  【案(an)例(li)】王某(mou)是某(mou)國(guo)有企(qi)(qi)業內聘(pin)職工。20xx年3月(yue)他接到了該(gai)企(qi)(qi)業的書面通知。通知里講,王某(mou)的勞(lao)動(dong)(dong)合同于4月(yue)份期滿,屆(jie)時企(qi)(qi)業將不再與他續簽勞(lao)動(dong)(dong)合同。王某(mou)不服,與企(qi)(qi)業幾次交涉沒有結(jie)果后,就到勞(lao)動(dong)(dong)爭(zheng)議(yi)調(diao)解委員會申請調(diao)解。

  經了(le)(le)(le)(le)解,王(wang)(wang)某(mou)(mou)(mou)于(yu)1997年4月被(bei)企業聘為(wei)內(nei)聘職工,因此連續三年與企業簽訂(ding)了(le)(le)(le)(le)一(yi)年期的勞動合同。由(you)于(yu)這個(ge)企業效益(yi)不(bu)錯,離家又比較近,王(wang)(wang)某(mou)(mou)(mou)一(yi)家人(ren)都挺滿意。可是上(shang)班剛滿半年,王(wang)(wang)某(mou)(mou)(mou)就(jiu)被(bei)查出(chu)(chu)患上(shang)了(le)(le)(le)(le)乙肝病,一(yi)年后,又因乙肝病復發住(zhu)進(jin)了(le)(le)(le)(le)醫院。這次住(zhu)院治療,加上(shang)出(chu)(chu)院后的休息,他連續6個(ge)月沒(mei)有上(shang)班。因此,企業除(chu)了(le)(le)(le)(le)把工資改(gai)為(wei)生活(huo)費外,還(huan)做出(chu)(chu)決定:鑒于(yu)王(wang)(wang)某(mou)(mou)(mou)長期不(bu)能上(shang)班,原來由(you)企業給繳納(na)的社會(hui)保險費用,要求王(wang)(wang)某(mou)(mou)(mou)自己承擔。開始(shi),王(wang)(wang)某(mou)(mou)(mou)為(wei)了(le)(le)(le)(le)保住(zhu)內(nei)聘工的身份

  ,接(jie)受了企(qi)業(ye)的決(jue)定,但這次(ci)企(qi)業(ye)要終(zhong)止勞動(dong)合同,王某感到實在(zai)無(wu)法接(jie)受。他認為自(zi)己(ji)并沒(mei)有犯什么(me)錯誤,企(qi)業(ye)不(bu)能不(bu)要自(zi)己(ji)。該(gai)企(qi)業(ye)

  一是(shi)勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)期(qi)滿(man)(man)企業(ye)是(shi)否可以不(bu)與勞(lao)(lao)(lao)(lao)動(dong)(dong)者續簽(qian)(qian)勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)。根據《勞(lao)(lao)(lao)(lao)動(dong)(dong)法》第二十(shi)三條規定(ding):“勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)期(qi)滿(man)(man)或者當事(shi)人約(yue)定(ding)的勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)終止條件出現(xian),勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)即(ji)行(xing)終止”。延續勞(lao)(lao)(lao)(lao)動(dong)(dong)關系需要雙方訂立新(xin)的勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)。由于勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)訂立的原(yuan)則是(shi)自愿原(yuan)則,這也就意(yi)味著勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)期(qi)滿(man)(man)時,企業(ye)和勞(lao)(lao)(lao)(lao)動(dong)(dong)者都有(you)權(quan)不(bu)與對方續簽(qian)(qian)勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)。該企業(ye)不(bu)與王某續簽(qian)(qian)勞(lao)(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)并(bing)不(bu)違反法律規定(ding)。對這個問(wen)題(ti)企業(ye)(尤其是(shi)國有(you)企業(ye))還有(you)不(bu)少職工(gong)沒有(you)正確的認(ren)識。

  二是勞(lao)(lao)(lao)動(dong)合同(tong)終止(zhi)時,企業(ye)應(ying)(ying)(ying)(ying)履(lv)行哪些(xie)義(yi)(yi)務(wu)(wu)。根據《勞(lao)(lao)(lao)動(dong)法》的(de)(de)(de)規定,用(yong)人單位在終止(zhi)勞(lao)(lao)(lao)動(dong)合同(tong)時應(ying)(ying)(ying)(ying)履(lv)行相應(ying)(ying)(ying)(ying)的(de)(de)(de)義(yi)(yi)務(wu)(wu):1、提前一個月(yue)(yue)以書面形(xing)式通知(zhi)對(dui)方(fang)。2、應(ying)(ying)(ying)(ying)當(dang)向勞(lao)(lao)(lao)動(dong)者支(zhi)付經(jing)濟補(bu)償,其標(biao)準為(wei)(wei),在本單位工(gong)作每滿(man)(man)一年發給相當(dang)于本人一個月(yue)(yue)工(gong)資(zi)(zi)的(de)(de)(de)經(jing)濟賠償,最多不超過12個月(yue)(yue)。3、勞(lao)(lao)(lao)動(dong)者患(huan)(huan)病(bing)(bing)或者非因工(gong)負傷,勞(lao)(lao)(lao)動(dong)合同(tong)期(qi)(qi)(qi)滿(man)(man)終止(zhi)勞(lao)(lao)(lao)動(dong)合同(tong)的(de)(de)(de),用(yong)人單位應(ying)(ying)(ying)(ying)當(dang)支(zhi)付不低(di)于6個月(yue)(yue)工(gong)資(zi)(zi)的(de)(de)(de)醫(yi)療(liao)補(bu)助費;對(dui)患(huan)(huan)重病(bing)(bing)或絕(jue)癥的(de)(de)(de),還應(ying)(ying)(ying)(ying)當(dang)適當(dang)增加醫(yi)療(liao)補(bu)助費。4、用(yong)人單位有義(yi)(yi)務(wu)(wu)協助勞(lao)(lao)(lao)動(dong)者辦理就業(ye)登記和(he)失業(ye)保險(xian)手續(xu)等。5、對(dui)于勞(lao)(lao)(lao)動(dong)者患(huan)(huan)病(bing)(bing),或女職(zhi)工(gong)懷孕、生育和(he)哺(bu)乳的(de)(de)(de),其勞(lao)(lao)(lao)動(dong)合同(tong)期(qi)(qi)(qi)限應(ying)(ying)(ying)(ying)自動(dong)延續(xu)到(dao)醫(yi)療(liao)期(qi)(qi)(qi)、孕期(qi)(qi)(qi)、產(chan)期(qi)(qi)(qi)和(he)哺(bu)乳期(qi)(qi)(qi)期(qi)(qi)(qi)滿(man)(man)為(wei)(wei)止(zhi)。本案中用(yong)人單位未履(lv)行相應(ying)(ying)(ying)(ying)的(de)(de)(de)義(yi)(yi)務(wu)(wu)是不對(dui)的(de)(de)(de)。此外,該企業(ye)對(dui)患(huan)(huan)病(bing)(bing)職(zhi)工(gong)只發生活(huo)費的(de)(de)(de)做法不妥(tuo),勞(lao)(lao)(lao)動(dong)者應(ying)(ying)(ying)(ying)當(dang)享受相應(ying)(ying)(ying)(ying)的(de)(de)(de)醫(yi)療(liao)期(qi)(qi)(qi)和(he)病(bing)(bing)假(jia)工(gong)資(zi)(zi);要求王某自負應(ying)(ying)(ying)(ying)由單位負擔的(de)(de)(de)社會保險(xian)費用(yong)也欠妥(tuo)當(dang)。繳(jiao)納社會保險(xian)費用(yong)是用(yong)人單位的(de)(de)(de)法定義(yi)(yi)務(wu)(wu),不能隨(sui)意轉由勞(lao)(lao)(lao)動(dong)者個人負擔。

  案例二:勞動者因(yin)工(gong)負傷,應續簽勞動合同

  【案例】近日,西(xi)城法院(yuan)審(shen)結一起勞動爭(zheng)議案件,判決(jue)原(yuan)告(gao)某(mou)出租(zu)汽(qi)車公司與(yu)被(bei)告(gao)宋某(mou)續簽勞動合(he)同;原(yuan)告(gao)退還(huan)被(bei)告(gao)車輛價值保證金、營運收(shou)入保證金及合(he)同管理費共計1.4萬余元。

  原告(gao)(gao)(gao)某出租汽車公司(si)訴稱:1999年(nian)1月,我(wo)(wo)公司(si)與被(bei)(bei)告(gao)(gao)(gao)簽(qian)訂了(le)為期4年(nian)的(de)勞(lao)動(dong)(dong)合(he)同(tong)及營運任務(wu)承包(bao)合(he)同(tong)。20xx年(nian)2月,被(bei)(bei)告(gao)(gao)(gao)因疲勞(lao)駕駛發生(sheng)重大交通事故,有關部(bu)門認(ren)定(ding)被(bei)(bei)告(gao)(gao)(gao)負(fu)事故全部(bu)責任。20xx年(nian)1月20日,我(wo)(wo)公司(si)與被(bei)(bei)告(gao)(gao)(gao)續簽(qian)了(le)勞(lao)動(dong)(dong)合(he)同(tong),合(he)同(tong)期限至20xx年(nian)1月31日止。根據20xx年(nian)1月1日起(qi)執行的(de)《工(gong)傷保險條例》有關規定(ding),我(wo)(wo)公司(si)通知(zhi)被(bei)(bei)告(gao)(gao)(gao)不再續簽(qian)勞(lao)動(dong)(dong)合(he)同(tong),按(an)規定(ding)給予被(bei)(bei)告(gao)(gao)(gao)一(yi)次性(xing)補助(zhu)。被(bei)(bei)告(gao)(gao)(gao)的(de)個人行為致使《營運任務(wu)承包(bao)合(he)同(tong) 》中止,屬被(bei)(bei)告(gao)(gao)(gao)的(de)違約(yue)行為,故起(qi)訴要求不與被(bei)(bei)告(gao)(gao)(gao)續簽(qian)勞(lao)動(dong)(dong)合(he)同(tong),不退還被(bei)(bei)告(gao)(gao)(gao)的(de)車輛價值保證金、營運收(shou)入保證金及合(he)同(tong)管理費。

  被告(gao)宋某辯稱(cheng):我于20xx年(nian)被評定(ding)(ding)為7級傷(shang)殘,不(bu)應適用(yong)20xx年(nian)1月1日起執行的《工傷(shang)保(bao)(bao)險(xian)條例(li)》。勞(lao)動法明確規定(ding)(ding)用(yong)人單位不(bu)得以任何方式收(shou)取風險(xian)抵(di)押(ya)金,故(gu)車(che)輛價值保(bao)(bao)證金、營運(yun)收(shou)入(ru)保(bao)(bao)證金及(ji)合同管(guan)理(li)費應予(yu)以退還。

  法院(yuan)認(ren)為:被(bei)(bei)告(gao)(gao)于(yu)20xx年(nian)1月(yue)進(jin)行了工傷(shang)認(ren)定(ding),故原(yuan)(yuan)、被(bei)(bei)告(gao)(gao)之(zhi)間的糾紛不適用(yong)20xx年(nian)1月(yue)1日起(qi)實施的《工傷(shang)保險條例》。根(gen)據有關規定(ding),勞動(dong)者患職業病或者因(yin)工負傷(shang)并被(bei)(bei)確(que)認(ren)達到傷(shang)殘(can)等級,要求(qiu)續訂勞動(dong)合(he)同(tong)的`,用(yong)人(ren)單(dan)位應當續簽勞動(dong)合(he)同(tong)。被(bei)(bei)告(gao)(gao)因(yin)工傷(shang)致(zhi)使《營運任務承包合(he)同(tong)》無法履(lv)行,不屬于(yu)被(bei)(bei)告(gao)(gao)無故違(wei)約,故被(bei)(bei)告(gao)(gao)要求(qiu)原(yuan)(yuan)告(gao)(gao)退(tui)還部(bu)分車輛價值保證(zheng)金(jin)、營運收入保證(zheng)金(jin)及(ji)合(he)同(tong)管(guan)理費,理由正(zheng)當。

  【案(an)例】劉(liu)(liu)先(xian)(xian)生(sheng)(sheng)在某公(gong)司已經連(lian)(lian)續(xu)(xu)(xu)(xu)工(gong)作多年(nian)(nian)(nian),公(gong)司只與(yu)(yu)劉(liu)(liu)先(xian)(xian)生(sheng)(sheng)簽(qian)(qian)(qian)訂(ding)過(guo)一(yi)(yi)次三(san)年(nian)(nian)(nian)期(qi)限(xian)(xian)的勞(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)(he)(he)同(tong),此后雙方(fang)雖然未再續(xu)(xu)(xu)(xu)簽(qian)(qian)(qian)勞(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)(he)(he)同(tong),但(dan)還是(shi)繼續(xu)(xu)(xu)(xu)保持了原工(gong)作關系。工(gong)作中,劉(liu)(liu)先(xian)(xian)生(sheng)(sheng)聽(ting)說(shuo)勞(lao)動(dong)(dong)(dong)(dong)法(fa)規(gui)定:只要(yao)連(lian)(lian)續(xu)(xu)(xu)(xu)工(gong)作十(shi)年(nian)(nian)(nian)以上的,用人單(dan)位就(jiu)應當與(yu)(yu)勞(lao)動(dong)(dong)(dong)(dong)者(zhe)續(xu)(xu)(xu)(xu)簽(qian)(qian)(qian)無固定期(qi)限(xian)(xian)勞(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)(he)(he)同(tong)。于(yu)是(shi),劉(liu)(liu)先(xian)(xian)生(sheng)(sheng)就(jiu)格外關注(zhu)自己的連(lian)(lian)續(xu)(xu)(xu)(xu)工(gong)作年(nian)(nian)(nian)限(xian)(xian)。某日,劉(liu)(liu)先(xian)(xian)生(sheng)(sheng)計算(suan)出剛(gang)好在該公(gong)司連(lian)(lian)續(xu)(xu)(xu)(xu)工(gong)作滿十(shi)年(nian)(nian)(nian),于(yu)是(shi)就(jiu)找(zhao)公(gong)司領(ling)(ling)導商議,要(yao)求(qiu)公(gong)司按勞(lao)動(dong)(dong)(dong)(dong)法(fa)的規(gui)定續(xu)(xu)(xu)(xu)簽(qian)(qian)(qian)一(yi)(yi)份無固定期(qi)限(xian)(xian)勞(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)(he)(he)同(tong)。公(gong)司領(ling)(ling)導認為(wei)公(gong)司的后續(xu)(xu)(xu)(xu)經營存在一(yi)(yi)定問題,目前難以與(yu)(yu)劉(liu)(liu)先(xian)(xian)生(sheng)(sheng)續(xu)(xu)(xu)(xu)簽(qian)(qian)(qian)無固定期(qi)限(xian)(xian)勞(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)(he)(he)同(tong),但(dan)表示:由于(yu)工(gong)作疏忽(hu),多年(nian)(nian)(nian)來未與(yu)(yu)劉(liu)(liu)先(xian)(xian)生(sheng)(sheng)簽(qian)(qian)(qian)訂(ding)過(guo)勞(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)(he)(he)同(tong),以致雙方(fang)長期(qi)處于(yu)無合(he)(he)(he)(he)(he)同(tong)狀(zhuang)況,現愿意(yi)馬上與(yu)(yu)劉(liu)(liu)先(xian)(xian)生(sheng)(sheng)續(xu)(xu)(xu)(xu)簽(qian)(qian)(qian)一(yi)(yi)份三(san)年(nian)(nian)(nian)期(qi)限(xian)(xian)的勞(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)(he)(he)同(tong)。可是(shi)劉(liu)(liu)先(xian)(xian)生(sheng)(sheng)不同(tong)意(yi),堅持要(yao)求(qiu)

  公司續簽(qian)無固定期限(xian)的勞(lao)動合同。經過幾次協(xie)商,雙方(fang)還是各持己見,以(yi)致(zhi)合同續簽(qian)的問題一時難(nan)以(yi)確定。

  一個月后,公(gong)司(si)發現(xian)劉(liu)先(xian)(xian)(xian)生仍(reng)然堅持要求續簽(qian)無固定(ding)期限勞(lao)動(dong)(dong)合(he)同,于是(shi)就(jiu)書面通知(zhi)劉(liu)先(xian)(xian)(xian)生:如劉(liu)先(xian)(xian)(xian)生在一周內不與公(gong)司(si)續簽(qian)三年(nian)期限的勞(lao)動(dong)(dong)合(he)同,則公(gong)司(si)只能依照規(gui)定(ding)通知(zhi)劉(liu)先(xian)(xian)(xian)生終止勞(lao)動(dong)(dong)關系。接到公(gong)司(si)的通知(zhi)后,劉(liu)先(xian)(xian)(xian)生即向(xiang)勞(lao)動(dong)(dong)爭(zheng)議仲(zhong)裁委員會提起申訴,要求公(gong)司(si)與自己簽(qian)訂無固定(ding)期限勞(lao)動(dong)(dong)合(he)同。

  劉先(xian)生認(ren)為(wei):根據勞動法(fa)的(de)規定,自己在公司已連續工作(zuo)十年(nian)以(yi)上,用人單位就應(ying)當與自己續簽無固(gu)定期限勞動合同(tong)。

  公(gong)司認為(wei):勞(lao)(lao)動法規定簽訂勞(lao)(lao)動合同(tong)應當(dang)協商一致,公(gong)司只同(tong)意與(yu)劉(liu)先生續簽三年期限的勞(lao)(lao)動合同(tong),雙方協商不成(cheng),公(gong)司可以(yi)按規定提前通知終止勞(lao)(lao)動關系。

  【評析】本案的(de)爭議焦點是劉先生(sheng)在未有勞動合同的(de)情況下是否(fou)可(ke)以工作年限滿(man)十年即提(ti)出(chu)續簽無固定期限合同的(de)要求。

  《勞(lao)動(dong)(dong)(dong)法》第十六條規(gui)(gui)(gui)定(ding)(ding):“建(jian)立勞(lao)動(dong)(dong)(dong)關系應(ying)當訂(ding)立勞(lao)動(dong)(dong)(dong)合同(tong)”;第十七條規(gui)(gui)(gui)定(ding)(ding):“訂(ding)立和變更(geng)勞(lao)動(dong)(dong)(dong)合同(tong),應(ying)當遵循平(ping)等自愿、協(xie)(xie)商一致(zhi)的(de)原則(ze),不(bu)(bu)得違反(fan)法律、行(xing)政法規(gui)(gui)(gui)的(de)規(gui)(gui)(gui)定(ding)(ding)”。根據(ju)以上規(gui)(gui)(gui)定(ding)(ding),勞(lao)動(dong)(dong)(dong)合同(tong)是(shi)勞(lao)動(dong)(dong)(dong)者(zhe)與(yu)用人(ren)單位確(que)(que)立勞(lao)動(dong)(dong)(dong)關系的(de)標志(zhi),訂(ding)立(包括續訂(ding))勞(lao)動(dong)(dong)(dong)合同(tong),應(ying)當遵循平(ping)等自愿、協(xie)(xie)商一致(zhi)的(de)原則(ze)。那么,當事人(ren)未簽訂(ding)勞(lao)動(dong)(dong)(dong)合同(tong)(或經協(xie)(xie)商不(bu)(bu)一致(zhi)簽訂(ding)不(bu)(bu)成(cheng))但又維(wei)持勞(lao)動(dong)(dong)(dong)關系的(de)性(xing)質如何確(que)(que)定(ding)(ding)?

  《上(shang)(shang)海(hai)(hai)市勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)條(tiao)(tiao)例》第二十(shi)七條(tiao)(tiao)規(gui)定(ding):“應(ying)當(dang)(dang)(dang)訂(ding)立(li)(li)書面(mian)勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)而(er)未(wei)訂(ding)立(li)(li),但(dan)勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)者(zhe)按照(zhao)用(yong)人單位(wei)要求履行了勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)義務的(de),當(dang)(dang)(dang)事(shi)(shi)人的(de)勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)關(guan)系成立(li)(li)”。根(gen)據以上(shang)(shang)規(gui)定(ding),當(dang)(dang)(dang)事(shi)(shi)人符合(he)(he)(he)訂(ding)立(li)(li)勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)的(de)所有(you)條(tiao)(tiao)件(jian)但(dan)未(wei)簽訂(ding)書面(mian)勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong),則確認當(dang)(dang)(dang)事(shi)(shi)人雙(shuang)方之間具有(you)勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)的(de)關(guan)系。由于“應(ying)訂(ding)未(wei)訂(ding)”是一種(zhong)事(shi)(shi)實上(shang)(shang)的(de)勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)關(guan)系,當(dang)(dang)(dang)事(shi)(shi)人在勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)關(guan)系存(cun)續期限上(shang)(shang)存(cun)在不確定(ding)性(xing),因此,《上(shang)(shang)海(hai)(hai)市勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)條(tiao)(tiao)例》第四十(shi)條(tiao)(tiao)規(gui)定(ding):“應(ying)當(dang)(dang)(dang)訂(ding)立(li)(li)勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)而(er)未(wei)訂(ding)立(li)(li)的(de),勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)者(zhe)可以隨時(shi)終(zhong)止勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)關(guan)系;用(yong)人單位(wei)提(ti)(ti)出終(zhong)止勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)關(guan)系,應(ying)當(dang)(dang)(dang)提(ti)(ti)前三十(shi)日通知(zhi)勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)者(zhe)”,該條(tiao)(tiao)款對當(dang)(dang)(dang)事(shi)(shi)人雙(shuang)方提(ti)(ti)出終(zhong)止事(shi)(shi)實勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)(dong)(dong)關(guan)系的(de)期限作了規(gui)定(ding)。

  那么,當事人(ren)之間未(wei)簽訂(ding)書面合同,勞動(dong)者(zhe)連(lian)續工作十(shi)年(nian)以上時,用(yong)人(ren)單位(wei)是否可(ke)以依據前條(tiao)規定以提(ti)前三十(shi)日通知勞動(dong)者(zhe)的方式提(ti)出終止(zhi)勞動(dong)關系?

  上海市勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)和社(she)會保障局關(guan)于實施《上海市勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong)條(tiao)例》若干問(wen)題的通(tong)知(二)規定:“應當訂(ding)立(li)書(shu)面勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong)而(er)(er)未訂(ding)立(li),勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)在(zai)同(tong)(tong)(tong)一(yi)用(yong)(yong)(yong)人(ren)單位(wei)連(lian)續工(gong)作滿(man)(man)十年以上,雙(shuang)方繼(ji)續存在(zai)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)關(guan)系狀態,用(yong)(yong)(yong)人(ren)單位(wei)未依(yi)據《條(tiao)例》第四十條(tiao)規定通(tong)知終止勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)關(guan)系的,勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)提出訂(ding)立(li)無(wu)固定期限勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong),用(yong)(yong)(yong)人(ren)單位(wei)應當與(yu)其訂(ding)立(li)無(wu)固定期限勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong)”。根據以上規定:勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)在(zai)同(tong)(tong)(tong)一(yi)用(yong)(yong)(yong)人(ren)單位(wei)連(lian)續工(gong)作滿(man)(man)十年以上,雙(shuang)方應當訂(ding)立(li)書(shu)面勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong)而(er)(er)未訂(ding)立(li),但又繼(ji)續保留勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)關(guan)系狀態,而(er)(er)此時用(yong)(yong)(yong)人(ren)單位(wei)尚未依(yi)據規定通(tong)知勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)終止勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)關(guan)系,在(zai)此前提下,勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)提出訂(ding)無(wu)固定期限勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong),用(yong)(yong)(yong)人(ren)單位(wei)就應當與(yu)其訂(ding)立(li)。

  本案中,劉(liu)(liu)先(xian)生在(zai)三年期勞(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)期滿后(hou)繼續(xu)在(zai)公(gong)(gong)司連續(xu)工(gong)作滿十年,當(dang)事人(ren)之(zhi)(zhi)間未再(zai)續(xu)簽勞(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong),劉(liu)(liu)先(xian)生與(yu)公(gong)(gong)司屬(shu)于“應訂未訂”的(de)勞(lao)(lao)動(dong)(dong)關(guan)系(xi)(xi)并處(chu)于繼續(xu)存在(zai)勞(lao)(lao)動(dong)(dong)關(guan)系(xi)(xi)的(de)狀(zhuang)態。此時,用人(ren)單位如(ru)依(yi)據《上海市勞(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)條(tiao)(tiao)例》第四(si)十條(tiao)(tiao)的(de)規定(ding)(ding)提前(qian)通知(zhi)劉(liu)(liu)先(xian)生終止勞(lao)(lao)動(dong)(dong)關(guan)系(xi)(xi)的(de),則雙(shuang)方勞(lao)(lao)動(dong)(dong)關(guan)系(xi)(xi)可以按公(gong)(gong)司的(de)通知(zhi)而(er)終止;但劉(liu)(liu)先(xian)生在(zai)公(gong)(gong)司依(yi)據規定(ding)(ding)提前(qian)通知(zhi)終止勞(lao)(lao)動(dong)(dong)關(guan)系(xi)(xi)之(zhi)(zhi)前(qian)提出訂立無固定(ding)(ding)期限勞(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong),因此,公(gong)(gong)司應當(dang)與(yu)其訂立無固定(ding)(ding)期限勞(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)。

  案例四:強(qiang)迫續訂(ding)勞動合同(tong)應為無效

  【案例】王某是某公(gong)司(si)的部(bu)門經理,20xx年(nian)12月,與公(gong)司(si)簽訂的為(wei)期(qi)(qi)三年(nian)的勞(lao)動合同到(dao)期(qi)(qi)。在合同期(qi)(qi)滿前(qian)一個月,他向公(gong)司(si)人(ren)事部(bu)提出合同期(qi)(qi)滿不再(zai)續簽的書面(mian)報告。合同期(qi)(qi)滿后,去人(ren)事部(bu)辦理調(diao)(diao)離(li)手續遭到(dao)拒(ju)絕。理由是,根據(ju)《員工(gong)守則(ze)》規定(ding),凡到(dao)公(gong)司(si)工(gong)作的人(ren)員至少應服務(wu)5年(nian),所以必須與公(gong)司(si)再(zai)續簽兩年(nian)合同,否則(ze)就要交20xx元違約金才能調(diao)(diao)離(li)。

  【評析(xi)】公(gong)(gong)司(si)(si)的(de)(de)(de)這種(zhong)做法是錯(cuo)誤(wu)的(de)(de)(de),因為(wei)(wei)雙(shuang)方(fang)是否續訂合同(tong),應按(an)照平等自(zi)愿(yuan)的(de)(de)(de)原則(ze)(ze),由當事(shi)人(ren)(ren)協商決定(ding)。任(ren)何(he)一(yi)(yi)方(fang)都不(bu)能(neng)強迫對(dui)方(fang)接(jie)受自(zi)己(ji)續簽(qian)勞(lao)(lao)動(dong)(dong)合同(tong)的(de)(de)(de)要求。《員工守(shou)(shou)(shou)則(ze)(ze)》只是公(gong)(gong)司(si)(si)的(de)(de)(de)內部(bu)規章制度,即使該守(shou)(shou)(shou)則(ze)(ze)在公(gong)(gong)司(si)(si)與王(wang)某簽(qian)訂勞(lao)(lao)動(dong)(dong)合同(tong)之前就已頒布實施,但鑒于該守(shou)(shou)(shou)則(ze)(ze)只是一(yi)(yi)個一(yi)(yi)般性的(de)(de)(de)約(yue)定(ding),針對(dui)的(de)(de)(de)對(dui)象是全體員工,而勞(lao)(lao)動(dong)(dong)合同(tong)只針對(dui)特(te)定(ding)的(de)(de)(de)當事(shi)人(ren)(ren)。當初(chu)他和(he)公(gong)(gong)司(si)(si)簽(qian)訂的(de)(de)(de)是三年期勞(lao)(lao)動(dong)(dong)合同(tong),不(bu)管是公(gong)(gong)司(si)(si)疏(shu)忽也(ye)好,愛才(cai)也(ye)罷,總之是以特(te)別(bie)約(yue)定(ding)的(de)(de)(de)方(fang)式排除了(le)《員工守(shou)(shou)(shou)則(ze)(ze)》的(de)(de)(de)有(you)關規定(ding)。在這種(zhong)情況下,兩者對(dui)服務期限的(de)(de)(de)規定(ding)發(fa)生沖突時,按(an)照“特(te)別(bie)優于一(yi)(yi)般”的(de)(de)(de)原則(ze)(ze),應執行(xing)(xing)(xing)勞(lao)(lao)動(dong)(dong)合同(tong)約(yue)定(ding)的(de)(de)(de)期限。至于交20xx元違約(yue)金才(cai)能(neng)調離的(de)(de)(de)說法,同(tong)樣(yang)沒有(you)任(ren)何(he)法律根據。違約(yue)金是對(dui)違約(yue)方(fang)違約(yue)行(xing)(xing)(xing)為(wei)(wei)的(de)(de)(de)一(yi)(yi)種(zhong)懲罰性措施,即只有(you)發(fa)生了(le)一(yi)(yi)定(ding)的(de)(de)(de)違約(yue)行(xing)(xing)(xing)為(wei)(wei),才(cai)發(fa)生違約(yue)金的(de)(de)(de)支付。勞(lao)(lao)動(dong)(dong)合同(tong)已經履行(xing)(xing)(xing)完畢而告(gao)終止,其間并無(wu)任(ren)何(he)的(de)(de)(de)違約(yue)行(xing)(xing)(xing)為(wei)(wei),故而20xx元違約(yue)金無(wu)從(cong)說起。

  勞動合同終止后,經雙方協商一致,還可重新訂立勞動合同。

  續訂勞動(dong)合(he)同(tong)(tong)的基本要求和訂立勞動(dong)合(he)同(tong)(tong)一(yi)樣,應堅持平等自(zi)愿、協商一(yi)致的原(yuan)則,不得(de)違反(fan)法律(lv)、法規(gui)、規(gui)章的規(gui)定。根據(ju)《天津市實施勞動(dong)合(he)同(tong)(tong)制度(du)規(gui)定》,勞動(dong)合(he)同(tong)(tong)期滿(man),經當(dang)事(shi)人雙方協商同(tong)(tong)意延續勞動(dong)合(he)同(tong)(tong)的,應當(dang)在合(he)同(tong)(tong)期滿(man)前 15日內辦理續延手續。

  2、勞動(dong)合(he)同(tong)約(yue)定的勞動(dong)報酬(chou)和勞動(dong)條(tiao)件(jian)在(zai)實際履(lv)行中發生變(bian)化而勞動(dong)合(he)同(tong)未依法變(bian)更(geng)的,實際履(lv)行的'勞動(dong)報酬(chou)和勞動(dong)條(tiao)件(jian)如(ru)低(di)于(yu)勞動(dong)合(he)同(tong)約(yue)定,不得作為續簽(qian)勞動(dong)合(he)同(tong)的最低(di)標(biao)準。

  3、勞(lao)(lao)動(dong)合同(tong)期滿(man)用人單位(wei)不再續訂的,應(ying)(ying)提前(qian)30日開具《終(zhong)止勞(lao)(lao)動(dong)合同(tong)通(tong)(tong)知(zhi)書》通(tong)(tong)知(zhi)職工(gong)本人。用人單位(wei)未提前(qian)通(tong)(tong)知(zhi)或提前(qian)通(tong)(tong)知(zhi)不足30日的,可以支付職工(gong)本人一個月工(gong)資的補償(chang)金,視為提前(qian)30日通(tong)(tong)知(zhi),勞(lao)(lao)動(dong)合同(tong)期滿(man)即終(zhong)止,雙(shuang)方應(ying)(ying)按有關規定辦理勞(lao)(lao)動(dong)合同(tong)終(zhong)止手(shou)續。

  4、員(yuan)工若患有職業病或(huo)其因工負傷并(bing)被確認達到規定的(de)傷殘等級,要求續訂勞(lao)動合(he)同(tong)的(de),企業應與其續訂合(he)同(tong)。

  5、員工若在企業(ye)連續工作(zuo)滿10年以(yi)上,在續訂勞動(dong)合(he)同時(shi),其要求續訂無固定期限勞動(dong)合(he)同的(de),企業(ye)應與其續訂無固定期限勞動(dong)合(he)同。

  6、勞(lao)動(dong)(dong)合(he)同(tong)期滿后,企業(ye)不想續(xu)訂(ding)(ding)合(he)同(tong),但未(wei)能與(yu)員(yuan)工(gong)辦理終止勞(lao)動(dong)(dong)合(he)同(tong)手續(xu),形成事實(shi)勞(lao)動(dong)(dong)關系的(de),視為續(xu)延(yan)勞(lao)動(dong)(dong)合(he)同(tong),企業(ye)應(ying)當與(yu)員(yuan)工(gong)續(xu)訂(ding)(ding)勞(lao)動(dong)(dong)合(he)同(tong)。雙方就續(xu)訂(ding)(ding)勞(lao)動(dong)(dong)合(he)同(tong)期限(xian)協(xie)商不能達成一(yi)致意見的(de),續(xu)訂(ding)(ding)勞(lao)動(dong)(dong)合(he)同(tong)的(de)期限(xian)從雙方簽字之(zhi)日(ri)起,不得少(shao)于一(yi)年。

  中華人民(min)共和國勞(lao)動合同法(fa)相關(guan)規定:

  第十四條(tiao) 無固定(ding)期限(xian)勞動(dong)合同,是(shi)指用人單位與勞動(dong)者約定(ding)無確(que)定(ding)終止時間的勞動(dong)合同。
