞(lao)動(dong)(dong)(dong)者(zhe)協商一(yi)致,可(ke)以(yi)訂立(li)無固(gu)(gu)定(ding)(ding)(ding)期(qi)限(xian)勞(lao)動(dong)(dong)(dong)合同(tong)(tong)。有(you)下列情(qing)形之一(yi),勞(lao)動(dong)(dong)(dong)者(zhe)提出或者(zhe)同(tong)(tong)意續(xu)訂、訂立(li)勞(lao)動(dong)(dong)(dong)合同(tong)(tong)的(de),除勞(lao)動(dong)(dong)(dong)者(zhe)提出訂立(li)固(gu)(gu)定(ding)(ding)(ding)期(qi)限(xian)勞(lao)動(dong)(dong)(dong)合同(tong)(tong)外,應當訂立(li)無固(gu)(gu)定(ding)(ding)(ding)期(qi)限(xian)勞(lao)動(dong)(dong)(dong)合同(tong)(tong):

  (一)勞動(dong)者在該用人(ren)單位(wei)連續工作滿十年(nian)的;

  (二)用人單位初次實行勞動合同(tong)(tong)制(zhi)度或(huo)者(zhe)國有企業改制(zhi)重新訂立(li)勞動合同(tong)(tong)時(shi),勞動者(zhe)在該用人單位連續工作(zuo)滿十年(nian)(nian)且距法定(ding)退休年(nian)(nian)齡不足十年(nian)(nian)的(de);

  (三)連續訂(ding)(ding)立二次固定(ding)期限勞動合(he)同(tong),且勞動者(zhe)沒有本法第三十九(jiu)條(tiao)和第四十條(tiao)第一項、第二項規定(ding)的(de)(de)情形,續訂(ding)(ding)勞動合(he)同(tong)的(de)(de)。

  第三十九條 勞動者(zhe)有下列情形之一的,用人單(dan)位可(ke)以解(jie)除勞動合同(tong):

  (一)在試(shi)用(yong)期間被證明不(bu)符合錄用(yong)條件的;

  (二)嚴重違(wei)反用(yong)人單位的(de)規章制度的(de);

  (三)嚴重失職(zhi),營私舞(wu)弊,給用人單位造(zao)成重大損害(hai)的.;

  (四(si))勞(lao)動者同時與其他用人(ren)單(dan)位建立(li)勞(lao)動關系,對完成(cheng)本單(dan)位的工作任務(wu)造成(cheng)嚴重影響,或者經用人(ren)單(dan)位提出,拒不改正的;

  (五)因本法第(di)二(er)十六條第(di)一款第(di)一項規(gui)定的(de)情形致使勞動合同無效的(de);

  (六)被依法追(zhui)究刑事責(ze)任的。

  第(di)四十條(tiao) 有下列情(qing)形之一的(de),用(yong)人(ren)單位提(ti)前三十日以書(shu)面形式(shi)通(tong)知勞動(dong)者(zhe)本人(ren)或者(zhe)額外支付勞動(dong)者(zhe)一個月工(gong)資(zi)后,可(ke)以解除勞動(dong)合同:

  (一)勞動(dong)者患(huan)病或者非因工(gong)負傷,在規定的(de)(de)醫(yi)療期(qi)滿后不能從事原工(gong)作,也不能從事由用(yong)人單位另行安排的(de)(de)工(gong)作的(de)(de);

  (二)勞動者不能勝任工作(zuo),經過培訓或者調整工作(zuo)崗位(wei),仍不能勝任工作(zuo)的;

  (三(san))勞(lao)動(dong)合同訂立時所依(yi)據的客觀情況發(fa)生重大(da)變(bian)化,致使勞(lao)動(dong)合同無法履(lv)行,經用(yong)人單(dan)位與勞(lao)動(dong)者協商,未能就變(bian)更勞(lao)動(dong)合同內容達成協議(yi)的。

  1、甲方(fang)應實行每日(ri)不(bu)(bu)(bu)超(chao)(chao)過8小(xiao)時(shi)(shi)、每周工(gong)(gong)作時(shi)(shi)間(jian)不(bu)(bu)(bu)超(chao)(chao)過40小(xiao)時(shi)(shi)的工(gong)(gong)作制,因生產需要確需延長(chang)工(gong)(gong)作時(shi)(shi)間(jian)時(shi)(shi),須經(jing)乙方(fang)本人同(tong)意,并發給乙方(fang)加(jia)班(ban)工(gong)(gong)資(zi)。日(ri)加(jia)班(ban)不(bu)(bu)(bu)得(de)超(chao)(chao)過3小(xiao)時(shi)(shi),每月加(jia)班(ban)不(bu)(bu)(bu)得(de)超(chao)(chao)過36小(xiao)時(shi)(shi)。乙方(fang)如(ru)為孕期、哺乳期女工(gong)(gong),甲方(fang)不(bu)(bu)(bu)得(de)安排其加(jia)班(ban)加(jia)點。

  2、甲方(fang)依照(zhao)國家法律和(he)有關政策規(gui)定,同乙方(fang)協商(shang)確定的(de)具體(ti)工(gong)資標(biao)準和(he)工(gong)資方(fang)式(shi)以及獎金、津貼、補貼如下:_________、

  2、因第七條第2款第(2)項(xiang)和第3款規定而解除勞動(dong)合(he)(he)同(tong)的(de)(de)(de),甲方(fang)(fang)應(ying)按乙方(fang)(fang)工作每滿1年(nian)(滿半年(nian)不滿1年(nian)的(de)(de)(de)按1年(nian)計(ji)算(suan))發給(gei)乙方(fang)(fang)1個(ge)月(yue)標準(zhun)工資(zi)的(de)(de)(de)生(sheng)活(huo)補(bu)(bu)助費(fei)(fei)。同(tong)時,如合(he)(he)同(tong)期(qi)未滿,甲方(fang)(fang)應(ying)發給(gei)乙方(fang)(fang)合(he)(he)同(tong)期(qi)內的(de)(de)(de)失業補(bu)(bu)償(chang)費(fei)(fei),標準(zhun)為(wei):距合(he)(he)同(tong)期(qi)滿,每相差1年(nian)發給(gei)相當于乙方(fang)(fang)標準(zhun)工資(zi)1個(ge)月(yue)的(de)(de)(de)補(bu)(bu)償(chang)費(fei)(fei),生(sheng)活(huo)補(bu)(bu)助費(fei)(fei)、補(bu)(bu)償(chang)費(fei)(fei)分別(bie)合(he)(he)計(ji)不超過(guo)12個(ge)月(yue)乙方(fang)(fang)標準(zhun)工資(zi)。

  3、甲(jia)方(fang)參照(zhao)(國營企業職工待業保險(xian)暫行規定)向待業保險(xian)機構繳納待業保險(xian)基金,乙方(fang)待業期(qi)間(jian)可享受待業保險(xian)待遇。

  4、乙方(fang)因工負傷或患職(zhi)業(ye)(ye)病,治療(liao)期間(jian)工資照發(fa),所需醫療(liao)費用(yong)由甲方(fang)支付。醫療(liao)終結(jie),經市(縣)勞(lao)動(dong)鑒定委(wei)員(yuan)會鑒定,確認為殘(can)廢的,由甲方(fang)發(fa)給殘(can)廢金。乙方(fang)因工殘(can)廢或患職(zhi)業(ye)(ye)病死亡,由甲方(fang)發(fa)給喪(sang)(sang)葬費和供(gong)養直(zhi)系(xi)親(qin)屬撫恤費。殘(can)廢金、喪(sang)(sang)葬費和供(gong)養直(zhi)系(xi)親(qin)屬撫恤費的標準,按照有關規定執行。

  5、乙方患病(bing)或(huo)非因工負傷,甲(jia)方應按其工作時間(jian)長短給予3至6個月(yue)的醫療期。在醫療期間(jian)發給不低于(yu)本人原工資(zi)60%的病(bing)假工資(zi)。

  6、乙方為女職(zhi)工,其孕期(qi)、產假(jia)和(he)哺乳(ru)期(qi)的待遇(yu)按《女職(zhi)工勞動保護規定(ding)》及有關規定(ding)執行。

  7、按照國家法律、法規規定,甲乙(yi)雙方協商確定的假日(ri)、公休假、婚喪假、探親假是:

  第七條(tiao)合同(tong)的(de)變更、解(jie)除和終止(zhi)

  1、甲方(fang)因停產、調整生產任務,或者由(you)于情況變(bian)化,經甲乙雙(shuang)方(fang)協商同意,可(ke)以(yi)變(bian)更合(he)同的相關(guan)內(nei)容(rong)。

  2、在下列情況下,甲方可以解除合(he)同:

  (1)乙(yi)方在試用(yong)期內,經發現不符合用(yong)工條(tiao)件的;

  (2)乙方(fang)患(huan)病或非因工(gong)(gong)(gong)負傷(shang),醫療期(qi)滿后不(bu)能從事(shi)原(yuan)工(gong)(gong)(gong)作也不(bu)能從事(shi)甲方(fang)另行安排的工(gong)(gong)(gong)作的;

  (3)甲方歇業,宣(xuan)告破產,或(huo)者(zhe)瀕臨破產處于法定整頓期間的(de);

  (4)雙方約定(ding)的其他(ta)事項:____________、

  3、下列情況下,乙方可以解除合同:

  (1)甲(jia)方(fang)違反(fan)國家規定,無安(an)全防(fang)護設施,勞動安(an)全、衛生條件(jian)惡劣,嚴重危害乙方(fang)身體(ti)健康的;

  (2)甲(jia)方無力(li)或不按照合同規定(ding)支付乙(yi)方勞動報酬(chou)的;

  (4)乙方(fang)本人有正當理由要(yao)求辭職的(de)。

  4、乙方被勞(lao)動教養,以及受刑事(shi)處分的(de),合同自行解除(chu)。

  5、甲乙雙方任何(he)一(yi)方解(jie)除(chu)合同,應當提(ti)前(qian)30天通知對方,并辦理解(jie)除(chu)合同的(de)手續。試用期(qi)內(nei)應解(jie)除(chu)合同的(de),不需要提(ti)前(qian)通知對方。

  6、在下列情況下,甲方不(bu)得解(jie)除乙方合同:

  (1)合(he)(he)同期未滿,又不符合(he)(he)本條第2款(kuan)規定的;

  (2)乙方患有職業(ye)病或因工負傷(shang)并(bing)經勞動鑒定委員會確(que)認的;

  (3)乙方患病或非因工負傷,在(zai)規定的醫(yi)療期內的;

  (4)乙方在孕期、產假和(he)哺(bu)乳期間的(de)。

  7、合同期限屆滿,應即(ji)終止(zhi)執(zhi)行(xing)。由于生(sheng)產、工作需要,經甲乙雙方協(xie)商同意,可(ke)以續訂合同。

  第八(ba)條雙(shuang)方認為需要約定的事項

  1、甲方為(wei)乙方提供住房或住房補(bu)貼;

  2、甲方為乙方解決伙食問(wen)題;

  3、甲方按國家規定的(de)補貼(tie)項(xiang)目,每月應(ying)發給乙方共計___元;

  第九條違反勞(lao)動(dong)合同應承(cheng)擔的(de)違約責任

  1、由(you)于(yu)甲(jia)乙雙方(fang)任何(he)一方(fang)的過(guo)錯造成合(he)同不能履行(xing)或者不能完(wan)全履行(xing),由(you)有過(guo)錯的一方(fang)承擔法律責任;如(ru)屬雙方(fang)過(guo)錯,由(you)雙方(fang)分別承擔各自應負的法律責任;

  2、因不可抗力(li)造(zao)成不能(neng)履行合同(tong)或者一方受損(sun)害的,可不承擔法(fa)律責任(ren);

  3、甲乙雙方任何一方違反合同時,應向對方支付違約金,違約金標準(zhun)是:_________、

  第(di)十一條(tiao)本(ben)合同未(wei)盡事(shi)宜(yi)或條(tiao)款與(yu)法律、法規、政策等有(you)抵觸(chu)的(de)(de),按國家現行的(de)(de)法律、法規、政策執行。

  第十二(er)條本合同自(zi)簽(qian)訂之日起生效(xiao),一式兩份,甲乙雙方各持一份。本合同涂改、未經合法授權代簽(qian)無效(xiao)。

  勞(lao)動(dong)(dong)合同(tong)法對無固定(ding)(ding)(ding)期(qi)限勞(lao)動(dong)(dong)合同(tong)的(de)新規定(ding)(ding)(ding),其立法本義(yi)就是(shi)為了穩定(ding)(ding)(ding)勞(lao)動(dong)(dong)關系,將“不定(ding)(ding)(ding)期(qi)勞(lao)動(dong)(dong)合同(tong)確定(ding)(ding)(ding)為勞(lao)動(dong)(dong)合同(tong)的(de)主(zhu)要形式,限制定(ding)(ding)(ding)期(qi)勞(lao)動(dong)(dong)合同(tong)的(de)使用,并降低(di)定(ding)(ding)(ding)期(qi)勞(lao)動(dong)(dong)合同(tong)轉(zhuan)為不定(ding)(ding)(ding)期(qi)勞(lao)動(dong)(dong)合同(tong)的(de)條件”。

  在(zai)勞(lao)(lao)(lao)(lao)動合(he)(he)(he)同(tong)(tong)(tong)法(fa)(草案(an))起草和修(xiu)改過程中,全國(guo)(guo)人(ren)大常(chang)委(wei)會勞(lao)(lao)(lao)(lao)動法(fa)執(zhi)法(fa)檢查組(zu)對(dui)(dui)各地用工市(shi)場的(de)調查表明:有60%以上的(de)用人(ren)單位(wei)與(yu)員工簽(qian)(qian)訂的(de)勞(lao)(lao)(lao)(lao)動合(he)(he)(he)同(tong)(tong)(tong)是短(duan)期(qi)(qi)合(he)(he)(he)同(tong)(tong)(tong),合(he)(he)(he)同(tong)(tong)(tong)期(qi)(qi)限(xian)(xian)大都在(zai)1年(nian)之內(nei)。針對(dui)(dui)我國(guo)(guo)目(mu)前呈(cheng)現(xian)勞(lao)(lao)(lao)(lao)動合(he)(he)(he)同(tong)(tong)(tong)短(duan)期(qi)(qi)化的(de)現(xian)狀,勞(lao)(lao)(lao)(lao)動合(he)(he)(he)同(tong)(tong)(tong)法(fa)對(dui)(dui)無固定期(qi)(qi)限(xian)(xian)勞(lao)(lao)(lao)(lao)動合(he)(he)(he)同(tong)(tong)(tong)的(de)規定有利于引導用人(ren)單位(wei)與(yu)勞(lao)(lao)(lao)(lao)動者(zhe)簽(qian)(qian)訂長(chang)期(qi)(qi)的(de)勞(lao)(lao)(lao)(lao)動合(he)(he)(he)同(tong)(tong)(tong),改變我國(guo)(guo)勞(lao)(lao)(lao)(lao)動合(he)(he)(he)同(tong)(tong)(tong)短(duan)期(qi)(qi)化的(de)局面(mian)。另外勞(lao)(lao)(lao)(lao)動合(he)(he)(he)同(tong)(tong)(tong)法(fa)對(dui)(dui)不簽(qian)(qian)訂勞(lao)(lao)(lao)(lao)動合(he)(he)(he)同(tong)(tong)(tong),及不簽(qian)(qian)訂無固定期(qi)(qi)限(xian)(xian)勞(lao)(lao)(lao)(lao)動合(he)(he)(he)同(tong)(tong)(tong)規定了較(jiao)高的(de)違(wei)法(fa)成本,這將使(shi)用人(ren)單位(wei)自覺守法(fa)。

  勞(lao)動合(he)同法構筑無固定期(qi)限勞(lao)動合(he)同為(wei)勞(lao)動合(he)同的(de)(de).主(zhu)要形式(shi),向勞(lao)動者傾斜的(de)(de)立法意圖顯(xian)而易見,但是(shi)對于無固定期(qi)限勞(lao)動合(he)同的(de)(de)理解(jie),有(you)許多用(yong)人(ren)單位(wei)(wei)認為(wei)無固定期(qi)限勞(lao)動合(he)同意味(wei)著固定工(gong),意味(wei)著重拾(shi)鐵飯碗,它將使用(yong)人(ren)單位(wei)(wei)的(de)(de)負擔加重,并(bing)影響(xiang)用(yong)人(ren)單位(wei)(wei)的(de)(de)用(yong)人(ren)自主(zhu)權。

  一、簽訂無固定期限勞動合同的情形概述

  根據(ju)《勞(lao)動合同法》和《勞(lao)動合同實施條(tiao)例》規(gui)定,員工(gong)在滿足(zu)法律規(gui)定的(de)情(qing)況下,用人單位應該(gai)與之簽訂(ding)無固定期(qi)限勞(lao)動合同:

  (1)勞動者(zhe)在(zai)該用人單位連續(xu)工作滿(man)十年的;

  (2)用人(ren)單位(wei)初次實(shi)行勞(lao)動合同制(zhi)度或(huo)者國有企(qi)業(ye)改制(zhi)重新訂立勞(lao)動合同時,勞(lao)動者在該用人(ren)單位(wei)連續工(gong)作(zuo)滿(man)十(shi)年且距(ju)法定(ding)退(tui)休年齡不足十(shi)年的;

  (3)連續訂(ding)立(li)二次固定期限(xian)勞動(dong)合同,且勞動(dong)者沒(mei)有本法(fa)第三十(shi)九條和第四十(shi)條第一項、第二項規定的情形(xing),續訂(ding)勞動(dong)合同的;

  (4)用人單位自用工之(zhi)日(ri)起滿一年不與勞(lao)動(dong)者訂(ding)立(li)書面勞(lao)動(dong)合同的,視為用人單位與勞(lao)動(dong)者已訂(ding)立(li)無固定期限勞(lao)動(dong)合同。

  上(shang)述第(di)(1)項(xiang),勞(lao)動(dong)(dong)者在(zai)一家用人單位連續工(gong)作滿十年(nian)的,這(zhe)里(li)的十年(nian)期限(xian)包含(han)勞(lao)動(dong)(dong)合同法(fa)實施之前的工(gong)作年(nian)限(xian),而且非因(yin)勞(lao)動(dong)(dong)者本人原因(yin)發生調動(dong)(dong)的,期限(xian)合并計(ji)算。

  第(di)(2)項是(shi)與國企改(gai)制(zhi)對接(jie)而定,保護一部分(fen)國企老職(zhi)工的(de)同時為國企減(jian)負。

  而根據勞動(dong)合同法實施條(tiao)例中的規定(ding),員工(gong)達(da)到連續工(gong)作滿十年或者連續訂立二次(ci)固定(ding)期(qi)限(xian)勞動(dong)合同的條(tiao)件(jian)后,還(huan)需要(yao)表示出(chu)簽訂無固定(ding)期(qi)限(xian)勞動(dong)合同的意思,在這一點上(shang),勞動(dong)合同法和(he)勞動(dong)合同法實施條(tiao)例有所區別(bie)。

  從立法的(de)(de)層(ceng)次上(shang)來說(shuo),勞(lao)(lao)(lao)(lao)動(dong)(dong)合同法的(de)(de)效力顯然要高于其實施條例,應以勞(lao)(lao)(lao)(lao)動(dong)(dong)合同法為(wei)準,只(zhi)要勞(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)滿足簽(qian)訂(ding)(ding)(ding)無(wu)固(gu)(gu)定(ding)期(qi)限(xian)(xian)勞(lao)(lao)(lao)(lao)動(dong)(dong)合同的(de)(de)條件,除非勞(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)明確表示(shi)要求簽(qian)訂(ding)(ding)(ding)固(gu)(gu)定(ding)期(qi)限(xian)(xian)勞(lao)(lao)(lao)(lao)動(dong)(dong)合同,否則就(jiu)要簽(qian)訂(ding)(ding)(ding)無(wu)固(gu)(gu)定(ding)期(qi)限(xian)(xian)勞(lao)(lao)(lao)(lao)動(dong)(dong)合同。但實踐中,有解決此問題的(de)(de)辦法。因為(wei)勞(lao)(lao)(lao)(lao)動(dong)(dong)合同法還規定(ding),遇到這(zhe)些情形時“除勞(lao)(lao)(lao)(lao)動(dong)(dong)者(zhe)提出訂(ding)(ding)(ding)立固(gu)(gu)定(ding)期(qi)限(xian)(xian)勞(lao)(lao)(lao)(lao)動(dong)(dong)合同外,應當(dang)訂(ding)(ding)(ding)立無(wu)固(gu)(gu)定(ding)期(qi)限(xian)(xian)勞(lao)(lao)(lao)(lao)動(dong)(dong)合同”,也就(jiu)是說(shuo)用人單(dan)位可在勞(lao)(lao)(lao)(lao)動(dong)(dong)合同中增加一條:員(yuan)工要求與公(gong)司訂(ding)(ding)(ding)立固(gu)(gu)定(ding)期(qi)限(xian)(xian)的(de)(de)勞(lao)(lao)(lao)(lao)動(dong)(dong)合同。

  第(di)(4)項(xiang)用人(ren)單位如果20xx年1月1日(ri)起用工時間(jian)超過(guo)一年且(qie)沒有簽訂書面(mian)勞動(dong)合同(tong),法律直接規定(ding)雙方已經存在無固定(ding)期限勞動(dong)合同(tong)。

  二、如何避免無固定期限勞動合同

  無固(gu)定(ding)期(qi)限勞(lao)動(dong)(dong)合同(tong)不是洪水猛獸,在某些(xie)情形下也(ye)是可以(yi)予以(yi)解(jie)除(chu)的。但是,一旦(dan)員(yuan)(yuan)工(gong)(gong)簽(qian)(qian)訂了(le)無固(gu)定(ding)期(qi)限勞(lao)動(dong)(dong)合同(tong),他/她可能(neng)(neng)自己也(ye)理(li)解(jie)為(wei)(wei)終身合同(tong),員(yuan)(yuan)工(gong)(gong)的這種心態可能(neng)(neng)對企業(ye)經營(ying)管理(li)和員(yuan)(yuan)工(gong)(gong)的工(gong)(gong)作積極性有著很(hen)大的負面影響。一旦(dan)簽(qian)(qian)訂或被(bei)視(shi)為(wei)(wei)無固(gu)定(ding)期(qi)限勞(lao)動(dong)(dong)合同(tong),因其沒有到期(qi)時間,不能(neng)(neng)到期(qi)自動(dong)(dong)終止(zhi),用(yong)人(ren)(ren)單位(wei)如(ru)果沒有合法(fa)的理(li)由而解(jie)除(chu)無固(gu)定(ding)期(qi)限的勞(lao)動(dong)(dong)合同(tong),往往會被(bei)認定(ding)為(wei)(wei)違(wei)法(fa)辭退。所以(yi),用(yong)人(ren)(ren)單位(wei)如(ru)果可以(yi)不簽(qian)(qian),應(ying)當在現有法(fa)律框架下盡量避免無固(gu)定(ding)期(qi)限勞(lao)動(dong)(dong)合同(tong)。

  1、簽訂較(jiao)長或合適期限的固(gu)定期限勞動合同(tong)

  二(er)、《勞(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)法(fa)(fa)》則(ze)擴(kuo)展了簽訂無(wu)固定期限(xian)合(he)(he)同(tong)(tong)的條件。該法(fa)(fa)第(di)14條第(di)2款規定:有下列(lie)情(qing)形之(zhi)一(yi),勞(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)提(ti)出(chu)或者(zhe)同(tong)(tong)意(yi)續(xu)(xu)訂、訂立(li)勞(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)的.,除勞(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)提(ti)出(chu)訂立(li)固定期限(xian)勞(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)外,應當訂立(li)無(wu)固定期限(xian)勞(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong):(1)勞(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)在該用(yong)人單(dan)(dan)位連續(xu)(xu)工作(zuo)滿10年(nian)的;(2)用(yong)人單(dan)(dan)位初次實行勞(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)制(zhi)度或者(zhe)國有企業改制(zhi)重(zhong)新訂立(li)勞(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)時,勞(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)在該用(yong)人單(dan)(dan)位連續(xu)(xu)工作(zuo)滿10年(nian)且距法(fa)(fa)定退休年(nian)齡不足10年(nian)的;(3)連續(xu)(xu)訂立(li)二(er)次固定期限(xian)勞(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong),且勞(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)沒有本法(fa)(fa)第(di)39條和(he)第(di)40條第(di)1項、第(di)2項規定的解除合(he)(he)同(tong)(tong)之(zhi)情(qing)形,續(xu)(xu)訂勞(lao)動(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)的。

  三(san)、乍一(yi)看,你的(de)(de)(de)情況(kuang)似乎(hu)符合(he)上述第(di)3項之規(gui)定,但實際上是不行的(de)(de)(de),因為目前(qian)適用該(gai)項規(gui)定有個合(he)同(tong)(tong)簽(qian)訂(ding)(ding)“次數(shu)”的(de)(de)(de)起(qi)算(suan)點(dian)問題(ti)。《勞(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)法(fa)》第(di)91條第(di)1款(kuan)規(gui)定:“本法(fa)第(di)14條第(di)2款(kuan)第(di)3項規(gui)定連(lian)續(xu)訂(ding)(ding)立(li)(li)固(gu)(gu)定期(qi)限勞(lao)動(dong)(dong)(dong)的(de)(de)(de)次數(shu),自本法(fa)施行后續(xu)訂(ding)(ding)固(gu)(gu)定期(qi)限勞(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)時開始計算(suan)。”由于該(gai)法(fa)自20xx年(nian)1月1日起(qi)實施,所(suo)以(yi)(yi)關于“連(lian)續(xu)訂(ding)(ding)立(li)(li)二(er)次固(gu)(gu)定期(qi)限勞(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)”的(de)(de)(de)次數(shu)應當自20xx年(nian)1月1日后開始計算(suan)。就你的(de)(de)(de)情況(kuang)而言(yan),你之前(qian)的(de)(de)(de)兩份合(he)同(tong)(tong)是在20xx年(nian)1月1日之前(qian)簽(qian)訂(ding)(ding)的(de)(de)(de),不能算(suan)“連(lian)續(xu)訂(ding)(ding)立(li)(li)二(er)次固(gu)(gu)定期(qi)限合(he)同(tong)(tong)”,因此你在第(di)二(er)份合(he)同(tong)(tong)期(qi)滿時想要簽(qian)訂(ding)(ding)無固(gu)(gu)定期(qi)限勞(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)是缺(que)乏法(fa)律依據的(de)(de)(de),即使(shi)提出了要求,單位也可以(yi)(yi)拒絕(jue)。

  四、另外應當說明的是(shi)(shi),簽(qian)訂(ding)了(le)無(wu)(wu)固(gu)定(ding)(ding)期(qi)限(xian)合(he)同,并不(bu)意味(wei)著勞(lao)(lao)(lao)動關系(xi)可存(cun)續至退休。實(shi)踐中,不(bu)少人認為(wei)簽(qian)訂(ding)了(le)無(wu)(wu)固(gu)定(ding)(ding)期(qi)限(xian)合(he)同,就等于有(you)了(le)“鐵飯碗”。其(qi)實(shi)不(bu)然,無(wu)(wu)固(gu)定(ding)(ding)期(qi)限(xian)合(he)同只是(shi)(shi)“無(wu)(wu)確(que)定(ding)(ding)終(zhong)止(zhi)時間”的勞(lao)(lao)(lao)動合(he)同,并非“終(zhong)身合(he)同”。因為(wei)它(ta)有(you)法(fa)定(ding)(ding)的解除、終(zhong)止(zhi)條件(jian)。只要出現(xian)《勞(lao)(lao)(lao)動合(he)同法(fa)》第39、40、41條所規定(ding)(ding)的可以解除勞(lao)(lao)(lao)動合(he)同的情況(kuang),如勞(lao)(lao)(lao)動者違反規章制(zhi)度(du),嚴重(zhong)失職、營私舞弊(bi),給單位造成重(zhong)大損失的等等,用人單位可以解除無(wu)(wu)固(gu)定(ding)(ding)期(qi)限(xian)合(he)同。

簽訂固定期限勞動合同14

  根據勞動合同法第十四條規(gui)定(ding),無(wu)固定(ding)期限勞動合同存在可以簽訂(ding)、應該簽訂(ding)及(ji)視(shi)為(wei)簽訂(ding)三種(zhong)情形:

  1、勞動者在該用(yong)人單(dan)位連續工(gong)作滿十年的。這(zhe)20xx年自用(yong)人單(dan)位用(yong)工(gong)之日起計算,包括勞動合(he)同實施前(qian)的工(gong)作時間(jian)。

  2、用(yong)人(ren)單(dan)位初次實行勞動(dong)合同(tong)制(zhi)度或者(zhe)國有(you)企業改(gai)制(zhi)重新訂立勞動(dong)合同(tong)時,勞動(dong)者(zhe)在(zai)該用(yong)人(ren)單(dan)位連續(xu)工作(zuo)滿(man)十(shi)年(nian)且(qie)距法定退休年(nian)齡不足十(shi)年(nian)的;

  3、連續(xu)(xu)訂(ding)立(li)二(er)(er)次(ci)固(gu)(gu)(gu)定期(qi)(qi)(qi)限(xian)(xian)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)(he)(he)同(tong)(tong)(tong),且勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)沒有本法(fa)第(di)三十(shi)九(jiu)條和(he)第(di)四十(shi)條第(di)一(yi)項(xiang)、第(di)二(er)(er)項(xiang)規定的(de)(de)情(qing)(qing)形,續(xu)(xu)訂(ding)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)(he)(he)同(tong)(tong)(tong)的(de)(de).。需要注(zhu)意(yi)的(de)(de)是,用(yong)人單位(wei)與(yu)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)連續(xu)(xu)二(er)(er)次(ci)固(gu)(gu)(gu)定期(qi)(qi)(qi)限(xian)(xian)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)(he)(he)同(tong)(tong)(tong),是指(zhi)自(zi)20xx年(nian)1月(yue)(yue)1日起,用(yong)人單位(wei)與(yu)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)的(de)(de)固(gu)(gu)(gu)定勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)(he)(he)同(tong)(tong)(tong)次(ci)數(shu),跨年(nian)度(du)的(de)(de)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)(he)(he)同(tong)(tong)(tong)和(he)僅(jin)約(yue)定試(shi)用(yong)期(qi)(qi)(qi)的(de)(de)合(he)(he)(he)(he)(he)同(tong)(tong)(tong)都(dou)可以視(shi)為(wei)一(yi)次(ci)固(gu)(gu)(gu)定期(qi)(qi)(qi)限(xian)(xian)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)(he)(he)同(tong)(tong)(tong),再次(ci)簽(qian)訂(ding)的(de)(de)合(he)(he)(he)(he)(he)同(tong)(tong)(tong)到期(qi)(qi)(qi)后,勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)不(bu)(bu)存在(zai)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)(he)(he)同(tong)(tong)(tong)法(fa)第(di)三十(shi)九(jiu)條和(he)第(di)四十(shi)條第(di)一(yi)項(xiang)、第(di)二(er)(er)項(xiang)規定的(de)(de)法(fa)定被(bei)解除勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)(he)(he)同(tong)(tong)(tong)情(qing)(qing)形的(de)(de),則用(yong)人單位(wei)應在(zai)合(he)(he)(he)(he)(he)同(tong)(tong)(tong)期(qi)(qi)(qi)滿(man)后與(yu)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)簽(qian)訂(ding)無固(gu)(gu)(gu)定期(qi)(qi)(qi)限(xian)(xian)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)(he)(he)同(tong)(tong)(tong)。另外,自(zi)20xx年(nian)1月(yue)(yue)1日后,試(shi)用(yong)期(qi)(qi)(qi)應包含在(zai)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)(he)(he)同(tong)(tong)(tong)期(qi)(qi)(qi)限(xian)(xian)內,勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)(he)(he)同(tong)(tong)(tong)僅(jin)約(yue)定試(shi)用(yong)期(qi)(qi)(qi)的(de)(de),試(shi)用(yong)期(qi)(qi)(qi)不(bu)(bu)成立(li),該期(qi)(qi)(qi)限(xian)(xian)為(wei)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)(he)(he)同(tong)(tong)(tong)期(qi)(qi)(qi)限(xian)(xian)。因此(ci),用(yong)人單位(wei)應注(zhu)意(yi)不(bu)(bu)要將試(shi)用(yong)期(qi)(qi)(qi)約(yue)定成一(yi)次(ci)固(gu)(gu)(gu)定期(qi)(qi)(qi)限(xian)(xian)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)(he)(he)同(tong)(tong)(tong)。

  三、視為簽(qian)訂:用(yong)人(ren)單位(wei)(wei)自用(yong)工(gong)之日起(qi)滿一(yi)年不(bu)與勞(lao)動(dong)者(zhe)(zhe)訂立書面勞(lao)動(dong)合同(tong)(tong)的,視為用(yong)人(ren)單位(wei)(wei)與勞(lao)動(dong)者(zhe)(zhe)已訂立無固(gu)定期限(xian)勞(lao)動(dong)合同(tong)(tong)。

  一、怎么簽訂固定期限勞動合同

  用(yong)人單(dan)位(wei)違(wei)反本法規定不(bu)與勞動者訂立固定期限(xian)勞動合(he)同(tong)的,自應當訂立固定期限(xian)勞動合(he)同(tong)之日(ri)起向(xiang)勞動者每月(yue)支付二(er)倍的工資。

  用(yong)人單位(wei)違反(fan)本(ben)法規定(ding)(ding)與勞(lao)(lao)動(dong)(dong)者約(yue)定(ding)(ding)試(shi)用(yong)期(qi)的,由勞(lao)(lao)動(dong)(dong)行政(zheng)部門(men)責令改正;違法約(yue)定(ding)(ding)的試(shi)用(yong)期(qi)已(yi)經履行的,由用(yong)人單位(wei)以勞(lao)(lao)動(dong)(dong)者試(shi)用(yong)期(qi)滿(man)月工(gong)資為標準,按(an)已(yi)經履行的超過法定(ding)(ding)試(shi)用(yong)期(qi)的期(qi)間(jian)向勞(lao)(lao)動(dong)(dong)者支付(fu)賠償(chang)金。

  用人單位違反本法規(gui)定(ding),扣(kou)押勞(lao)動者居民(min)身份證(zheng)等證(zheng)件的,由(you)勞(lao)動行(xing)政部門責令(ling)限期退(tui)還勞(lao)動者本人,并(bing)依照有關法律規(gui)定(ding)給(gei)予處罰。

  用(yong)人單位違(wei)反本(ben)法規定,以(yi)(yi)擔保(bao)或者其他名(ming)義向勞(lao)動者收取財物的(de),由勞(lao)動行(xing)政部門責(ze)令限期退還勞(lao)動者本(ben)人,并以(yi)(yi)每人五(wu)百元(yuan)以(yi)(yi)上二(er)千(qian)元(yuan)以(yi)(yi)下的(de)標準處以(yi)(yi)罰(fa)款;給(gei)勞(lao)動者造成損(sun)害的(de),應當承擔賠償責(ze)任。
